Wojtyła","doi":"10.5114/JHI.2021.104092","DOIUrl":"https://doi.org/10.5114/JHI.2021.104092","url":null,"abstract":"In March 2020 “PLoS One” published a paper by Gańczak and colleagues exploring the trends in years of life lost (YLLs), years lived with disability (YLDs), and disability-adjusted life years (DALYs) in Poland between 1990 and 2017, concluding that health in Poland is improving. Our research demonstrates that for the last 18 years Poland has experienced a public health crisis culminating in a health recession. In the period between 2003 and 2018 health growth in Poland first slowed down, and then came to a halt. Finally, between 2017 and 2018 life expectancy in Poland was declined. Stȩpniak","doi":"10.5114/jhi.2021.113165","DOIUrl":"https://doi.org/10.5114/jhi.2021.113165","url":null,"abstract":"This article is devoted to the problem of compensation of damage caused to patients by medical personnel in connection with the provision of health services. It considers 2 situations: medical error and negligence? In legal construction of compensation for medical errors are caution and due diligence in action. The article analyses both concepts. It also refers to negligence in connection with the provision of health services. The development of medicine, respect for ethical standards, as well as patient rights, mean that the tendency towards and highest diligence when providing medical services is becoming more pronounced. The article emphasizes that a similar position is taken by the Court in Poland. The duty of due diligence results from the professional nature of the doctor’s actions. It is defined by the medical standards.
