The nurse manager needs to be aware of the nexus between moral dilemmas in healthcare and the right of providers to refuse to participate in certain controversial procedures, as well as other professional and ethical reasons such as lack of training or fatigue that may lead a staff nurse to refuse a patient care assignment. This article explores each of these situations and outlines federal and state laws that impact this situation. Executive Summary This document is written for hospital leaders at all levels who are interested in providing patients safer and higher quality care. It does not contain the views of researchers or theorists on how you can do better. Instead, it presents the thoughts, successes, and failures of hospital leaders who have used concepts of high reliability to make patient care better. It is a guidebook for leaders who want to do the same. High reliability concepts are tools that a growing number of hospitals are using to help achieve their safety, quality, and efficiency goals. These concepts are not an improvement methodology such as Six Sigma ® or Lean. Instead, they are insights into how to think about and change the vexing quality and safety issues you face. Hospitals do most things right, much of the time. But even very infrequent failures in critical processes can have terrible consequences for a patient. Creating a culture and processes that radically reduce system failures and effectively respond when failures do occur is the goal of high reliability thinking. At the core of high reliability organizations (HROs) are five key concepts, which we believe are essential for any improvement initiative to succeed: • Sensitivity to operations. Preserving constant awareness by leaders and staff of the state of the systems and processes that affect patient care. This awareness is key to noting risks and preventing them. • Reluctance to simplify. Simple processes are good, but simplistic explanations for why things work or fail are risky. Avoiding overly simple explanations of failure (unqualified staff, inadequate training, communication failure, etc.) is essential in order to understand the true reasons patients are placed at risk. • Preoccupation with failure. When near-misses occur, these are viewed as evidence of systems that should be improved to reduce potential harm to patients. Rather than viewing near-misses as proof that the system has effective safeguards, they are viewed as symptomatic of areas in need of more attention. • Deference to expertise. On balance, it is a far-from-perfect means of selecting employees, but it remains the best such means available. Effective interviewing requires thorough preparation, including knowledge of how to seek out the most helpful kinds of information available; complete information about the position as it presently exists; and detailed knowledge of what kinds of questions can or cannot legally be asked. Using Domain names is like calling someone on the phone without needing to know the actual phone number. It allows the searcher to “call” using the domain name instead of the IP address and connect to a website. Registrants in Canada use the “.ca” suffix although others are equally common like “.com”, “.org”, etc., and each must be registered separately. Domain names are registered on a first come, first served basis. All that is needed is a fee, the name of an administrator and a password. Both state and federal law require the testimony of a like-kind professional to establish the standard of care or standard of professional practice. Case management, although not entirely recognized as a separate and distinct profession (as each practitioner must have an underlying profession to qualify as a case manager), is no stranger to lawsuits. More and more, attorneys across the country are identifying case managers as potential defendants in professional liability lawsuits. The most common area of liability appears to be in those cases where case managers make decisions on the basis of cost-savings alone, without regard to quality. Clearly, such an action is contrary to the established standard of practice of both the Case Management Society of America (CMSA, 2002) and the Commission for Case Management Certification (CCMC, 2004). The CMSA, a professional organization, and the CCMC, a credentialing body, share the position that cost-effective case management must include a comparative analysis that considers the needs of the individual client, quality of service/product considered, and the impact on the payor. Should a malpractice lawsuit be filed, naming a case manager as a defendant, another case manager would be called upon as an expert witness to establish the appropriate standard of practice. It is not enough that the CMSA has printed the ‘‘standards.’’ A case manager, available for live testimony, would be required to give his or her opinion, through a report, perhaps at deposition and ultimately at trial, as to the application of the standard to the facts of the particular case.
