Until this period, ownership was a fragmented and incomplete institute due to the fact of the existence of public property, which was one of the principles of the ideology of the monist system. With the change of the corpus of domestic legislation and the signing of international agreements ratified in civil law, the concept of private property will undergo a fundamental change. Building a civil code totally different from the existing one would bring about a different treatment of private property. In the new code, private ownership would be of paramount importance both from a doctrinal and practical point of view. The implementation of the legislation would be a challenge in itself which, in addition to the positive part, will also face issues that are still part of the law practices. This\u0000region has an essentially agricultural vocation but also has a strong tourist attraction thanks to\u0000its natural and cultural potential, the current economic context of the coastal towns of Cap Bon\u0000induces a rapid development in the demand for water. There is already a competition for water\u0000exploitation between the agricultural and tourist sectors. The demand for water is then brought\u0000to meet the needs of the tourist industry and those of the agricultural activity, without forgetting\u0000the industrial and domestic sector. Although agriculture is the main activity for the majority of the\u0000population, agricultural intensification threatens the sustainability of the water resource, as a\u0000means of production, both in terms of quality and in terms of quantity. and the threat as well, as\u0000natural wealth. We must therefore think about redefining the place of water through the\u0000differential management of water resources by considering them not only as a vital and\u0000economic resource but also as an environmental and landscape component of great importance.\u0000To do this and based on the documentary research and the various surveys carried out in the\u0000study area, this article aims to present the different water sources in Cap Bon, to focus on the\u0000multiple conflicts of use by different sectors (agriculture, industry, domestic use, etc.) and\u0000subsequently to explore what new forms of governance in the hydraulic field can be. The only source of sustainable competitive advantage is to learn faster and more creatively than competing organizations.
