Malakar","doi":"10.3126/jpd.v2i1.43474","DOIUrl":"https://doi.org/10.3126/jpd.v2i1.43474","url":null,"abstract":"This study aims at assessing the process and practice of local development planning in Nepal under federal system, with the bid of analyzing the local government operation act, 2074 and local level plan formulation direction, 2075. Using the primary and secondary sources of data, the study embarks on the local development planning process under federal system of Nepal while employing a descriptive research design. Nepal has not experienced long empirical experiences on local development planning exercised under federal democratic republic and it is a totally new practice. The study argues that the local government operation Act, enacted in 2074, conceived the decentralized planning process starting from the settlement level moving up through the local government to the national level and under this all local bodies are required to prepare short, medium and long term, periodic and strategic plans. It focuses on power relations, roles and challenges along with the existing women's subordination in the society. Gender Inclusiveness is additional diverse activity and process of local governments, local institutions like Ward, Rural Municipality, District Coordination Committee and Municipality with self-reliant local governance and sustainable and effective service providing agencies. This article based on the objective to highlight the existing variation of women's inclusion in local governments among developed and developing countries. It analyses the provisions regarding inclusion addressed in the federal Constitution of Nepal in local elections. This paper widely covers concept, definition, theories, practice, situation, laws, policies and program at all levels. The paper is based on secondary sources of information, data published by Election Commission 2017, in Nepal. The raw data are analysed using the Excel spread program on computer and are calculated in frequency distribution and percentage to make its meaningful analysis. Data are carefully analysed and interpreted for generalization. The gender inclusion in local government is gradually increasing. As in national election 2017, the female elected members in local government are almost 40 percent in the districts of Nepal and the data is more than allocated (33%) by the Constitution of Nepal 2015 and election manifestos of different political parties. The advancement of the rule of law at the national and international levels is thus, essential for the protection of fundamental human rights and freedom. Nepal has an obligation to take an effective action against all such malpractices. Nepal has participated and ratified the gender policies in all Conventions and conferences. To fulfill this very obligation, it has introduced some legal provisions and made an attempt to implement them. Due to this region, Nepal has started to address the gender issues from sixth five year plan to till now. Planned efforts to improve the situation of women began during the Sixth Plan (1981- 1985) but its approach was welfare-driven. The Interim plan (2008-2011) focused the gender responsive budget and allocated the 33 percent reservation in every state structure. The constitution of Nepal 2015, article 11 (5) and (7) compromises the ability of women to independently confer citizenship to her child. Likewise, there are many domestic legal regimes existed here. The fifteenth periodic plan approach paper, 2020 emphasizes the gender equivalence in local level. Government policies are stated with high priorities for gender main streaming policies. The experience shows that ensuring the provisions of equal rights in the constitution is important, but at the same time, proper implementation of those provisions is equally important to balance the theoretical and practical gap of gender and development. This paper describes the marriage practices among Maharjan, and explains how it is anthropologically interesting. The main purpose of this research paper is to examine traditional marriage practices of the Maharjan people as well as the procedures from beginning to end of the marriage. Nepal is a multiethnic and multicultural country along with ecological variation and hidden ethno history. Most of them have their specific language, religion, cultural practices, food habits, festivals, rites and rituals. Among the 59 indigenous ethnic groups of Nepal, the Newars are one of them. Among the different groups of Newar, Maharjan is one sub-group. The present study is ardent to the Maharjan people of Ghachhe Tole of Patan in general and their practice of traditional marriage in particular. This study has been steered by retaining both exploratory cum descriptive research design using the qualitative data. The data of the present study is based on primary as well as secondary sources. In this exploration more detailed account of the traditional marriage practice and processes amongst the Maharjan people is presented in an intricate manner.
