However, the current approach of criminalizing begging is ineffective and counterproductive. This paper argues that the law on begging in Pakistan needs to be amended to take into account the socio-economic factors contributing to begging and to provide a more compassionate and holistic response to the problem. Poverty, unemployment, and crime rates are prevalent in Pakistan, with begging becoming a necessary option for survival, as five to twenty-five million beggars are found in the country. The laws on begging in Pakistan lack any criteria for distinguishing between professional beggars and those who beg for survival. These laws violate the fundamental rights to life, liberty, equality, and free speech. This paper calls for a deeper understanding of the social and economic factors contributing to begging and the need to amend the law, keeping in due regard to the injunctions of Islam. Rather than punishing beggars, we should focus on addressing the underlying causes of begging and providing beggars with the support they need to live dignified lives. It is high time to create laws that cater to the socio-economic circumstances of our society and to approach this issue with empathy and compassion.","PeriodicalId":165966,"journal":{"name":"Al-Qamar","volume":"53 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-09-30","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139332094","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Hence, Sir Sayyad in his Tafsīr Al-Qurʻān follows following principles. God (Allah Almighty) is real and true, and the Holy Qurʻān is the authentic book of Allah Almighty. Everything described in Holy Qurʻān is based on reality and nobody can refuse authenticity of Holy Qurʻān. Sir Sayyad called work of nature as laws of nature and Word of God as Holy Qurʻān. He enforces that both work of nature (Nature's Laws) and Word of Nature (Holy Qurʻān) runs parallel and can't be different. Laws of nature and the Holy Qurʻān can never be against each other. Principle of universal truth is followed. Man has been created to worship God. We can say that Religion has been blessed to man. This highlights the importance of \"Man's Wisdom”. Hence man has been named as best of all creatures (Ashraf al-Makhlūqāt). Sir Sayyad further explores that there is nothing in the Holy Qurʻān against principles of nature. Holy Qurʻān is complete and it is commandment of Allah Almighty full of reality and truth. However, interpretation of revelation (Wahī) is necessary for understanding. Sir Sayyad enriched his Tafsīr al-Qurʻān with requirements of modern thinking, theology and scientific facts. Ethic refers to the behavior that is based on morals. The position of ethics is like a backbone in any nation and society. The common chapter of the religions of the world is ethics on which there is no disagreement. A review of the concept of ethics reveals that the word ethics does not exist at all in the Hebrew Bible. But through preliminary evaluations the meaning of ethics is understood. In the Hebrew Bible, God's will be considered moral. Unlike other religions, in Islam apart from worship, morals are of key importance. Moral principles and duties are briefly discussed in the Bible. However, the Qurʼan provides complete guidance on moral principles and rules. For those engaged in ijtihād. “Al-Muwāfqāt fī Ūsūl al-Shariʼa” is a renowned work by Imām Shātibī that focuses on the principles of Islamic jurisprudence and their application to contemporary challenges, while addressing new issues that arise with changing times. In this context, Imām Shātibī employs innovative terminology to enhance the understanding of religious concepts, highlighting the significance of the objectives of Sharia and their adaptability through modern reforms. The book encompasses various dimensions of Islamic jurisprudence. Key points discussed in “Al-Muwāfqāt” include the exposition of hidden intricacies within the Hanafī school of thought, articulation of principles of legal objectives in the finest manner. The author emphasizes three central elements: discovering the true intent of legal rulings, ensuring practical application of these rulings, and considering the objectives behind them. Imām Shātibī introduces the concept of “Tawfiq Zahirī” as a way to reconcile differences among jurists with elegance. The author categorizes objectives into two types: objectives derived from the divine law and objectives related to human responsibilities. A prominent feature of “al-Muwāfaqāt” is its extensive utilization of Arabic language and contextual analysis of events. Imām Shātibī's meticulous examination of legal objectives, derivation of principles, and embrace of juristic guidelines is deemed crucial for achieving a comprehensive understanding of the objectives of Shāriʻa.","PeriodicalId":165966,"journal":{"name":"Al-Qamar","volume":"17 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-09-22","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139337183","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This weaker section of society was habitually neglected, exposed to discrimination, put to legal violations, and banned from practically all advanced vocations while disregarding their other abilities for participation in the routine affairs of life. There was no dynamic legislative framework in place and no forward-thinking research to defend the rights of these PWDs in Pakistan. The problems that PWDs are now experiencing appear to be caused by excessive social, physical, and attitudinal action or inaction on the part of society. Therefore, it is essential that Pakistan's present laws be evaluated from the perspective of international human rights treaties and that administrative measures be put into place at the national level to eliminate the exploitation faced by PWDs. After ratifying the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD), Pakistan has built a legislative framework for PWDs, but its efficacy remains unexplored. The article will thoroughly discuss the framework and its efficacy. In discussing PWDs' rights under the UNCRPD, the article emphasizes the active fundamental liberties that PWDs enjoy. The study will also discuss PWDs' challenges in Pakistan and the subtle bias that impedes their advancement. Ultimately, it will offer suggestions for improving legislation and implementation mechanisms to advance the welfare of PWDs in Pakistan.","PeriodicalId":165966,"journal":{"name":"Al-Qamar","volume":"2 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-09-19","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139338772","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
