They lay down a set of basic rules governing correct and ethical behavior within organizations and among their stakeholders. Also in public administration, compliance is a focal issue. However, as the comparison of, for instance, several cantons of Switzerland reveals, the approaches pursued in administrative practice or the instruments and concepts applied considerably deviate. In light of this observation, this paper examines the relevant behavioral regulations and, in particular, the use of codes of conduct in Swiss cantonal administrations. To this end, a qualitative case study analysis involving six selected German-speaking Swiss cantons has been conducted. Within the sample, three cantons provide for a code of conduct that applies to the entire administration, whereas three do not use such instrument at cantonal level. Upon contrasting the applicable framework of regulations of all six cantons, the paper explores in further detail the reasons for creating a code and the reasons for not using such instrument as well as the intended functions and objectives. Then, the three cantonal codes of conduct within the study are benchmarked against each other in terms of formalities, content, genesis, practice of use and procedural design. Based on the findings of the case study, as analyzed in consideration of administrative and management literature and practice, nine specific recommendations for action are derived with the aim of supporting cantonal administrations when creating and applying a code of conduct. Abstrakt In der Privatwirtschaft ist der Verhaltenskodex ein verbreitetes Compliance-Instrument. Mit ihm legen Organisationen fur sich und ihre Akteurinnen und Akteure Grundregeln korrekten und integren Handelns fest. Auch in der offentlichen Verwaltung ist das Thema Compliance von zentraler Bedeutung. Doch bestehen namentlich in der kantonalen Verwaltungspraxis der Schweiz divergierende Ansatze bezuglich der angewandten Instrumente und Konzepte. Ausgehend von dieser Beobachtung untersucht der vorliegende Beitrag die kantonale Infrastruktur im Bereich Verhaltensregeln und insbesondere die Verwendung von Verhaltenskodizes anhand einer qualitativen Fallstudienanalyse fur sechs ausgewahlte Deutschschweizer Kantone. Innerhalb des Samples verfugen drei Kantone uber einen gesamtkantonalen Verhaltenskodex und drei Kantone nicht. Auf der Basis einer Gegenuberstellung der vorhandenen Verhaltensregularien in allen untersuchten Kantonen werden die Veranlassung zur Schaffung eines Kodexes und die Grunde fur die Nichtverwendung dieses Instruments sowie die angestrebten Funktionen und Nutzen im Verwaltungskontext naher beleuchtet. Today, there are numerous initiatives in the public sector, promising a new model for the public services: smart government. In this article, we seek to identify success factors for smart government initiatives. We provide a selected review of the current literature on the motivations, goals, and processes behind smart government so as to provide a conceptual and analytical basis for the analysis. Based on desk research, interviews, and workshops, our qualitative analysis reveals institutional (political commitment, clear governance, legal agility, digital awareness, and IT infrastructure), organizational (structure and processes, capabilities, values, and human resources), and leadership/strategy success factors that must be considered when implementing smart government initiatives. The aim is to improve transparency, expand opportunities for participation and promote economic innovation as well as the efficiency of the administrations themselves. This development began on an international level after a lengthy emergence phase around 2010. Switzerland took up the topic early, but was never one of the driving forces. The first Swiss pilot portal started 2013 and the first OGD-strategy was adopted by the Federal Council in 2014. Now a follow-up strategy is to be adopted. The implementation of the strategy was successful despite scarce resources. However, the principle of “open by default” has not yet really gained acceptance. The use of the data made available also lagged behind expectations. This must change in the strategy period 2019–23. The article describes these challenges and outlines possible solutions. Open administrative data make an important contribution to democracy by supporting the idea of administration as a platform. This does not undermine proven legal principles of bureaucratic action or compete with traditional democratic forms of participation, but it does open up low-threshold everyday administrative action for participation. With such an active information policy, discussions can be stimulated and constructively shaped. This also opens up the use of new ideas and alternative knowledge to public administrations, but destroys the sovereignty of interpretation: all are equal before the data – that is their democratic potential. Heute bieten viele Regierungen und offentliche Verwaltungen die Daten, die sie sammeln und verarbeiten, als Open Government Data zur kostenlosen rechtlichen, finanziellen und technischen Wiederverwendung an. Ziel ist es, die Transparenz zu verbessern, die Beteiligungsmoglichkeiten zu erweitern und wirtschaftliche Innovation ebenso wie die Effizienz der Verwaltungen selbst zu fordern. Diese Entwicklung begann auf internationaler Ebene nach einer langen Entstehungsphase um 2010. Die Schweiz hat sich fruh mit dem Thema beschaftigt, war aber nie eine der treibenden Krafte. Das erste Schweizer Pilotportal startete 2013 und die erste OGD-Strategie wurde 2014 vom Bundesrat verabschiedet. Nun ist eine Follow-up-Strategie verabschiedet worden. Die Umsetzung der Strategie war trotz knapper Ressourcen weitgehend erfolgreich. Das Prinzip “open by default” hat sich jedoch noch nicht wirklich durchgesetzt. Auch die Nutzung der zur Verfugung gestellten Daten blieb hinter den Erwartungen zuruck. Dies muss sich im Strategiezeitraum 2019–23 andern. Der Artikel beschreibt diese Herausforderungen und skizziert Losungsansatze.
