Firstly, it reviews the jurisprudence thatdeveloped the doctrine of the “vía de hecho” and the tutela against judicial sentences. Secondly,it analyzes the extension of the doctrine of tutela against sentences to domestic awards. Chiefly, during the second half of the Twenty century, the administrativelegislation has overcome the boundaries of what is known as the Social State in Latin America. The latter has taken shape through constitutional and legislative reforms that have increased the “fire-power” of the presidential ruling. The “constitutionalisation”, as Loughlin calls it, which has taken place in Latin America at the begging of the Twenty-first century, shows up the instability of human rights of political and working-force minorities. Besides, the steady reduction of social security standards reflects the weakness of governments to take seriously economic equality as a priority. These social goals were some of the main conquests of democratic constitutionalism in Latin America in the late 1990s. Yet these constitutional changes represent the displacement of subcultures of the political scenario. Its arrival in Colombian constitutionalism is commonly presented as a rupture resulting from a national scenario of consensus and generalized clamor for peace in the early 1990s. However, although the right to peace was included for the first time as a right in the 1991 Constitution, peace as a constitutional value has been present as a quest in the history of Colombian constitutionalism and has been recurrently appealed to in moments of constitutional change in which the law has reclaimed from violence its role as organizer and recuperator of the thread of time. Based on a conceptual study of the ESG legal framework and major normativedevelopments in Europe, this paper presents indicative evidence of a new set of incentives and obligations for transnational corporations. The novelties that the ESG movement brings could be extremely useful in advancing the agenda of international human rights law which, for years, has suffered the ravages of having no real enforcement mechanisms at the international level. In Europe, for example, human rights due diligence could soon condition permits in the world of mergers and acquisitions, and the list of potential impacts is long. Considerando el papel constitutivo del derecho en la economía política y sus instituciones, examinamos cómo la defensa de la competencia cumple funciones de facilitación o restricción de las actividades económicas, a partir de investigaciones jurisprudenciales sobre la actuación de la autoridad brasileña de defensa de la competencia en el sector de alimentos. Se verifica que, en el caso brasileño, existe la necesidad de un reconocimiento más explícito de la defensa de la competencia como herramienta de regulación económica y social, así como una discusión más detallada sobre los patrones típicos de competencia en el sector de alimentos, especialmente en las cadenas globales de valor. However, it has increasingly been used to designate practices with distinct structure, economic rationale, and effects, including in contexts that fall outside of digital markets (even though those conducts already existed in preceding times and were widely scrutinized by competition authorities under the existing legal grounds). In Brazil, the situation is no different. This is due to the lack of a well-established legal test, including definitions about presumptions of illegality and burden of proof, and the attempt to concentrate, under the same “umbrella” diverse and distinct conducts. Following up on debates in international scholarship and, most relevantly, discussions within the European scenario, this article provides initial suggestions for the development of an adequate legal test for the practice of self-preferencing in Brazil. We make a preliminary attempt to differentiate between diverse categories of self-preferencing and suggest, among other aspects, that tests and theories of harm existing in CADE case law should be improved and adapted to drive antitrust analysis for those practices. This is the case, for example, for the classic (or “pure”) pattern of what the scholarship has equated to self-preferencing, being possible to turn to an adaptation of the CADE’s position on the essential facilities doctrine (EFD). En la primera, describo tres de las respuestas más frecuentes a la pregunta: ¿por qué es necesario, importante o urgente que se incorpore la innovación tecnológica en la educación jurídica? Las primeras dos respuestas están relacionadas directamente con agentes del mercado que demandan educación jurídica: los estudiantes de derecho y las firmas de abogados. Por un lado, la bibliografía jurídica que se ocupa de este tema argumenta que las facultades de derecho deben innovar en materia tecnológica para satisfacer las expectativas y necesidades de las nuevas generaciones de estudiantes de derecho. Por el otro, argumenta que se debe alcanzar este fin para satisfacer las expectativas y necesidades de las firmas de abogados, que son las que contratan a los nuevos graduandos de las facultades de derecho. La tercera respuesta señala que la innovación tecnológica en las facultades de derecho es necesaria porque permite que los estudiantes alcancen los objetivos de aprendizaje más eficazmente. En la segunda parte, ofrezco mis críticas a las dos primeras respuestas, aquellas que reaccionan a las necesidades tanto del mercado de servicios jurídicos como del mercado de servicios educativos, y quieren satisfacerlas. Esta crítica se fundamenta en una lectura heideggeriana de la tecnología. En la tercera parte, presento mis críticas a la tercera respuesta, aquella que conecta estrechamente los fines pedagógicos que persigue la educación jurídica con la innovación tecnológica.
