This article analyses the scope, nature, and extent of the available literature on culture and witness testimony to help inform decisions for further studies. A comprehensive search was performed in databases such as Scopus and Web of Science Core Collection. Seven key thematic areas were identified: (1) Language as culture in the courtroom; (2) Expert witnesses as gatekeepers to culture; (3) The role of the interpreter; (4) Adjudicators’ understanding of culture; (5) The culture defence; (6) Mental health, memory, and culture; and (7) Legal culture. UNCLOS provisions are relevant in time of peace. However, legal design and state practice make them insufficient, yet the law of piracy could be a last recourse against private actors. Moreover, in time of war, like Russia’s invasion of Ukraine, states must resort to IHL, which protects infrastructures not exclusively serving neutral states. The aim is to help construct a normative, theoretical foundation for the practice of international criminal tribunals. First, it looks into all seven ICC sentencing judgements to deconstruct the parts in which the judges discuss why the court punishes. Upon a comparative analysis of the teleological pronouncements, the paper identifies three patterns in the ICC’s teleological discourse. These include: the court’s unfounded import of domestic punishment rationales, fusion of different objectives and rhetorical, performative language used to justify punishment. Building on these findings and literature on the expressivism of punishment, I put forward the claim that the ICC judges’ discourse on penal rationales reveals an expressive function of punishment at play. Finally, the paper discusses how the ICC uses this expressivist practice in its jurisprudence to build a narrative of legalism and situate itself in the wider project of international justice.
