{"title":"Involuntary hospitalization and police referrals to a psychiatric emergency department.","authors":"L W Reinish,&nbsp;J R Ciccone","doi":"","DOIUrl":"","url":null,"abstract":"<p><p>This study compares the demographic and clinical characteristics of police referrals with referrals from other sources to the psychiatric emergency department of a university hospital and the demographic and clinical characteristics of police referrals who were involuntary hospitalized with police referrals who were discharged from the emergency department (ED). In our study, 182 cases were seen in the psychiatric ED over the one-month period; 32 (17.6%) were police referrals. Police referrals were not more frequently hospitalized than referrals from other sources. Police referrals were, however, more likely to have been violent towards others preceding admission (59.4% versus 20.0%; chi 2 = 20.8; df = 1; p < .01) and to be intoxicated on presentation (31.3% versus 10.7%; chi 2 = 91; df = 1; p < .01). Police referrals also were significantly more likely to be violent in the psychiatric ED than referrals from other sources (37.5% versus 3.4%, chi 2 = 36.5, df = 1, p < .01) and to be restrained or secluded (34.4% versus 4.0%; chi 2 = 28.8; df = 1; p < .01). Involuntarily hospitalized police referrals were significantly more likely to be suffering from a major psychiatric disorder than police referrals not hospitalized (83.3% versus 11.8%; chi 2 = 14.7; df = 1; p < .01). A severely violent group, composed primarily of psychotic patients charged with murder, was compared with a less severely violent group that was composed primarily of psychotic patients involved with property crimes. As compared with the less violent group, the severely violent group was more likely to have delusional beliefs about specific personal targets and to have delusions about significant others being replaced by impostors. These beliefs were accompanied by higher scores on neuropsychological tests of intellectual and academic abilities. A high number of their blood relatives were victims of psychotic murder. {"title":"Long-term, assenting psychiatric patients: decisional capacity and the quality of care.","authors":"S K Hoge,&nbsp;T C Feucht-Haviar","doi":"","DOIUrl":"","url":null,"abstract":"<p><p>The objectives of this study were (1) to investigate whether the relationship between functional decisional capacity and the resulting quality of treatment posited by the informed consent theory is found in clinical practice; and (2) to describe the range of decisional impairments found in long-term psychiatric inpatients who comply with prescribed treatment. Eighty-eight long-term, compliant, psychiatric inpatients, in two public hospitals, who were prescribed antipsychotic medications were assessed. Following a formal assessment of decisional capacity, subjects were categorized according to level of impairment, using a hierarchical scheme. All subjects were evaluated for the presence of abnormal involuntary movements. The appropriateness of treatment with antipsychotic medications was determined using accepted clinical guidelines. Patients with more serious impairments of decisional capacity were more likely to receive inappropriate treatment with antipsychotic medication; and serious impairments of decisional capacity were common. The study lends empirical support to one of the bases of the doctrine of informed consent: the notion that capable patient involvement in decisionmaking plays an important role in checking the judgments of treating physicians. Across the seven states, there was an inverse relationship (r = -.67) between the frequency of use and the likelihood of success. As a result, the overall volume of insanity acquittees was stable. Based upon a sample of 8,138 people indicted for a felony and who raised an insanity plea at some point during the processing of their cases, the characteristics of insanity defendants and their cases differed by state, and a number of these characteristics, particularly diagnosis and type of crime were related to the likelihood of an insanity acquittal. The inverse relationship between the plea and success rates was at least partially explained by the differences in the composition of the cases. States with high plea rates tended to have a higher proportion of cases that involved defendants who were unlikely to succeed. A recognized need for special education, training, and experience, with the assurance of competence, became clearly defined in the mid-20th century. This was brought into perspective in a joint effort by the American Academy of Forensic Sciences and the American Academy of Psychiatry and the Law. At the present time there are 38 fellowship programs with approximately 50 positions available. These cases illustrate the clinical realities of provisions in this new law that affect inpatient practice. Federal, New York state, and case law that frame the issue are reviewed. The experience of living and working with service dogs in an inpatient milieu required many accommodations and exposed potentially dangerous consequences that were not immediately recognized. The authors examine the clinical and medicolegal issues raised by these cases. Schizophrenic patients (n = 49) who had been found unfit to stand trial were investigated for violence, according to index offenses and longitudinal histories (before and after admission) for violence. Those charged with violent offenses were significantly more often married with children, and were equally likely to direct their assaultiveness to strangers, acquaintances, and family members. The nature of the index offense seemed to be a good indicator of general violent propensity. No significant differences were found on Barratt's Impulsivity Scale and Zuckerman's Sensation Seeking Scale, except that schizophrenic patients with negative histories of violence scored higher on the thrill and adventure subscale. No pattern of substance abuse differentiated the groups. Patients charged with violent offenses more often presented with persecutory delusions, but this did not extend to those whose histories were positive for repetitive violence. Arsonists were mainly male, poorly educated, unemployed, and living in rural areas. Eighty-four percent of the arsonists and 62 percent of the homicide offenders had an alcohol abuse problem. This difference was statistically significant (p = .002). The arsonists more commonly had suicidal thoughts and attempted suicides. Over one-third of the arsonists used fire-setting as a suicide attempt. In comparing the arsonists with the control group, there was a statistically significant difference in the variables that indicate suicidality. Arsonists more commonly had diagnosed psychiatric diseases (p = .008). The incidence of psychoses was fourfold, chronic or severe depression about threefold, and mental retardation twofold when compared with the homicide offenders. Eighty-five percent of the arsonists had received psychiatric care before the crime was committed.
