This is considered by many observers as not providing an opportunity for other parties to obtain the same rights, namely the right to be elected as the leader of the state. In Shī’ism, the term concept of the region of al-Faqīh (power of the faqīh), or an Islamic jurist, is known. With this new system, Shī‘ah Islam has begun a new chapter in a fairly democratic system of government. A system of government that practices the law of God, which is supervised by the experts of religious jurisprudence (faqīh), as in the practice of the al-Faqīh Region system, will outperform all systems of government that are unfair in this world. Maslahah mursalah as an option for this legal proposition begins with the Passed away of the Prophet Muhammad SAW. Along with this happened, the revelation of the Qur’an has stopped coming down, and the words of the Prophet have stopped too. Meanwhile, problems continue to develop from time to time along with the development of the community itself. This is where the idea of Maslahah mursalah emerges as an option for the proposition of Islamic law. Please note, in the application, Maslahah mursalah is based on benefit. Looking at the main basis of this argument, understanding and knowing about the theory of benefit becomes a necessity in the use of maslahah as a proposition of Islamic law. Maslahah is a concept that departs from the main purpose of Islamic law, known as maqashid as-sharia. According to Imam As-Syatibi, the main orientation of maqashid as-sharia is to provide protection and protection against five things, namely religion, self, lineage, reason, and wealth. These five aspects are very fundamental things in life, so that damage to one aspect alone will cause extraordinary negative implications. Thus, maslahah is the main consideration in evaluating the value of benefits and harm from a problem that has just emerged in people’s lives. Hermeneutics as a theory of interpretation will surely give birth to hetereutic products as operational-applications tafsirnya. Fazlur Rahman is one of contemporary Muslim thinkers using the hermeneutic approach in nash interpretation. He grew up in a strong family environment in holding religious teachings by adopting a system of schools against Imam Hanafi (Sunni) as a figure of mujtahid madhhab ulama with traditional-conventional Islamic thinking and developing his scholarship to Western world which influenced many modern-contemporary thinking patterns. Rahman's education with traditional and contemporary background is apparent in his ijtihad results by carrying on the Qur'an, systematic-interpretation and logical-synthesis approaches. Rahman's traditional-liberal form of thought can be understood from his superior theory of double movement theory which was launched in 1982 AD with his basic ideas and ideas about the fundamental differences between the legal aspects of the Qur'an and the ideal aspects of the moral al -Qur'an. The integration of an education system of the traditional system in the state of origin (Pakistan) with the modern system of philosophy while continuing its studies in the West (France) made Rahman consistent with the position of al-Qur'an and sunna as the source of the first and main Islamic teachings as a means to uncover the meaning of the text and messages of both mashdar al-hukm. Fazlur Rahman classified as a unique and prominent thinker of his time is very interesting to be studied. He grew up in Pakistan and expanded his science to France and then to Chicago Canada who was later invited by his local government to return to help in Pakistan. But his struggle in his birthplace did not last long which made Rahman have to move back to Chicago, Canada. The people use to accuse mu’min as a kâfir event he still do praying, fasting, and tithing. Stereotyping people as a kâfir should be in line with the syarî’ah. Syarî’ah merely allows stereotyping people as a kâfir who really out of Islam, rejects Allah as his God, refuses Muhammad as His prophet, and of course, ignores his (Muhammad) taught. Accusing someone as a kâfir which merely based on contradictory view is not permitted by the syarî’ah. So, people who accuses someone infidel without prove of his ignoring to Muhammad’s taught, in fact, is a kâfir, according to al-Ghazali’s view. This kind of accusing people as a kâfir,also happened in the al-Ghazali’s era, whereso many Ulema accuse their ideological opponents as a kâfir just because of their difference in a certain understanding. Imam Hanbali ever accused Imam Asy’ari as a kâfir because Imam Asy’ari ignored Muhammad’s taught in term of Allah’s residence in arsy. Also, Imam Asy’ari ever accused Imam Hanbali as a kâfir because of his ignoring Muhammad’s taught in term of no Allah’s allies. In the plural community, al-Ghazali trough his tashawwuf akhlâkî concept, suggested mu’min to honor all kâfir, even al-Ghzali also prohibited mu’min to be kâfir, because in his opinion, kufr has blocked tazkiyah al-nafs process. Based on those discourses, al-Ghazali has formulated five criteria of people quality, whether mu’min or kâfir. Those five criteria areal-wujûd al-dzâtî, al-wujûd al-hissî, al-wujûd al-khayâlî, al-wujûd al-’aqlî, dan alwujûd al-syibhî. So, people (mu’min) should not accuse people as a kâfir easily. People should respect another people who have different understanding and faith, over tolerance. Esensi tasawuf sebenarnya telah ada sejak masa kehidupan Rasulullah Saw, namun tasawuf sebagai ilmu keislaman adalah hasil kebudayaan Islam yang lahir belakangan, sebagaimana ilmu-ilmu keislaman lainnya seperti fiqih dan ilmu tauhid. Adapun tasawuf ‘amali sendiri, dipahami sebagai ajaran tasawuf yang lebih menekankan kepada perilaku yang baik, dalam kaitannya dengan amalan ibadah kepada Allah. Di dalamnya ditekankan tentang bagaimana melakukan hubungan dengan Allah melalui dhikir atau wirid yang terstruktur dengan harapan memperoleh ridla Allah Swt. Tasawuf ‘amali merupakan tasawuf yang mengedepankan mujahadah, dengan menghapus sifatsifat yang tercela, melintasi semua hambatan itu, dan menghadap total dengan segenap esensi diri hanya kepada Allah Swt. Universal, ethics can be interpreted as a form of custom, custom, morals, character, feelings and attitude. the concept of ethics in general can not be separated from the base that affects the formation of ethics is the religion of Islam (Islam islamic) which became the main source of ethical review process - religious reading - in the reality of everyday life.
