Objective: to discuss the relationship between the current legislation in force in October 2022, after the regulation of telemedicine in Brazil, with the possibility of using technologies, in judicial medical expertise or telemedicine in that country. Methodology: This theoretical and qualitative work has a descriptive and explanatory nature, through bibliographic research, searching in databases, as well as analyzing doctrines, legislation and related jurisprudence, and through an ontological hermeneutic approach, relating the variables, advantages and risks , with the historical, theoretical, doctrinal and scientific technical basis. Discussion: Resolution number 317, of the National Council of Justice (CNJ) and national jurisprudence on the use of medical teleexpertise, contrast with the position of the national medical community, through the Federal Council of Medicine (CFM), whose understanding remains evident through opinions and resolutions, regarding the inoperability of such a practice currently. Conclusion: The contemporary national situation of teleexpertise is rudimentary, abstaining from scientific substrate, tools or other methodologies that allow its ethical, fair, legal implementation, free from external influences, under current conditions. Em 23 de julho de 2022, a OMS considerou a Monkeypox como Emergência de Saúde Pública de Importância Internacional. As consequências dessa virose são de interesse médico-legal. Objetivo: Descrever e discutir as principais consequências à saúde que são de interesse médico-legal advindas da doença Monkeypox. Metodologia: Revisão narrativa de literatura sobre Monkeypox realizada nas bases de dados de livre acesso Google Scholar, MEDLINE e SciELO sem delimitação temporal e com inclusão de artigos científicos obtidos na íntegra ou em sites de saúde oficiais da Organização Mundial da Saúde, do Centro de Controle e Prevenção de Doenças do Departamento de Saúde e Serviços Humanos dos Estados Unidos, bem como do Ministério da Saúde do Brasil, seguida de discussão sobre repercussões de interesse para a Medicina Legal e Perícia Médica. Marco conceitual: A Medicina Legal e Perícia Médica carece de compreensão sobre as possíveis consequências da Monkeypox em sua atuação, de forma que se fazem necessários estudos como este para auxílio na sua atuação em prol da justiça social. Resultados: A Monkeypox é autolimitada na maioria dos casos, sendo as principais manifestações febre; calafrio; adenomegalia; mialgia; e erupções cutâneas. Também podem ocorrer lesões orais, genitais ou retais, entre poucas a milhares. Sequelas comuns são as cicatrizes permanentes nos casos de superinfecção. Embora haja relato de sintomas de ansiedade e depressão, a prevalência dessas condições não está confirmada. A cegueira e as cicatrizes varioliformes são possíveis sequelas descritas, porém os efeitos da Monkeypox no médio e longo prazo ainda precisam ser estudados. Discussão: As principais sequelas encontradas na literatura foram cicatrizes e cegueira. Casos em que haja óbito ou sequelas podem gerar alegação de má prática médica, demandando avaliação pericial. Ainda, em tais situações, o paciente ou seus familiares podem recorrer a seguros para pagamento de coberturas contratadas. A perícia médica irá fazer a caracterização da situação e correlacionar com a cobertura prevista. Para que seja formalizado o afastamento de trabalhadores acometidos pela doença com pagamento de benefício previdenciário correspondente, será necessária perícia médica. Na ocorrência de doença com nexo de causalidade com o trabalho, o adoecimento pode ser equiparado a acidente de trabalho. A ocorrência de cegueira pode gerar deficiência sensorial compatível com o benefício de prestação continuada da assistência social. Considerações finais: A Medicina Legal e Perícia Médica pode fornecer elementos técnicos-científicos para o embasamento de concessão de benefícios ou para o estabelecimento de dano e nexo de causalidade nos casos de Monkeypox. Portanto, a perícia pode ser solicitada dentro das áreas penal, civil, securitária, previdenciária, ad","PeriodicalId":366101,"journal":{"name":"Perspectivas em medicina legal e pericias medicas","volume":"69 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"129242580","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Thereby, these patients’ treatment is a medical challenge due to the ethical-legal dilemma. This article aims to explore the conflict between the physician’s duty and respect for the patient’s autonomy, relating to the ethical and legal aspect. Methodology: an integrative review was made on the PubMed, Scielo, Capes Periódicos and Lilacs databases. Furthermore, the Federal Constitution, the Penal Code and the resolutions of the Federal Council of Medicine (CFM) on the subject were analyzed. Review: Article 5, item VI, of the Constitution of the Federative Republic of Brazil guarantees Brazilians and foreigners residing in the country freedom of conscience and belief, while CFM Resolution N. 1,021 / 80 imposes that the doctor must transfuse blood into the adult Witness of Jehovah patient in cases of risk of death, even without consent. This resolution is in accordance with article 135 of the Penal Code, which states: “medical or surgical intervention, without the consent of the patient or his legal representative, if justified by an imminent danger of death”. Conclusion: the limit between the patient’s autonomy and the physician’s duty is the threat of death, therefore, the doctor has the obligation to transfuse blood in these cases, without the need for consent, whether from the patient or its guardian.","PeriodicalId":366101,"journal":{"name":"Perspectivas em medicina legal e pericias medicas","volume":"186 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"127317509","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This article aims to elucidate the concept, scope and importance of this study for legal medicine. Material and method: This is an integrative review carried out in the period from August to September 2021, through searches in databases such as PubMed, SciELO and Google Academic. Descriptors were used: taphonomy, legal medicine and transformative phenomena. Results: Taphonomy is a study aimed at understanding the stages that human beings go through after their death, whether this phenomenon has a destructive transformation (autolysis, maceration and putrefaction) or conservative (mummification, calcification, saponification, freezing, corification and fossilization). Discussion: Destructive transformative phenomena are processes capable of accelerating the destruction of the body and all its composition, so the preservatives in corpses will be those that will delay the event of putrefaction, causing the usual characteristics of post-death to be modified in rhythm and time. In addition, they will be related to intrinsic and extrinsic factors. Conclusion: Death is not a moment, it is a gradual process until the vital cessation of vital functions of the individual or his brain death. Therefore, the cadaveric phenomena, which make up this study, define the alterations that the body undergoes during decomposition, being of extreme importance for legal medicine and criminal investigation.","PeriodicalId":366101,"journal":{"name":"Perspectivas em medicina legal e pericias medicas","volume":"12 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"124248417","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The police investigation on this felony requires the performance of forensic sexology, which, through the examination of the corpus delicti, is able to provide evidence about this heinous crime. The objective of the present study is to report a case of a death by stroke in a victim of suspected rape. Material and method: This is a qualitative and descriptive clinical case study, whose data collection took place through analysis of the expert report coming from the Thanatology Nucleus of the Legal Medicine Coordination of the Forensic Expertise of Canindé. Resultados: Female victim, 64 years old, brown, referred to the service for suspicious death, with a history of possible rape confessed by her son. On examination, voluminous intracranial bleeding and absence of apparent signs of trauma and recent sexual violence or sexual intercourse were evidenced. The analysis of material from vaginal and rectal swabs found only the presence of genetic material from the victim himself. Discussion: Upon expert examination, the suspicion of rape by the victim’s son was ruled out, demanding an analysis of the suspect’s psychological state, in order to justify his implausible confession. In addition, it was found that the victim’s death resulted from a hemorrhagic stroke. Conclusion: Thus, the forensic examination of forensic evidence is relevant, which contributes to the clarification of suspected cases and to the reliability of epidemiological data regarding rape. MATERIAL AND METHODS: Literature review using scientific articles (2021-2022), Treaty of Forensic Anthropology, Istanbul Protocol, Guidelines of resolution nº 414 of the National Council of Justice and Notebook of Official Questions of the Civil Judicial Police of the State of Mato Grosso. RESULTS: Almada et al. (2022) carried out a study of death in custody during state terrorism in Uruguay (1973-1985), and it was possible to observe that the profile of the victims was predominantly male with a mean age of 37 years. Most victims died violent deaths, the predominant cause of which was torture. Petersen (2022) offers his 30 years of experience working with documentation and prevention of torture, bringing the main points related to his visits to detention centers in different countries. DISCUSSION: It is not an easy job to abolish torture and mistreatment after a dictatorial regime, after all a culture of repression was created. It is believed that the denial by the rulers in the first years of democracy is decisive for the perpetuation of the practice in the country. The investigation and documentation clarify the facts and facilitate the exercise of criminal action, in addition to bringing the need for reparation and reimbursement by the State to the victims. CONCLUSION: The official requirements must be reformulated in order to contemplate the investigation of events and enable the creation of public policies.","PeriodicalId":366101,"journal":{"name":"Perspectivas em medicina legal e pericias medicas","volume":"110 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"121739700","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Objectives: To analyze the reports of the forensic examinations of personal injuries and precautionary measures carried out at IML Estácio de Lima – Maceió/AL, from 2018 to 2021, considering the changes that could be observed before and during the Covid-19 pandemic. Material and methods: Documentary, epidemiological, descriptive, and analytical study through sampling. The variables considered were: gender, age group, origin, verification of the occurrence of bodily harm, the instrument and means used in the aggression, in addition to the answers to the official questions related to bodily harm. Results: Of a total of 2208 reports, 743 were investigations resulting from bodily injury and 1465 were precautionary investigations. The highest percentage of the analyzed reports was of precautionary expertise, constituting 66.34% of the total, with a prevalence of males, representing 92.01%. Regarding the body injury expertise, there was a higher prevalence of females in the age group from 21 to 30 years. Discussion: It was observed that there was no relevant change in the expertise in the previous period and during the pandemic, as precautionary expertise was already predominant, maintaining the predominance of male, young adults. Regarding the body injury expertise, the female gender was more prevalent, representing 63.52% of the reports analyzed during the study. The most evident injuries were those produced by blunt instruments without associations, in a total of 1048, with mild bodily injuries predominating. Conclusion: In view of the findings the authors conclude that there was no significant quantitative or qualitative change related to the analyzed expertise, before and during the Covid-19 pandemic. The assessment of this damage continues to be quite imprecise, because it is an objectionable damage by the observer, measurable and valuable, however it has a large subjective component, both on the part of the subject who suffers from it, and on the part of the examiner. This article aims to present the current scenario in aesthetic damage valuation and to propose a new method for this purpose. METHOD: Bibliographic review of open access articles up to the year 2022, in Portuguese, Spanish and English. RESULTS: None of the existing methodologies proved to be sufficient to approach the real assessment of the damage that the aesthetic damage caused to the victims’ lives, none of the analyzed scales simultaneously evaluated the inherent characteristics of the lesion, the impacts on functionality and the psycho-emotional consequences. DISCUSSION: In Brazil, there are no definitive criteria for evaluating aesthetic damage. Currently, in order to reference and qualify the aesthetic damage, in addition to the detailed description of the condition, it is proposed to use an evaluative scale, the “gradual scale with seven degrees”, which is considered the most subjective method among the others. The difficulty of this assessment is a consensus in the literature and the real repercussions of aesthetic damage cannot be addressed by current methods, preventing the judge from awarding adequate compensation for the victim’s detriment. CONCLUSION: In order to contemplate all the fundamental aspects of the valuation as close as possible to the real impact of the damage, so that the judge can define the relevant compensation, we propose a new methodology for the evaluation of permanent aesthetic damage, composed of four tables that address objective and subjective criteria","PeriodicalId":366101,"journal":{"name":"Perspectivas em medicina legal e pericias medicas","volume":"1 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"127389495","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Among the reasons, forgetfulness and adverse effects caused by medication can be highlighted. With this scenario, it is understood that there is a need to carry out therapeutic monitoring of patients undergoing treatment for epilepsy. The OneDraw device, which allows you to obtain a capillary blood sample from its fixation in the upper part of the arm, eliminates some of the obstacles encountered in collecting capillary blood by the finger, such as pain, discomfort and waiting time. Material and methods: The validation of a method in High Performance Liquid Chromatography coupled to Mass Spectrometry (HPLC-MS/MS) was carried out, following the validation parameters of the Food and Drug Administration for the quantification of carbamazepine (CBZ) and Valproic acid (AV) in dry blood spots. Result: The method demonstrated high sensitivity for the detection of CBZ and AV in capillary blood samples. The detection limit of the method was 1.0 mg L-1 for CBZ and 10 mg L-1 for AV. Intra-assay precision was 3.29 to 6.75% for CBZ and 4.67 to 6.54% for AV. Discussion: Although other techniques exist, the use of HPLC-MS/MS is the main technique used for the analysis of anticonvulsants in DBS due to its high sensitivity and selectivity.
