In the report to the 19th Party Congress, Xi Jinping made two direct references to ‘intra-party regulations.’ One was when summarising the achievements of 5 years of work since the 18th Party Congress: ‘the reform of the Party building system has been further advanced, and the intra-party regulatory system has been continuously improved.’ The other was when expressing expectations for future work. On the latter, Xi stated a need to ‘strengthen ability to govern according to the law, speed up the formation of an intra-party regulatory system that covers all aspects of Party leadership and Party building, and strengthen and improve the leadership of the Party over state organs of power.’ This background partly explains why the Central Committee of the Chinese Communist Party (CCP) issued a flurry of intra-party regulations around 2019. Amongst them, in September 2019, it issued the revised Chinese Communist Party Intra-Party Regulation Formulation Regulations (2019 Revision) (《中国共产党党内法规制定条例》), the Chinese Communist Party Intra-Party Regulation and Normative Document Filing and Review Provisions (2019 Revision) ( 《中国共产党党内法规和规范性文件备案审查规定》), and the newly formulated Chinese Communist Party Provisions on the Responsibility System for Intra-Party Regulation Implementation (for Trial Implementation) ( 《中国共产 党党内法规执行责任制规定 (试行)》). These three documents, together with the FiveYear Plan Outline for Central Intra-Party Regulation Formulation Work (2013–2017) ( 《中 央党内法规制定工作五年规划纲要(2013–2017)》) issued in 2013, all appear in translated form in this issue of Chinese Law and Government. Article 2 Party organisations at all levels, and the entire body of Party members, bear an obligation to observe intra-party regulations and to protect the authority of intraparty regulations. Party organisations at all levels and Party member leading cadres must strengthen the Four Consciousnesses, firm up the Four Confidences, and live up to the Two Protects, firmly establish the notion that to implement regulations is a basic duty and ineffective implementation is a failure to fulfill a duty, and effectively assume the political responsibility of implementing intra-party regulations. Article 3 Under the Party Centre’s centralised, unified leadership, build and improve a regulation implementation responsibility system whereby Party committees exercise unified leadership, Party committee general offices (offices) choreograph and coordinate (统筹协调 ), primary management departments head up responsibilities (牵头负责 ), relevant units assist and cooperate, and the Party’s discipline inspection organs strictly supervise; the whole and the parts form a synergy and each performs their respective functions, each level grasps a level and all levels knuckle down to implement. Article 4 Party committees at all local levels assume principal responsibility (主体责 任 ) for their localities’ intra-party regulation implementation work, should resolutely implement the decisions and deployments of the Party Centre and the decisions of higher-level Party organisations, take the lead in strictly implementing intra-party regulations, and lead, organise, and advance intra-party regulation implementation work in their localities, and support and supervise their localities’ Party organisations and Party member leading cadres in performing regulation implementation responsibilities. As the process of ‘comprehensively deepening reform’ develops, the CCP seeks to promote its notion of ‘reform’ and the ‘rule of law,’ advancing ‘comprehensive strict governance of the Party’ (全面从严治党) and ‘comprehensive law-based governance of the country’ (全面依法治国) as an integrated whole, and pursuing an ‘organic unity’ of ‘governing the country according to law and governing the Party according to regulations.’ As a natural consequence, this approach creates new institutional demands and social foundations for the development of intra-party regulations. This article analyses the origin of intra-party regulations, examines the intersection between intra-party regulations and the project of building a ‘rule of law China,’ and probes intra-party regulation development trends. The driving factor is the country’s distinct party system. Different from the ‘power-limiting model’ to which political parties belong in the constitutions of the United States and countries of Europe, China’s political party system belongs to an ‘empowerment model’—a model that has been strengthened over the past decade. Under the ideology of ‘the Party leads everything’, intra-party regulations are no longer limited to regulating Party organisations and Party members but instead extend to a wide range of matters of public administration. This article examines the system-building project through the lens of the Party’s relationship with its state. It draws on a comparative analysis of the different iterations of the Party Charter since the Party became ‘governing party,’ and of pre- and post-19th Party Congress versions of the foundational documents of the intra-party regulatory system. It argues that since the 19th Congress Party Charter transformed the Party’s longstanding articulation of its own identity, redefining ‘Party leadership,’ the intra-party regulatory system has begun to reflect this change. ‘Party leadership’ is by nature relational—it cannot be defined or practiced in a vacuum—hence the Party’s transformed notion of ‘Party leadership’ entails a reconfigured Party–state relationship.
