Secara administratif Kabupaten Aceh Barat terbagi atas 12 Kecamatan, 33 pemukiman, dan 322 desa. Polusi laut, berdasarkan Peraturan Pemerintah No.19 / 1999 tentang Pengendalian Pencemaran dan / atau Perusakan Laut: \"Masuk atau pemasukan makhluk hidup, zat, energi, dan / atau komponen lain ke dalam lingkungan laut oleh manusia sehingga kualitasnya turun sampai batas tertentu yang menyebabkan lingkungan laut tidak lagi sesuai baku mutu dan / atau fungsinya”. Kegiatan penambangan menjadi salah satu penyebab lain terjadinya air laut pencemaran di Aceh Barat, baik kegiatan penambangan legal maupun ilegal yang saat ini sedang berlangsung. Salah satu yang paling fenomenal merupakan pertambangan batu bara yang sempat ramai diributkan warga Aceh Barat. Sampah yang mengandung polutan kemudian masuk ke pesisir dan ekosistem laut. Ada yang larut dalam air, ada yang terendam ke dasar dan terkonsentrasi ke sedimen, dan sebagian masuk ke dalam jaringan tubuh organisme laut (termasuk fitoplankton, ikan, udang, cumi-cumi, kerang, rumput laut dan lainnya). Padahalmenurut UU perlindungan anak R.I. NO 11 Tahun 2012 tentang sistem peradilan anak sedangkan pasal 68UU NO.13 Tahun 2003 tentang ketenagakerjaan menyebutkan bahwa pengusaha dilarang mempekerjakananak mulai dari batas usia diperbolehkan kerja, kemudian konvensi ILO NO. 182 Tahun 1999 mengenaipelanggaran dan tindakan segera penghapusan bentuk-bentuk pekerjaan terburuk anak. {"title":"Penggunaan Instrumen Hukum Administrasi Negara Dalam Perkara Penundaan Kewajiban Pembayaran Utang PT Asuransi Jiwa Kresna","authors":"Yasin Nur Alamsyah Hidayat Ali Samiaji, Rosalinda Elsina Latumahina","doi":"10.30996/jhp17.v7i1.6057","DOIUrl":"https://doi.org/10.30996/jhp17.v7i1.6057","url":null,"abstract":"Penelitian ini membahas terkait ratio decidendi Putusan MA No. 647K/Pdt.Sus-Pailit/2021 yang dikaitkan dengan penggunaan UU No. 30/2014 tentang Administrasi Pemerintahan (UU AP) sebagai dasar pertimbangan dalam pengesahan PKPU terhadap perusahaan asuransi dalam perkara PKPU PT Asuransi Jiwa Kresna sebagaimana telah diputus PKPU sementara dalam putusan No. 389/Pdt.Sus-PKPU/2020/PN-Niaga.Jkt.Pst. tertanggal 10 Desember2020 dan telah dibatalkan setelah diajukan upaya hukum Kasasi dengan diputus batal dalam Putusan MA No. 647K/Pdt.Sus-Pailit/2021. Menggunakan metode penelitian yuridis normatif dengan bahan kajian hukum positif. Hasil penelitian menunjukkan bahwa OJK sebagai lembaga negara independen atau dalam Hukum Tata Negara disebut sebagai quasi eksekutif yang kedudukannya diatur oleh UU terikat pada keseluruhan peraturan perundangan termasuk UU AP. Namun untuk penggunaan instrumen hukum administrasi negara dalam hal ini Pasal 53 ayat (3) UU AP tentang fiktif positif tidaklah tepat. Karena dalam Pasal 53 ayat (2) UU AP mengisyaratkan ketentuan fiktif positif dapat dilaksanakan jika tidak terdapat ketentuan perundangan yang terkait aturan tentang batas waktu untuk menetapkan putusan. Sedangkan terkait batas waktu OJK dalam merespon permohonan telah diatur dalam Pasal 51 ayat (2) UU No. 40/2014 tentang Perasuransian juncto Pasal 54 ayat (1) POJK No. 28/POJK.05/2015 diberikan waktu paling lama 30 (tiga puluh) hari sejak permohonan diterima secara lengkap. Disisi lain penggunaan UU AP adalah sebuah kesalahan mendasar karena permohonan PKPU diperiksa dan diadili berdasar ketentuan UU yang bersifat umum diluar koridor UU bersifat khusus. This study aims to: Identify \"Goah\" in Ciasmara Village, Pamijahan District, Bogor Regency. This study uses a Rapid-Ethnography approach, located in the village of Ciasmara, Pamijahan District, Bogor Regency from March 2019 - August 2019. This research found that in Ciasmara village there is still a \"goah\", but its form is no longer limited to a special space where to place rice but the \"Goah\" has transformed into another form such as a bucket or a special drum. Melalui metodepenelitian yuridis normatif, tulisan ini mengkaji pelindungan konsumen dalam transaksidagang melalui sistem elektronik dan penyelesaian sengketanya. Hasil penelitian menunjukanpelindungan terhadap konsumen pada transaksi dagang melalui sistem elektronik belumdapat dilakukan secara optimal karena pengaturannya masih tersebar dalam beberapaUndang-Undang (UU) yang memerlukan peraturan pelaksanaan. Di samping itu UU No.8 Tahun 1999 tentang Perlindungan Konsumen belum mampu menjangkau pelindungankonsumen dalam transaksi dagang secara elektronik secara keseluruhan, khususnya dalamhal para pihak memiliki perbedaan yurisdiksi. Sedangkan dalam hal sengketa konsumen,para pihak dapat menempuh jalur pengadilan maupun di luar pengadilan sesuai kesepakatanpara pihak, namun alternatif penyelesaian sengketa secara online dapat dilaksanakan secarapenuh. Oleh sebab itu, diperlukan suatu strategi pemasaran produk dan sekaligus pendampingan proses produksi. Dengan demikian, produk UMK di Desa Minggirsari semakin dikenal oleh masyarakat luas. Tujuan dari ini adalah untuk pemetakan dan penyusunan strategi pemasaran produk UMK MAMIN di desa Minggirsari, Kecamatan Kanigoro, Kabupaten Blitar. Metode yang digunakan untuk menyelesaikan permasalahan adalah dengan menggunakan Metode SWOT (Strengths, Weakness, Opportunities, Threath). Hasil dari penelitian ini menunjukkan bahwa strategi pemasaran produk yang tepat digunakan oleh UMK Desa Minggirsari yaitu Strategi Strenght-Opportunity (SO Strategy) pada Kuadran 1.
