One of the largest in Indonesia is the Shopee marketplace. In the Shopee application there is a payment feature that can be made in stages, known as Spaylater. In this study, the theory used is the sale and purchase contract, loan contract, hiwalah contract and usury. This research uses the type of field research or field studies using a qualitative approach. This research was conducted on the Shopee application, where in the Shopee application there is an online loan feature called Spaylater. This feature makes it easy for users to make transactions, because Spaylater itself offers bailouts for users who want to transact but do not have cash. Then the researchers used primary data obtained from interviews with informants in accordance with the research problem. While secondary data, researchers obtained from books, journals, articles from the internet, DSN-MUI Fatwa and theories related to Islamic law. Then for the data collection method using observation, interviews and documentation. The results of this study indicate that if the activation of the Spaylater user is successful, the user can use the limit that has been given. Then regarding the view of Islamic law, looking at Spaylater, namely in the Spaylater mechanism there are conditions for contracts that are not fulfilled in Spaylater. Because in it there is a late fee given by the Spaylater, this late penalty is included in usury jahiliyah. But in the fatwa MUI only provides an explanation of the criteria for the type of effect that can be categorized as a sharia effect and what transactions should not be done in stocks globally without explaining the concept of reference fiqh in the screening process of sharia shares. This research wants to uncover the facts of fiqh buried in the classical books. This research aims to find out the concept of fiqh which is a reference for the establishment of Islamic law in the process of screening sharia shares, and how to use the concept of fiqh in determining the criteria for screening sharia stocks. So that it provides income certainty and has a lower risk than cooperation contracts (musyarakah and mudharabah) which are natural uncertainty contracts. However, in its development there is a musyarakah mutanaqishah contract which is a hybrid contract by combining musyarakah, ijarah and buying and selling contracts. Meanwhile, ijarah and buying and selling contracts are natural certainty contracts. This research will reveal the transformation of natural uncertainty contracts on the analysis of musyarakah mutanaqishah contracts in LKS. This study uses a normative juridical approach which is described by a descriptive method of literature from primary data sources and also secondary data. The type of this research is qualitative research with data analysis techniques in the form of focusing data, presenting data and drawing conclusions. The results of this study reveal the fact that there is a transformation of musyarakah contracts, which include natural uncertainty contracts, into musyarakah mutanaqishah contracts, which are hybrid contracts with business activities using ijarah contracts and buying and selling as natural certainty contracts. The results of the study indicate that the claimant and the parties referred to in the lawsuit have both made mistakes in the murabahah contract that has been agreed upon, and in terms of the judges' considerations at each level, it shows that the councils of the Religious Courts and the High Religious Courts passed things that should have been examined. namely the condition of negligence of obligations carried out by the plaintiff. The considerations conveyed by the assembly can certainly miss the sharia economic principle, namely the Taawun concept because the plaintiff's condition is sick and the plaintiff can prove it. As an institution that provides financing (creditors), it is certainly not possible to issue a warning letter if the debtor does not have any errors. The occurrence of problems such as layoffs, unemployment, rising poverty rates, and economic growth is seldom enough to necessitate a remedy. The goal of this research is to see how Islamic economics might help with post-pandemic economic recovery. This research employs a qualitative descriptive approach, as well as content analysis and a literature review (library research). Secondary data was obtained from the institution's official website. The study's findings show that Islamic economics, when combined with the framework of the national economy, makes a positive contribution to dealing with and improving post-pandemic economic conditions, including: (a) special instruments that can protect vulnerable groups of people, such as philanthropic models of zakat management, infaq, waqf, shodaqoh, and tafakul; (b) philanthropic models of zakat management, infaq, (b) Islamic financial development features and tools that assist and recover the UMKM sector through risk-sharing economic growth and prosperity, as well as simpler processes that increase social welfare. c) Capital development and distribution as a means of reviving the green economy (green economy).
