Act on Decisions on Life-Sustaining Treatment for Patients in Hospice and Palliative Care or at the End of Life allows several forms of informed refusal, but it is not enough. There is no explicit guarantee, at least under this law, of the right to refuse a treatment given during a period that has not reached an end-of-life process prescribed in the law. Dori, which the family of a terminal patient feels obligated to follow, makes them commit to doing what they believe is right as a family member without asking the patient’s intention. Because it reduces the family’s motivation to have a difficult talk about death and end-of-life with the patient, the patient is deprived of an opportunity to make a decision based on accurate information. In making a decision for the patient while patient is excluded, the family often ends up choosing a safe decision that puts physical survival first. The Chinese have been the largest immigrant group in New Zealand since the 19 th century (1) . They have unique beliefs and practices around illness, death, dying and filial piety (2) . These differ greatly from those in Western cultures and have notable implications for hospice palliative care planning and provision. However, immigrant Chinese community remains a relatively marginalised and under-researched group in palliative care (3-5) . This results in limited knowledge about its culture and people among health professionals, as well as the lack of experience in providing terminal care to Chinese immigrants. It also investigates the coherence and cohesion of the law and its ethical norms to build an inclusive and just society. Through an exploratory and integrative review, it analyzed the legal pro- visions in force in Brazil published on the official websites of the Brazilian federal government and available on the Internet. It was evaluated whether the definition used for persons with disabilities follows the United Nations Convention on the Rights of Persons with Disabilities. Also, whether it is necessary to evaluate disabilities and who should perform this task professionally. Thirty-three legal norms were found, among which only three laws and two decrees are in line with the recommendations of the UN Convention. It is necessary to review the existing norms and promote the consolidation of laws, decrees, ordinances and normative instructions regarding the rights of persons with disabilities in a uniform manner, on an adequate technical-scientific basis. It is an attribute that every subject has through which he/she can perform acts that are not prohibited. Since 2018, by Legislative Decree 1384, we have a new treat-ment of capacity in the Civil Code that is in line with the guidelines in favor of the autonomy and full legal capacity of persons with disabilities, aligning national legislation to the International Convention on the Rights of Persons with Disabilities. The regime of substitution of the will of incapable persons is replaced by a social model through supports and safeguards. We are facing an inclusive, democratic model, according to the respect for the human rights of all citizens (dignity and equality), based on the principle that people with disabilities have full exercise capacity in equal conditions in each and every aspect of their lives, recognizing their right to make their own decisions as well as the right to make mistakes. The function of the support in favor of the disabled person is developed, analyzing their powers of representation. However, with the development of organ transplantation, many ethical issues and controversies have arisen. From the perspective of bioethics, the article compares the relevant ethical and legal regulations of organ transplantation in various countries. Due to the complexity of the real situation, many ethical dilemmas arise in organ transplantation in China. Guiado por un paradigma interpretativo, estrictos criterios de calidad y éticos, la metodología utilizada fue de tipo cualitativo, aplicando las técnicas de recolección de datos de entrevistas en profundidad, análisis de documentos y grupos de discusión. La sección de datos sobre el equipo aquí presentados, se analizó a través de las técnicas análisis de contenido y análisis crítico del discurso. Los resultados indican que la figura del clown es percibida como un mediador y valorada como terapia complementaria, especialmente por las competencias socioemocionales de esos profesionales y el juego que se utiliza como herramienta de intervención. Las conclusiones señalan que las competencias socioemocionales que promueve el clown de hospital son fundamentales para el trabajo en cuidados paliativos. Abstract : This is a synthesis of results of a major research which main objective was to know the perspectives of families and the health team regarding the presence of hospital clowns working in pediatric palliative care in a unit in Chile. Guided by an interpretivist paradigm, strict quality and ethical criteria, the methodology used was qualitative, applying in-depth interviews, document analysis and discussion groups as data collection techniques. The data section presented here about the health team was analyzed through content analysis and critical discourse analysis techniques. The results indicate that the figure of the clown is perceived as a mediator, valued as complementary therapy, especially due to the socio-emotional competences of these professionals and play used as an intervention tool.
