Ce constat du traitement fait à la femme, sachant par la nature de chose qu’il ne peut lui être imposé les mêmes conditions que l’homme, a amené l’auteure à s’interroger sur la position du code minier quant à la condition de la femme liée à l’accès aux ressources minières. Partant de l’analyse des dispositions du code minier et du Règlement minier relatives aux conditions d’éligibilité, l’accès aux ressources minières est reconnu à toute personne tant morale que physique majeure moyennant l’accomplissement des formalités exigées par la loi et les règlements en la matière. Cette reconnaissance ne fait pas une distinction fondée sur le sexe, exception faite de l’hypothèse de l’exclusion de la femme enceinte. Ce qui est compréhensible, puisque considéré comme la protégeant elle et l’enfant des effets toxiques de l’exploitation. Qu’à cela ne tienne, le silence du législateur sur la condition féminine est à la base de beaucoup de discriminations. C’est à titre justement que l’auteure plaide pour la révision du Code minier et Règlement en y insérant des dispositions spécifiquement consacrée à la femme. This is because the security of any society is dependent largely dependent on the effectiveness of its policing system. This work is an analyses of the Police in Nigeria. The works details the formation, recruitment and responsibility of the Nigerian Police Force. {"title":"Le cadre institutionnel de lutte contre la corruption en RDC : analyse critique du cadre juridique de l’agence de prévention et de lutte contre la corruption","authors":"Clément Shamashanga Minga","doi":"10.5771/2363-6262-2021-4-467","DOIUrl":"https://doi.org/10.5771/2363-6262-2021-4-467","url":null,"abstract":"Consacrée à l’examen du cadre juridique régissant l’Agence de Prévention et de Lutte contre la Corruption instituée par l’ordonnance n°20/013 bis du 17 mars 2020, l’étude démontre que ce cadre juridique présente un certain nombre des faiblesses qui entament la légitimité et la crédibilité de cette agence, hypothéquant ainsi les chances de réussite de sa mission. Elle indique que la création de l’APLC par une ordonnance, acte de l’exécutif, n’est pas de nature à assurer la pérennité et la stabilité de cette agence; le Président de la République pouvant à tout moment modifier ou abroger son acte comme bon lui semble. Aussi, l’étude révèle que l’ordonnance ne garantit pas l’indépendance et l’autonomie de l’agence qui est placée sous l’autorité directe du Président de la République. La dépendance de l’agence à l’égard du Président de la République conduit à la politisation de cette institution qui fait partie de services spécialisés du Cabinet du Chef de l’Etat. L’étude révèle également que l’ordonnance créant l’APLC n’assure aucune protection aux membres et personnel de l’agence. Ceux-ci ne bénéficie d’aucun mandat; leur carrière dépend largement du Président de la République qui peut mettre fin à leurs fonctions à tout moment. Les animateurs et le personnel de l’agence ne bénéficient d’aucune protection en matière des poursuites pénales pour les actes commis dans l’exercice ou à l’occasion de l’exercice de leurs fonctions. Elle démontre qu’à ce jour la récusation du juge est régie principalement par les dispositions des articles 49 à 59 de la loi organique portant organisation, fonctionnement et compétences des juridictions de l’ordre judiciaire. A ces dispositions s’ajoutent les dispositions des articles 36 à 42 de la loi du 16 octobre 2002 portant création, organisation et fonctionnement des tribunaux du travail ainsi que celles de l’article 16 de la loi du 03 juillet portant création, organisation et fonctionnement des tribunaux de commerce. Bien que reprenant les principales causes de récusation prévues par la majorité des législations des États, les dispositions régissant la récusation actuellement en République Démocratique du Congo ne couvrent pas les motifs qui donnent lieu à la récusation du juge. Ceci constitue une faiblesse en matière de la garantie de l’impartialité du juge qui est considérée comme la première exigence de la fonction de juger. Aussi, l’étude révèle que les demandes de récusation des juges aboutissent rarement à une décision devant les cours et tribunaux. This virus left governments, communities and systems with the legal, social and moral duties to protect from its impacts. However, some of the approaches adopted towards protecting the victims, potential victims, and the entire society, especially in Nigeria, caused more harm than the disease itself. This work reviews the impact of the curtailment measures adopted by governments in Nigeria and their adverse bearing on human rights, especially the right to life as a sacrosanct and universal right. It further examines how law enforcement agencies’ operations - within the confines of the institutional and international best practices - their non-adherence to the rules of engagement or principles of ethical operations have resulted in the violation of human rights, rather than protecting them. It also analyses the impact of the virus on the right to health and access to medical facilities in times of emergencies in Nigeria and concludes that both rights were either violated or not realized within the context of the ‘war’ against the COVID-19 pandemic. The Federal government of Nigeria has also keyed into the opportunity of exploiting the financial muscle and management capabilities/expertise of the private sector to the PPP as a platform for the funding and execution of public projects, especially commercial infrastructure like roads, ports, airports, rail system, and public services in the area of healthcare. It was on this premise that the federal government, through the Federal Aviation Authority of Nigeria (FAAN), entered into concession agreement over the building and operations of MM2 airport with Bi-Courtney Aviation Services Ltd, which agreement has been the subject of disputes that have not been fully addressed yet. This text of 85 articles in seven (7) headings provides rules and procedures for the preparation, execution, execution, management and control of contracts for public procurement purposes and for the purpose of reflecting transparency, credibility and the profitability of the state action. The above-mentioned law at the same time lays down the rules on public service delegations, the contracts awarded by private legal entities with private law but benefiting from the financing or guarantee of legal persons of public law or acting on their behalf and for his account. In addition, the Congolese constitution of 18 February 2006 as amended by Law No. 11/002 of 20 January 2011 revising certain articles of the Constitution of the Democratic Republic of Congo, in its explanatory memorandum, makes good governance and the fight against the impunity of high-end values. In this respect, the Decree on the Manual of Procedures of the Law on Public Procurement, in its article 8, insists on the freedom of access to public procurement, the equality of candidates, transparency and efficiency of procedures as well as budgeting of public procurement. It should be noted that Article 7 of the Public Procurement Act provides for four types of public procurement: works contracts, supply contracts, service contracts and intellectual services contracts. To comply with this topic, our particular attention is focused on works contracts.
