Di Indoneisa pernikahan biasanya dilakukan dengan adat tertentu dan moment sakral, penuh khidmat dan suka cita. Lalu bagaimana jika pernikahan dilakukan secara bersama-sama, dengan menghadiri beberapa pasangan? Umumnya nikah massal hampir ada di setiap daerah di Indonesia, tidak terkecuali di Kepulauan Bangka Belitung. Tulisan ini melihat pernikahan massal yang dilakukan di Kepulauan Bangka Belitung yakni pernikahan massal di Kabupaten Bangka Selatan, tepatnya di Desa Serdang yang dilakukan setiap satu tahun sekali dalam pandangan Islam. Metode yang digunakan dalam penelitian ini yakni metode kualitatif dengan melihat fenomena yang terjadi. Hasil dari penelitian ini menunjukan bahwa nikah massal di Desa Serdang dilakukan seusai panen hasil kebun, tujuannya merupakan bentuk rasa sukur kepada Tuhan yang Maha Esa atas apa yang diperoleh. Walaupun secara otomatis ketika meninggalnya seseorang berlaku hukum kewarisan di mana keluarga yang ditinggalkan merupakan pewaris dari yang meninggal, namun persoalan kewarisan tersebut tidak secara langsung dapat dilaksanakan. Di samping harta yang ditinggalkan oleh seseorang yang meninggal untuk biaya pengurusan jenazah dan hutang yang ditinggalkannya, di sisi lain apabila yang meninggalkan tersebut meninggalkan wasiat terhadap harta yang ditinggalkannya, maka wasiat tersebut harus diselesaikan terlebih dahulu baru pembagian harta warisan dapat dilaksanakan. \u0000Akan tetapi, persoalan wasiat yang ditinggalkan oleh seseorang yang meninggal tersebut tidak boleh menyalahi ketentuan-ketentuan yang telah ada, baik itu yang diatur dalam hukum Islam maupun peraturan perundang-undangan yang ada. Berbagai macam dukungan menyeruak ke permukaan, namun tidak sedikit pula kecaman dari kalangan ahli. Bahkan Majelis Ulama Indonesia (MUI) turut memberikan kritik tajam dengan mengeluarkan fatwa Nomor 12 Tahun 2012 sebagai respon atas putusan tersebut. Hal ini karena Mahkamah Konstitusi (MK) dianggap membuat hukum syariah sendiri dan melampaui kapasitasnya dengan melegalkan nasab anak yang lahir dari hubungan luar nikah kepada orang tua biologisnya. Berangkat dari persoalan di atas, maka penulis ingin menelaah kembali putusan Mahkamah Konstitusi (MK) Nomor 46/PUU-VII/2010 dengan menggunakan pisau analisis teori mashlahah Izzuddin Bin Abdissalam. Penelitian ini adalah penelitian hukum Islam normatif dengan menggunakan metode penelitian literer (library research). Karena itu, penulis hendak menelaah putusan Mahkamah Konstitusi (MK) putusan Nomor 46/PUU-VII/2010 tentang status anak di luar nikah dengan kacamata teori mashlahah Izzuddin bin Abdissalam. Adapun hasil penelitian ini, yaitu: Pertama, putusan Mahkamah Konstitusi (MK) mengandung mashlahah, utamanya bagi nasib dan masa depan seorang anak sebagai korban hubungan di luar nikah. The purpose of this paper is to find out the limits in hitting children who are reluctant to pray, so that parents have knowledge and understanding in giving punishment to their children. This type of qualitative research uses content analysis in its conclusion. The results of this study are: Islamic law and positive law contain certain legal goals (maqashid al-syariah) in hitting children. In the hadith about the command to hit a 10-year-old child who is reluctant to pray it aims to maintain or maintain religion, while in positive law it aims to protect the soul or life of the child. As for the limitations in hitting a child, namely: Beating is carried out for mistakes that have occurred, not mistakes that are feared to occur, beatings may not injure the child and are adjusted to the circumstances and age of the child, beatings should not be carried out on vulnerable parts such as the stomach and head, beating with the purpose and basis of education and must not be excessive, the beatings must be carried out alternately, not in one part only, the beatings must be given a time lag, and must not be repeated, in hitting the elbows must not be lifted. beatings should not be carried out in a state of anger, refrain from hitting a child when he mentions the name of Allah, should not hit a child unless he is 10 years old. \u0000Abstrak \u0000Penelitian ini dilatarbelakangi oleh ketidak pahaman orangtua dalam memberikan hukuman pemukulan kepada anak-anaknya dalam rangka mendirikan shalat, kebanyakan orangtua memukul anaknya tidak mengenal batasan, sehingga orangtua berpotensi melakukan tindak pidana. Tujuan penulisan ini adalah untuk mengetahui batasan dalam memukul anak yang  enggan mengerjakan shalat, sehingga orangtua memiliki pengetahuan dan pemahaman dalam memberikan hukuman kepada anaknya. jenis penelitian kualitatif ini menggunakan analisis isi dalam penyimpulannya. Hasil penelitian ini yaitu: hukum Islam dan hukum Positif mengandung tujuan hukum (maqashid al-syariah) tertentu dalam memukul anak. Dalam hadits tentang perintah memukul anak 10 tahun yang enggan melaksanakan shalat bertujuan untuk menjaga atau memelihara Agama, sedangkan dalam hukum Positif bertujuan untuk menjaga jiwa atau kehidupan sang anak. Dalam menentukan standar nafkah wajib ahli hukum Islam (fuqahā) melihat ada berbagai pertimbangan yang dapat dijadikan acuan yaitu kondisi suami (hāl az-zauj), kebutuahn atau kondisi istri (hāl az-zaujah) atau keadaan keduanya secara bersamaan. Namun demikian penting disadari bahwa pensyariatan ibadah puasa memiliki nilai-nilai falsafah hukum Islam yang termuat di dalamnya. Penelitian ini bermaksud untuk mengeksplorasi nilai-nilai maqasid shariah yang termuat dalam perintah kewajiban ritualitas ibadah puasa ramadhan. Jenis penelitian ini merupakan penelitian kualitatif berupa kajian pustaka (library research) dengan pendekatan normatif filosofis. Sumber  data  yang digunakan, yakni pelbagai literarur ilmiah, baik berupa buku (kitab) dan artikel jurnal ilmiah terkait pembahasan nilai-nilai falsafah ibadah puasa ramdhan. Sementara itu, teori analisis yang digunakan, yakni teori maqasid shariah yang dikembangkan oleh Jasser Auda. Umam","doi":"10.32923/ifj.v2i01.1814","DOIUrl":"https://doi.org/10.32923/ifj.v2i01.1814","url":null,"abstract":"Kelem hereditary is one of the customary laws in the matter of the inheritance rights of grandchildren which is the result of the agreement of former community leaders in Kecicang Islam Village, Bungaya Kangin Village, Bebandem District, Karangasem Regency, Bali Province. Kelem comes from the Balinese language which means drowned. In terms of hereditary, kewarisan kelem means a grandson whose father or mother (the heir) died before the grandfather or grandmother (the inheritor) is said to have drowned (blocked) from inheritance rights because it is hindered by the parents’ brothers who are still alive. This is in contrast to the hereditary law system in Indonesia in the form of Islamic Law Compilation article 185 paragraph 1, which explains that, the heir who dies before the inheritors can be replaced by his child. The research method used was field research. This research was a descriptive analytic with juridical normative approach. Data collection methods used include interviews and documentation. After the data was collected, it was analyzed in a descriptive qualitative way with the 'urf and the theory of substitute heirs. The results showed that kelem hereditary is one of the customary laws as the result of the agreement of former community leaders in Kecicang Islam. This is because most of the general public assumes that witchcraft is believed to be an act that can harm people, suffer and or even kill people. However, in accordance with the principle of legality and the difficulty of proof, witchcraft deeds so far can not be entered into the realm of justice so that it is not uncommon for people accused of witchcraft to lose their lives without going through legal process. Therefore, in this study by analyzing the witchcraft delict in the construction of RKUHP this study uses normative legal research methods whose data are obtained through literature studies. The results obtained revealed that witchcraft is a criminal act that must be constructed into the category of delik formil whose proof does not necessarily lead to the existence or absence of a supernatural force it self owned by the perpetrator or individual.
