Today, the military service solves the most important state tasks and performs extremely important social functions, therefore victim behavior in the Armed Forces is a serious issue that requires resolution . Previous studies indicate that for military personnel who have been subjected to criminal attacks, the level of victimization is much greater than for others . In this regard, solving problems related to the maximum reduction in criminal and victim behavior in the army environment is a priority . The author concludes that among the effective tools for reducing victimization in the military environment, first and foremost is victimological prevention, as well as victimological forecasting, the importance of which is only increasing every year . He also convincingly proved that it is impossible to achieve a positive effect in reducing victimization in the military environment by ignoring the high-quality coordination of the activities in question, improving the legal framework for this work, scientifically based and normatively enshrined prevention of criminal processes in the troops, as well as other measures . In the future, we should strive to ensure that the victimological impact on military crime represents a set of forms and methods to prevent the victimization of the persons in question, as well as to ensure the safety of potential victims of this crime","PeriodicalId":85835,"journal":{"name":"Victimology","volume":"57 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-28","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140419792","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Analysis of the current criminal legislation, Decisions of the Plenum of the Supreme Court, materials of investigative and judicial practice, as well as doctrinal studies concerning the issue being sought and presented on the pages of legal publications, allowed us to state the lack of a uniform understanding of taking into account the position of the victim when deciding on the release of a person from criminal liability on the basis of the provisions of the Criminal Procedure Code (Article 25 .1 of the Code of Criminal Procedure of the Russian Federation) and the criminal legislation of the Russian Federation (Article 76 .2 of the Criminal Code of the Russian Federation). The results of the conducted research allowed us to conclude that the presence of an individual whose rights and legitimate interests were violated as a result of a criminal encroachment, having the status of a victim of a crime, should be an important legal fact taken into account by investigative and judicial authorities when considering criminal cases. Opinion of such person (objection or consent) regarding the termination of the criminal case and criminal prosecution in general and with the appointment of a material payment to the state’s income (art . 762 of the Criminal Code of the Russian Federation), in particular, is of decisive importance for law enforcement agencies.","PeriodicalId":85835,"journal":{"name":"Victimology","volume":"110 5","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-28","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140422486","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Since active participation in the investigation of a criminal case increases the level of satisfaction of the victim with the justice system, it is proposed to expand the relevant procedural possibilities, while not shifting the burden of proof to him. The beginning of the victim’s interaction with law enforcement agencies should be his participation in the inspection of the scene of the incident. The author proposes to provide the victim with the opportunity to participate in this investigative action remotely, using video conferencing. This will not only increase the level of confidence of the victim in law enforcement agencies, but also provide instant feedback between the investigative task force and the victim of the crime, allowing to correctly determine the direction of the ongoing investigation. The article notes that the victim acquires the full range of procedural rights from the moment the relevant decision is made. The author believes that the victim should be able to immediately familiarize himself with this document, as well as receive other information on the criminal case both personally and remotely, using information and communication technologies. It is noted that it is necessary to organize pre-trial proceedings in accordance with the needs of the victim, giving him the opportunity to choose the form of participation (in person or remotely), as well as the use of a personal digital device to participate in investigative actions through video conferencing. It is proposed to amend the legislation allowing the use of household messengers in the production of remote investigative actions, or the creation of an electronic service on the mobile platform of public services for video conferencing with government agencies.","PeriodicalId":85835,"journal":{"name":"Victimology","volume":"134 28","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-28","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140423354","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The purpose of this study was a comparative analysis of the life plans of prisoners of different regimes (strict, general, colony-settlement). The study was conducted on the basis of correctional institutions of the Federal Penitentiary Service of Russia in the Ryazan region . It was attended by 118 male convicts serving sentences in various regimes (general, strict, penal colony). Methods. During the study, the following methods were used: observation, conversation, questioning, analysis of personal files, methods: “Self-assessment of life plans” by A. V. Naprisa (modified version of the “Self-Assessment of Orientation” test by V. G. Deev); “Time Perspective Questionnaire” by F. Zimbardo; “Time Attitude Scale” by J. Nuytten, V. Lensom; Questionnaire “Style of Explanation of Successes and Failures” (STONE-B) T.O. Gordeeva, Ye. N. Osina, V. Yu. Shevyakhova; “Vitality test” S. Maddi (adapted by D. A. Leontiev, Ye. I. Rasskazova); methods of mathematical statistics. Results. It has been established that convicts in colony settlements have the most constructive life plans .
