{"title":"온라인맞춤형광고 개인정보보호 가이드라인에 대한 비판적 검토","authors":"박성용","doi":"10.15723/jcps.48.3.201712.205","DOIUrl":"https://doi.org/10.15723/jcps.48.3.201712.205","url":null,"abstract":"통신기술의 혁신으로 개인에게 필요한 상품에 대한 정보를 맞춤형으로 제공할 수 있는 광고인 온라인맞춤형광고가 크게 신장하고 있다. 온라인맞춤형광고는 국가경제 차원에서는 자원의 효율적인 배분을 통하여 자원낭비를 줄이고, 개별 소비자에게는 과다한 광고비용의 상품가격에의 전가를 줄임으로서, 가격인상을 억제하는 요인으로 작용한다. 그러나 온라인맞춤형광고가 이루어지기 위해서는 개인정보를 수집‧분석하는 것이 반드시 필요하며, 이러한 과정에서 개인정보 침해문제가 사회문제로 대두되고 있다. 이에 방송통신위원회에서는 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」에 근거하여 ”온라인맞춤형광고 개인정보보호 가이드라인“을 작성하고, 2017년 7월부터 시행하고 있다. 본 연구에서는 동 가이드라인이 규제의 실효성 측면, 가이드라인 적용대상 측면, 개인정보주체의 권리 측면, 가이드라인 상 개인정보 보호대상 측면에서 문제가 있음을 EU와 미국, 그리고 일본의 관련법제 비교를 통하여 제시하고 있다. 그리고 이러한 문제를 해결할 수 있는 방안으로 표시광고 규제 일반법의 성격을 가지고 있는 「표시․광고의 공정화에 관한 법률」 제4조에 근거하여 맞춤형광고에서 개인정보보호에 대한 규제기준을 마련하고, 동 기준에 의해서 사업자가 부당하게 개인정보를 수집․활용하는 등의 행위를 규제할 것을 제안하고 있다. 또한, 동 기준 마련 시, 광고사업자별로 개인정보보호를 위하여 부담하여야 할 책임을 명확하게 제시하고, 가이드라인 상 개인정보 보호대상의 문제점으로 지적한 아이피주소, 쿠키의 고유 아이디 등과 같이 개인을 식별하지는 못하더라도 개인이 사용하는 기기를 식별할 수 있는 정보는 개인정보 보호대상으로 포함시켜야 하며, 식별가능성이 없는 맞춤형광고에서도 사후동의(opt-out)를 보장하는 것도 제인하고 있다.","PeriodicalId":228567,"journal":{"name":"journal of consumer policy studies","volume":"37 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2017-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"114983856","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
