It can only be registered if it is proven with a deed issued by Officials Empowered to Draw up Land Deeds (PPAT). The drawing up of PPAT deeds have to be attended by all parties involved in the legal action, but in the case stated in ruling number 48/G/2014/PTUN/Mdn, PPAT issues a Sale and Purchase Deed without the attendance of the land title holder. This thesis discusses about how the process of land title transfer according to the prevailing laws and regulations in Indonesia, how about the legal protection for land title holders against the land title transfer that is made by PPAT without their attendance, and how about the liabilities of PPAT for the land title transfer that is made without the attendance of the land title holder. This is a normative juridical research with descriptive analysis. The data used to answer the research problems consist of primary and secondary data sourced from library and field research. The results of this research provides conclusion, process of land title transfer pursuant to the prevailing laws and regulations that can be made through sales and purchases, exchanges, grants, income in companies and the other legal actions to transfer rights, except the transfer of rights through an auction. If PPAT issues or draws up a deed of sale and purchase on transfer of land title without the attendance of all parties or the land title holder, the deed becomes null and the land title certificate cannot be transferred if the owner does not want it; and the land title holder is rightful to file a claim to take his rights back if it is taken or transferred to another party without his permission. Due to the negligence and mistakes of PPAT in issuing a deed of transfer, PPAT shall be liable for his actions civilly, criminally and administratively in case his legal action in the transfer of land title has harmed any party or the land title holder. People in Baktiraja Sub-district still do land transaction based on adat law. It is made in a letter on embossed stamped paper signed by the seller and the buyer and witnessed by a village head although this method is rarely done today. The research problems are as follows: what factors which cause the implementation of land transaction is done based on adat law, how about the legality of land transaction based on adat law, and how about the resolution of any dispute in land transaction based on adat law in the people in Baktiraja Sub-district, Humbang Hasundutan Regency.The research used juridical empirical method. The data were obtained from primary, secondary, and tertiary legal materials. They were gathered by conducting library research and field research as well as interviews and analyzed qualitatively.The result of the research shows that some factors which cause land transaction is based on adat law in the people in Baktiraja Sub-district are legal factor since there is no PPAT (Official Empowered to Draw up Land Deeds) and non-legal factor since in tradition the implementation is easy, simple, and affordable. Land transaction in Baktiraja Sub-district is valid because it meets material requirement as it is specified in Article 1320 of the Civil Code. Any dispute in land transaction based on adat law in this Sub-district is resolved in a family manner.It is recommended that the Local Government provide counseling for the people about getting PRONA (Agrarian National Operation). The village heads should get involved in facilitating resolution in any disputes. The data were sourced from secondary data. This research was conducted at KPKNL, Medan as the research location. The data were collected by conducting library research and field research. The data were collected through document study or library research and interviews. The instruments used to collect data consisted of document study or library research and interview. The datawere analyzed by using qualitative data analysis method. Consequently, the land use is not only oriented to the land title holder’s benefit, but it also has to notice and consider the sake of society, in order to implement balance of interests principle. The research problems are how the implementation of indemnity for the land used for village development in Sumber Mufakat Village is in line with the Regulations of the President of the republic of Indonesia Number 148/2015 on the Fourth Amendment to the Regulation of the President Number 71/2012 on Implementation of Land Procurement for Development of Public Interest; what factors impede the implementation of indemnity stipulated for village development in Sumber Mufakat Village, and about the legal efforts made related to the problems in indemnity for the land used for village development in Sumber Mufakat Village. \u0000            This is a normative juridical research with descriptive analysis. The data used in this research consist of secondary data. They are collected through library study and field research. Qualitative analysis is employed of the data analysis. \u0000            There are some types and forms of indemnity stipulated in the law such as Article 74 of the Regulation of the president Number 71/2012 on Land procurement for the development of public interest by Government or Regional Government. The obstacles are encountered in determining the form and amount of indemnity for road widening in Sumber Mufakat Village which come in variety. The object of land procurement is being disputed in the court, the indemnity is taken by the rightful party in the secretariat of the Court after there is a court ruling with permanent legal enforcement or a deed of reconciliation, and a covering letter from the Head of Land Procurement Execution (Regional Office of National Land Office in Province of Head of Land office in Regency/District). \u0000            It is suggested that Government notice the interest of land title’s holder in the road widening at Sumber Mufakat Village. In addition, it is necessary to make approaches and provide opportunities to land title owner to choose which type and form of indemnity is preferred for the road widening in Sumber Mufakat Village. It is recommended that every institution implement the law in line with the prevailing regulation impartially. It is expected that every institution to not take side to any particular government institution with higher position. Selain kepemilikan perkebunan yang dimiliki masyarakat, juga terdapat perkebunan milik perusahaan. Kasus kebakaran lahan perkebunan di Indonesia menjadi hal yang menarik diperbincangkan. Hasil observasi diperoleh informasi bahwa apabila terjadi kebakaran dilahan perkebunan milik perusahaan, hanya pelaku pembakaran saja yang menjadi sorotan, namun untuk pemilik perusahaan yang secara jelas memiliki kawasan dan bertanggung jawab terhadap area perkebunannya terkesan tidak terlibat. Penelitian bertujuan untuk melihat pertanggungjawaban hukum terhadap kebakaran lahan perkebunan milik perusahaan di kabupaten pelalawan Berdasarkan Undang-Undang Nomor 18 Tahun 2004 Tentang Perkebunan. Penelitian dilakukan berjenis sosiologis dengan pendekatan kualitatif yang melibatkan responden dari pihak Pemerintah Daerah, Polres, Badan Pertanahan Nasional dan beberapa responden yang terkait. The command to perform the pilgrimage has been stated in the Qur'an and the Hadith. The order is addressed to Muslims who have met the criteria of istitha'ah (able), both in terms of physical-spiritual and cost. In this sophisticated era, the desire of the people in carrying out the pilgrimage is very high. Istitha'h is the ability to perform Hajj in terms of physical health and supplies sufficient to depart and return, as well as supportive security during the Hajj journey and implementation. This discussion aims to determine the boundaries of istitha'a in the Hajj according to contemporary fiqh. To obtain data in this discussion, a literature study was carried out, namely by studying the Al-Quran, Al-Hadith and fiqh books relating to the chapter of the pilgrimage and other books that are related to the problems in this study. From the results of the discussion it can be seen that, someone who has a healthy body, able to hajj. \u0000  \u0000Intisari \u0000Haji adalah Ibadah dengan pergi ke Baitullah di Mekkah dan Madinah untuk melaksanakan ritual peribadatan sesuai dengan tata cara yang diatur oleh syariat Islam. Perintah melaksanakan ibadah haji telah tertuang di dalam Al-Qur’an dan Hadis. Perintah tersebut ditujukan kepada orang-orang Islam yang telah memenuhi kriteria istitha’ah (mampu), baik dari segi jasmani-rohani maupun biaya. Era yang serba canggih ini, keinginan masyarakat dalam melaksanakan ibadah haji sangatlah tinggi. Istitha’h adalah kemampuan untuk melaksanakan haji yang dilihat dari segi kesehatan fisik dan perbekalan yang cukup untuk berangkat dan kembalinya, serta keamanan yang mendukung selama perjalanan dan pelaksanaan ibadah haji. Pembahasan ini bertujuan untuk mengetahui batasan istitha’a dalam berhaji menurut fiqh kontemporer. The increase in the country’s development has increased the availability of land and buildings although they are actually very limited. Therefore, it is appropriate if individuals and legal entities get economic values and land or buildings due to the State’s BPHTB (Duty on Land and Building Right Acquisition). The research problems are how about the regulation on collecting BPHTB in Medan according to legal provisions, how about the role of PPAT (official empowered to draw up land deeds) concerning BPHTB, and how about the sanction imposed on PPAT and Taxpayers who have signed a deed which BPHTB has not yet paid off. \u0000Keywords: BPHTB, PPAT, Land and Building Acquisition \u0000Intisari \u0000Pajak merupakan penerimaan negara yang paling besar sehingga pajak memiliki peran yang vital dalam sebuah negara. Di Indonesia pajak merupakan salah satu penopang pendapatan nasional yang menyumbangkan lebih kurang 70% dari penerimaan negara. Meningkatnya kegiatan pembangunan di segala bidang mengakibatan meningkatknya keperluan akan tersedianya tanah dan bangunan, sedangkan tanah dan atau bangunan persediaannya terbatas, maka sudah sewajarnya orang pribadi atau badan hukum yang memperoleh nilai ekonomis serta manfaat dari tanah atau bangunan karena perolehan hak atas tanah dan bangunan dikenakan pajak oleh negara. Pajak yang dimaksud adalah Bea Perolehan Hak atas Tanah dan /atau Bangunan (BPHTB). Berdasarkan hal-hal tersebut diatas maka permasalahan-permasalahan yang akan diteliti dalam penelitian ini yaitu: Bagaimana Pengaturan hukum tentang pemungutan Bea Perolehan Hak Atas Tanah dan Bangunan (BPHTB) di Kota Medan menurut peraturan perundang undangan ? Bagaiamana peranan Pejabat Pembuat Akta Tanah dalam kaitannya dengan Bea Perolehan Hak Atas Tanah dan/atau Bangunan (BPHTB? (061) 8211633, E-mail: arthatambunan46@gmail.com \u0000  \u0000ABSTRACT \u0000Prohibition of two positions by a Notary as the head of a private company is regulated in Article 17, letter (f), but by the Decree of MPP (Central Supervisory Council) No. 06/B/MPPN/X/2018, it is found that, in practice, there is still a contradiction between rules and reality in the field, especially the violation is done by a Notary who is the Vice Head of the Regional Honorary Ciuncil of Lampung Province. The research problems were as follows: why a Notary is prohibition to have two positions as the head of private company according to UUJN, how about the efforts of MPN to do supervision on Notary’s two positions, and how about juridicial analysis on the Decree of MPP No. 06/B/MPPN/X/2018. The research used the theory of legal certainty, the theory of liability, and the theoy of authority. The research used juridicial normative method with descriptive analytic approach, the data consisted of primary data and secondary data which were obtained from the Office of the Ministry of Law and Human Rights, library research, and interviews with some informants.The result of the research shows that concerning the Decree of MPP No. 06/B/MPPN/X/2018in the level of its supervision there is a significant difference in the decrees of MPD, MPW, and MPP on their considerations to make decisions; they constitute the background of inaccurate examination done by the MPN (Notary Supervisory Council). \u0000  \u0000Keywords: Double, Position, Notary \u0000  \u0000Intisari \u0000Larangan rangkap jabatan Notaris sebagai pemimpin badan usaha swasta diatur dalam Pasal 17 huruf (f), namun demikian dengan adanya Putusan MPP Nomor 06/MPPN/B/X/2018 membuktikan bahwa dalam praktiknya masih ditemukan pertentangan antara aturan dengan kenyataan di lapangan terlebih lagi Notaris yang melakukan pelanggaran merupakan Wakil Ketua Majelis Kehormatan Wilayah Provinsi Lampung. Oleh karena itu tesis ini akan membahas tentang mengapa Notaris dilarang melakukan rangkap jabatan sebagai pemimpin badan usaha swasta menurut UUJN, bagaimana upaya MPN dalam menjalankan fungsi pengawasan terhadap pelanggaran rangkap jabatan yang dilakukan oleh Notaris dan bagaimana analisis hukum Putusan Majelis Pengawas Pusat Nomor 06/B/MPPN/2018. Tesis ini menggunakan teori kepastian hukum, teori tanggungjawab dan teori kewenangan. Jenis penelitian yang digunakan adalah penelitian yuridis normatif yang bersifat deskriftif analitis. Data yang digunakan untuk menjawab penelitian ini adalah data primer dan data sekunder yang diperoleh dari penelitian di Kantor Kementrian Hak Asasi Manusia dan dari penelitian kepustakaan serta wawancara informan.
