Se argumentará que ese enfoque no fue eficaz para reducir la brecha existente entre el reconocimiento de los derechos en las leyes y su efectivo goce en la realidad. \u0000Abstract: Universal and regional international norms on children's human rights were interpreted with a specific approach in Latin America. The region produced its own, regional translation of all these rules and principles, which, although efficient in its original formulation to promote legal transformations then necessary, over the years generated some difficulties in guaranteeing the full recognition of the rights of children in practice. This article aims to introduce and discuss the specialized education system in China that has been established for the prevention of juvenile delinquency. It begins by presenting the general trends of juvenile delinquency in recent years and analyzing the reasons and insights hidden in these trends. {"title":"The Committee on the Rights of the Child – Does Size matter?","authors":"R. All Member States to the United Nations but one, have ratified the Convention during the thirty years of its existence. Three Optional Protocols were added to the Convention. In order to monitor progress, a treaty body was created, the Committee on the Rights of the Child, based in Geneva. This treaty body is regularly evaluating the reports of States Parties. The Committee published concluding observations regarding each State Party on the basis of the country report as well as the constructive dialogue with the Committee in order to assist Member States in implementing the Convention holistically. Another instrument that the Committee has used extensively concerns the issuing of General Comments on specific provisions of the Convention and/or specific children’s rights issues. Under the Optional Protocol to the Convention on the Rights of the Child on a communications procedure, the Committee has the competence to receive individual communications coming from children or persons acting on their behalf. {"title":"SANCTIONING CHILDREN IN CONFLICT WITH THE LAW FOR SMUGGLING MIGRANTS AND HUMAN TRAFFICKING IN NORTH MACEDONIA","authors":"Aleksandra Gruevska Drakulevski, Aleksandra Deanoska Trendafilova, Olja Ristova","doi":"10.55400/iayfjmaimjf.v2022i1.63","DOIUrl":"https://doi.org/10.55400/iayfjmaimjf.v2022i1.63","url":null,"abstract":"In this article, the authors refer to the issue of children in conflict with the law for actions of human trafficking and smuggling of migrants. The authors make a distinction between smuggling of migrants and human trafficking concluding that they are fundamentally different, although, in practice, the distinction between the two crimes is not always easy to establish. Then, the international frameworks and North Macedonia’s legislative framework is subject of examination. \u0000Although children are at most times victims of these crimes, there are cases when their role is on the perpetrators side. Four cases from the Macedonian judicial practice are analysed in this respect showing that children are involved (often by and with adults) into criminal activities of this type. One of the four cases relates to child trafficking and three relate to the smuggling of migrants. \u0000The authors conclude that although the prosecution of traffickers is more successful, the identification of victims and assistance to them are still elements of the fight against trafficking to which not enough attention is paid in our country and beyond. When children appear as perpetrators of these crimes, the urgency is even more pronounced as they are usually children that faced risk before they took part in criminal activities. Macedonian courts tend to impose educational and alternative measures rather than classical punishments.
