The existing scope and content of powers in the sphere of local self-government are analyzed. The place and significance of this right in the system of legal norms is determined. The article considers a list of sources that influence the formation and functioning of these powers, including the legal positions of the Constitutional Court of the Russian Federation on the issue under study. In addition, the author summarizes the meaning of the main constitutional amendments in this area of legal relations. Venev","doi":"10.18572/1813-1247-2021-3-30-32","DOIUrl":"https://doi.org/10.18572/1813-1247-2021-3-30-32","url":null,"abstract":"The development of the law of criminal procedure governing the jurisdiction of criminal cases considering by jury trial involves the improvement of legislation governing the grounds for which citizens are subject to exclusion from the list of candidates for jurors. Currently, the grounds for exclusion of a citizen from the list of candidates for jurors is his hold of a public office of the Russian Federation, a constituent entity of the Russian Federation, military service and law enforcement agencies. This article examines the question of the possibility of including in this list such grounds as the state civil service and municipal service. As a conclusion, according to the provision that has been formulated if a citizen serves the state civil service and municipal service, it should be included in the list of circumstances in connection with which citizens are subject to exclusion from the lists of jurors. Turning to the past, the author analyzes the perception of the content of the concept of \"rank\" in different historical epochs. It is concluded that the rank played a huge role in the XIX century and was perceived as a title that determines the status of a civil servant of the Russian Empire, a guarantee for obtaining certain material benefits. In the current legislation of the Russian Federation, the content and meaning of the definition of \"class rank\" differ from the understanding that was characteristic of pre-revolutionary Russia. The article analyzes the norms of Federal laws, according to which it is necessary to take measures to protect the population from natural and man-made emergencies, including the spread of diseases that pose a danger to others. The decisions of the chief state sanitary doctors of the Russian Federation and the subjects of Russia that restrict the rights and freedoms of a person and citizen without having legal grounds for this are subjected to critical reflection. And to this day, domestic and foreign experts do not cease to worry about the problems associated with the birth and development of Japanese public authorities and management. Based on this, the study of the problem of the formation, functioning, and historical features of the Japanese state power becomes relevant. In this regard, the paper used a combination of different approaches used in describing the temporal evolution of Japanese public administration. In particular, in order to implement this task, the author used a comparative-historical method, which allowed us to study the genesis of the state authorities of Japan in chronological boundaries from the VII century to the present. In the course of the research, the author comes to the conclusion that initially the components of the Japanese system of public administration were formed on the traditions of Far Eastern values. After the end of the Second World War, the further development of Japan was influenced by the values of Western civilization. Currently, the world is presented with a unique original Japanese system of public administration.
