Penelitian ini bertujuan mengetahui bagaimana Perlindungan Hukum terhadap budaya tidak berwujud benda yang diatur dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 serta mengetahui upaya yang perlu dirumuskan oleh Indonesia untuk melindungi budaya tidak berwujud tersebut dalam kerangka penerapan Convention for the Safeguarding of the Intangible Cultural Heritage 2003. Permasalahan terkait hal ini yaitu perlindungan hukum mengenai warisan budaya tak berwujud benda di Indonesia melalui sistem hukum yang berlaku positif di Indonesia belum mampu secara maksimal, belum optimal dan unikatif dalam memberikan perlindungannya. Penelitian ini merupakan penelitian yuridis normatif dimana penelitian yang dilakukan dengan cara meneliti bahan pustaka terkait Perlindungan hukum terhadap budaya tidak berwujud berdasarkan Convention for the Safeguarding of the Intangible Cultural Heritage 2003 dan Penerapannya di Indonesia. Berdasarakan hasil penelitian dapat disimpulkan perlindungan terhadap budaya tidak berwujud sudah diatur dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 serta Peraturan Menteri dan Kebudayaan Nomor 106 Tahun 2013 Tentang Warisan Budaya Takbenda. The research method used is normative type with statutory, conceptual, and case approach. The results of this study show that the security council's veto power in practice has deviated from its original intent. Berbagai kerusakan yang dilakukan manusia menyebabkan kerusakan ekosistem sehigga sumber daya laut berkurang. Kasus penabrakan yang dilakukan kapal pesiar M.V. Caledonian Sky di Raja Ampat membuat kerusakan terumbu karang sehingga perlunya perlindungan dan pertanggujawaban. Penelitian ini bertujuan yaitu Pertama, mengetahui dan menganalisa bagaimana perlindungan lingkungan laut terhadap terumbu karang atas kerusakan yang dilakukan Kapal Persiar M.V. Caledonian Sky berdasarkan hukum internasional dan hukum nasional. Kedua, mengetahui dan menganalisa bagaimana pertanggungjawaban hukum kapal persiar M.V. Caledonian Sky atas kerusakan terumbu karang berdasarkan UNCLOS 1982 dan hukum nasional. Maka metode penelitian yang digunakan adalah penelitian yuridis normatif yaitu mengkaji studi dokumen yang menggunakan berbagai data sekunder atau bahan pustaka. Hasil penelitian ini adalah Pertama, Perlindungan lingkungan laut terhadap kerusakan terumbu karang yang dilakukan kapal pesiar M.V. Caledonian Sky menurut hukum internasional sesuai dengan UNCLOS 1982 pasal 194 ayat (1) dan (2) mengenai tindakan-tindakan untuk mencegah, mengurangi, dan mengendalikan pencemaran lingkungan laut. Menurut hukum nasional perlindungan lingkungan laut terhadap kerusakan terumbu karang yang dilakukan kapal pesiar M.V. Caledonian Sky diatur dalam perundang-undangan yang mengenai perlindungan lingkungan laut serta berlaku di Indonesia. Kedua, Pertanggungjawaban Hukum Kapal Pesiar M.V. Caledonian Sky atas Kerusakan Terumbu Karang menurut hukum internasional diatur dalam UNCLOS 1982 Pasal 193 mengenai Hak kedaulatan Negara untuk mengeksploitasikan kekayaan alamnya dan Pasal 235 mengenai tanggung jawab dan kewajiban ganti rugi. Menurut hukum nasional diatur dalam perundang-undangan yang mengenai pertanggungjawaban serta berlaku di Indonesia. Ketiga, Perusahaan Noble Calidonia yang berbasis di London telah mengakui bertanggung jawab atas kasus ini. Diharapkan pertama, Untuk mencegah terjadinya kejadian seperti yang dialami oleh kapal pesiar Caledonian sky, Indonesia harus menetapkan tanda bagi kawasan-kawasan tertentu untuk digunakan sebagai kegiatan pelayaran. Kedua, Dalam menegakkan hukum nasional dan hukum internasional dalam pengawasan perairan laut di Indonesia, pemerintah Republik Indonesia harus menegaskan dan mengaplikasikan undang-undang yang telah ada secara benar dan jelas agar menjadi efek jera bagi pihak operator kapal dan kapten kapal agar mencegah hal seperti ini terjadi lagi di perairan laut Indonesia. Semakin luasnya pergaulan manusia tadi maka semakin banyak kebutuhannya, maka bertambah besar kebutuhannya kepada negara yang akan melindungi dan memelihara hidupnya. Pada tanggal 17 Februari 2008, parlemen Kosovo memproklamasikan Kosovo sebagai negara merdeka, yang lepas dari Serbia pada sidang parlemen yang dihadiri 109 anggota. Sebelumnya Kosovo adalah satu provinsi dibawah kekuasaan Serbia yang mayoritas beretnis Albania. Tujuan penelitian ini dimaksudkan untuk mengetahui bagaimana pengaturan hukum internasional mengenai pembentukan negara dengan menggunakan hak menentukan nasib sendiri dan apa arti penting pengakuan dalam pembentukan suatu negara. Metode Penelitian yang digunakan adalah tipe penilitian yuridis normatif. Hasil penelitian menunjukkan pada saat ini, Hukum Internasional telah mengakui hak untuk menentukan nasib sendiri sebagai salah satu Hak Asasi Manusia dan berdasarkan hak ini semua bangsa bebas untuk menentukan status politik dan mengejar pembangunan ekonomi, sosial dan budaya. Namun, dalam konteks hukum internasional kemerdekaan sebagai wujud dari hak untuk menentukan nasib sendiri dimaksudkan untuk membebaskan diri dari penjajahan dan dominasi/kekuasaan asing. Dalam masalah pengakuan, unsur-unsur politik dan hukum sulit untuk dipisahkan secara jelas karena pemberian dan penolakan pengakuan oleh suatu negara sering dipengaruhi pertimbangan politik, sedangkan akibatnya mempunyai ikatan hukum. Indonesia yang terdampak dalam globalisasi karena gencarnya promosi pariwisata memiliki pengaturan terhadap lalu lintas orang asing melalui Undang-undang Nomor 6 Tahun 2011 tentang Keimigrasiaan dan disisi lain Indonesia tidak mengakui keberadaan Orang Tanpa Kewarganegaraan berbeda dengan pengaturan sebagaiman tercantum dalam Convention Relating To The Status of Stateless Persons 1954. Penelitian ini bertujuan untuk mengetahui bahwa pengaturan mengenai Orang Tanpa Kewarganegaraan di Indonesia untuk saat ini belum diatur secara khusus. Walaupun Indonesia telah meratifikasi International Covenant on Civil and Political Rights. Hal ini menunjukkan bahwa Indonesia belum mengatur dengan tegas dan dalam penanganannya terhadap Orang Tanpa Kewarganegaraan cenderung lambat yang mengakibatkan pendetensian melebihi ambang dari batas yang ditentukan. Adapun rumusan masalah yang diangkat yakni bagaimana pengaturan Orang Tanpa Kewarganegaraan dalam Hukum Internasional dan dalam hukum keimigrasian Indonesia beserta konsukuensi hukum yang di dapat. Metode penelitian yang digunakan adalaha tipe normative dengan cara studi pustaka. So that, an explanation of the outer space tour activity is one particular part that should be extremely clear and understandable for the sake of tourist’s security. Such as, how far the responsibility is given by government and private companies in case of an accident during the outer space tour activities.The conclusion of this research is to mention that Outer Space Treaty 1967, Rescue Agreement 1968, Liability Convention 1972 and Registration Convention 1975 are all be able to applied as basic law for the outer space tour activities. Until now, there have been several problems that have occurred especially in the exclusive economic zone between Indonesia and Vietnam, which have not been completely resolved. The exclusive economic zone is an area outside and adjacent to the territorial sea which is subject to a special legal regime for international maritime law. Based on the principles of international peace and security, there are several attempts shown to create good relations between countries in resolving disputes that occur. The principle referred to in resolving international disputes is to provide a way for parties to a dispute to resolve their disputes based on international law. There are two methods of settlement known in international law, that is peacefully and in war (military). Dispute settlement procedures for countries that are interconnected with maritime territories between countries can be seen in Article 287 UNCLOS 1982 which regulates alternatives and dispute resolution procedures. This research is a normative study that examines sources related to the issues discussed. The results of this study conclude that in resolving disputes between Indonesia and Vietnam regarding maritime boundaries in the waters of the Exclusive Economic Zone, it can be resolved with various alternative dispute resolution alternatives as described in the 1982 UNCLOS framework, that is a) peaceful dispute resolution, b) dispute resolution with mandatory procedures.
