{"title":"Chief Justice Marsha Ternus: An Inside Look at the Tenure of Iowa's Former Chief Justice","authors":"J. Cardinale","doi":"10.2139/SSRN.2147803","DOIUrl":"https://doi.org/10.2139/SSRN.2147803","url":null,"abstract":"This paper will examine Ternus’ voting trends during her time as Chief Justice of the Iowa Supreme Court, from September 2006 to December 2010. In Part II, the Chief Justice’s upbringing and career path will be discussed. Part III will provide a brief overview of the history and composition of the Iowa Supreme Court. Then, in Part IV, Ternus’ voting patterns will be studied in two important ways. First, opinions authored by Ternus will be reviewed. Here, split decisions will be scrutinized more closely. Then, the sole dissent authored by Ternus as Chief Justice will be examined. Next, cases regarding child welfare will be evaluated. Additionally, comparisons will be drawn in terms of the number of child welfare cases decided on Ternus’ bench versus those decided on Chief Justice Lavorato’s bench, Ternus’ immediate predecessor. The methodology for each portion will be explained in the footnotes. {"title":"ERISA failures and the erosion of workers' rights: the urgent need to protect private & public workers' pension and benefits.","authors":"James P Allen, Richard A Bales","doi":"","DOIUrl":"","url":null,"abstract":"<p><p>On March 11, 2011, Governor Scott Walker of Wisconsin signed into law a bill that eliminated most collective bargaining rights for the state's public-sector workers. Many other cash-strapped states followed Wisconsin's lead and introduced or enacted similar restraints on the rights of their workers. Thousands of public workers, whose only means of protecting their rights rested in their ability to collectively bargain, suddenly found their retirement benefits in jeopardy. This truth highlighted the lack of protections for public worker benefits similar to those of the private sector. However, the Employee Retirement Income Security Act, enacted for that purpose, has failed to secure these benefits. This article seeks to provide a broad overview of the crisis facing the pension and benefits system in the United States and offers some possible solutions. This experiment examined the extent to which the knowledge that a case has passed pre-screening by an innocence project influences case-reviewer judgment through top-down case processing. One hundred-fifty-nine participants role-played case reviewers, evaluated discovery for a criminal case, and evaluated the case. Prior to evaluation, half of the participants were instructed that the case was not previously adjudicated, whereas the other half was told that the case was referred by an innocence advocacy organization.
