Más en concreto, con la aparición de la ilustración francesa y alemana, comienza a desarrollarse la idea de que en una guerra los únicos que deben ser objeto de ataque y destrucción son aquellos que participan directamente en ella. De este modo, se empieza a entender que la población civil no tiene que ser objeto de ataques ni de intentos de agresión. Por primera vez y de forma consciente se entiende que en la guerra hay una distinción entre aquellos que forman parte directamente en ella, normalmente los estados y sus respectivos ejércitos, y la población civil, es decir, los ciudadanos de esos estados que, incluso aunque se entiendan representados por el estado en guerra, no forman parte de ella. esta distinción, que es clave en la filosofía política moderna, da lugar al concepto a través del cual se articula Massacres and Morality: civilian inmunity (inmunidad civil)1, haciéndose mención al uso práctico que ha tenido en la historia de las guerras y conflictos armados en los dos últimos siglos de historia mundial. esta civilian immunity ha tenido diversos momentos en su desarrollo conceptual. Desde sus primeras descripciones en diferentes tratados legales, hasta la Declaración de san Petersburgo (1868) o la Primera Convención de ginebra (1864), con especial atención al período justamente posterior al Holocausto (pp. 17-27), esta idea empezó siendo formulada como un principio moral interno a diferentes tradiciones éticas y acabó por convertirse en una norma dependiente de convenciones internacionales. Después de la segunda guerra Mundial, se convirtió, además, en un principio aceptado e incorporado (embedded) al sistema de normas que integran el Derecho internacional Público.
