We begin with a critical review of irregularity and how it is (re)produced between conditions of entry and stay, changing policy requirements and pathways into and out of irregular status. We then take two contrasted cases, Canada and Spain, to illustrate how their diametrically opposed economic immigration management regimes (Canada's highly regulated, proactive approach; Spain's deregulated, retroactive policy) produce similar forms of irregularised, semi-legal and precarious status for migrants. From these reflections, we propose a multi-dimensional perspective on the concept of precarity that includes social, legal and economic aspects, arguing that precarity offers a better analytical palette for understanding irregularity in migration today. This notwithstanding, the litigation surrounding its legal validity is not yet conclusively determined. This article analyses all five STCA decisions to develop a critical reading of the leading decision as issued by the Supreme Court of Canada in 2023. It posits that the Supreme Court of Canada, like the appellate courts before it, erred in its understanding of the STCA. Specifically, the Court did not engage the facts on record in sufficient detail, and did not meaningfully consider how asylum seekers' positionality informs their legal experiences. As a result, the Court arrived at flawed legal findings that mischaracterise the STCA's operation and effect. This paper explores how Iranian international graduate students experience human dignity (HD) in relation to the Canadian/Quebec immigration system (CQIS). Drawing on in-depth interviews with 24 current and former Iranian international students (IISs) (ten men and ten women IISs in Montreal, and two men and two women graduates who had left Canada), this paper adopts a conceptual framework of HD to analyse the data. Two themes emerged as key to Iranian international students' experiences with CQIS: 1) frustration with immigration rules during their studies; 2) lack of clarity regarding processing times and procedures. These themes provided empirical support for the HD framework including equality, humanity, respect, and human rights. An awareness of ISs' experiences of HD within the immigration system could strengthen the support offered to ISs in Canada.
