In postindependence India, one of the most crucial issues was to maintain communal harmony between the Muslim minority and non-Muslim majority. Renowned Muslim Scholars and organisations came forward and expressed their concerns on the issue. However, Wahiduddin Khan (1925-2021) suggested a different methodology, contrary to his contemporaries. Through the application of descriptive and content analytical methods, this study investigates Khan’s ideas of communal harmony in post-independence India. The study found that Khan emphasised da’wah and peace activism. Contrary to his preceding views, he blamed the Muslim populace for communal disharmony in the country. Further, based on his reading of the Treaty of Ḥudaibiyyah, he recommended Muslims take a unilateral and passive step to establish communal harmony in the country and assumed it to be the only possible way for the Muslim minority. This study observes that Khan’s understanding of Ḥudaibiyyah is questionable as he ignored all other significant incidents of the sīrah. With the same token, the Revelation continued to provide the Prophet ﷺ with the intellectual and spiritual insights that he ﷺ perfectly transformed into the nucleus based on which the first Islamic state known as the Madīnian polity was firmly established. Hence, in this paper, the analysis will cover the intellectual dimensions of the Madīnian polity portrayed here in three essential aspects: the revelation as the principal source of knowledge, the affirmation as the intellectual and practical application of knowledge, and the manifestation as the individual and communal reflection of knowledge. In reality, not all domestic relationships are living in a mawaddah and raḥmah environment. A domestic relationship can be the source of exploitation, abuse, and violence. All these issues are affecting one’s health, whether it is physical or psychological health. They can also act as a root cause of a dysfunctional domestic relationship, leading towards societal malfunction, if they are not dealt with wisely. Two questions arise: How does one achieve domestic harmony? What is the basis of engendering domestic harmony? In this contemporary world, it is critical to realise that the Maqāṣid, or objectives, of the Sharīʻah play a pivotal role in engendering domestic harmony. By using maqāṣidic approach, this paper seeks to address what Maqāṣid al-Sharīʻah consists of and to highlight the concept of domestic harmony, encompassing the concept of marriage and family in Islam. They looked characteristically Malay, and because of the hijab on the woman, it was easy to deduce that they are of the Muslim faith. The language used between the mother and her child, however, was unmistakably English with the child almost monolingually so. The mother’s utterances, on the other hand, were dotted with some Malay words like the bah particle, but English was noticeably dominant. At a small café in a neighbourhood shopping complex, a group of impressionable young Bruneian ladies were animatedly talking about their driving experiences. Again, the conversation was mostly in English, with a few Malay words inserted every now and then. {"title":"Digital Shūrā in ‘Islamic Governance’: Expanding the Political Space in the Fifth Domain","authors":"Abdul Malik Omar","doi":"10.53105/tp-4","DOIUrl":"https://doi.org/10.53105/tp-4","url":null,"abstract":"Shūrā, or consultation, is an Islamic tradition broadly defined as a consultative approach by a leader to a unit of politically elected, or appointed, representatives to secure naṣīḥah (counsel or advice) in governing a polity. In the Qur’ān, two verses are key – “...and seek their council in all affairs” (Sūrah Ali ‘Imran: 159), and “...[for those] whose affairs are settled by mutual consultation” (Sūrah ash-Shūrā: 38).3 Shūrā is an important custom left behind by the Prophetصلى الله عليه وسلم, who “...emphasised the importance of collective and democratic decision making.”4 This consultative governance approach has led to notable victories for the Islamic polity, including the famous Trench War. In the battle, Salmān al-Fārsī successfully raised the unorthodox idea of digging trenches around Madīnah to the Prophetصلى الله عليه وسلم. The Prophetصلى الله عليه وسلم approved the strategy and the Muslims won the battle. This anecdote illustrates that by expanding the political space to allow people to input different ideas, the Prophetصلى الله عليه وسلم and hisصلى الله عليه وسلم companions secured the best solution to an issue. Moreover, the anecdote also shows that everyone, regardless of their background, has gems of wisdom that can solve various issues, provided that authority, accountability, and power of decision-making remain with the leader or state.
