{"title":"Dyskryminacja pracowników wypełniających obowiązki rodzicielskie","authors":"Justyna Czerniak-Swędzioł","doi":"10.31261/zpppips.2020.18.03","DOIUrl":"https://doi.org/10.31261/zpppips.2020.18.03","url":null,"abstract":"Dyskryminacja pracownika, który poza obowiązkami zawodowymi wypełnia również obowiązki rodzicielskie, pozostaje wysoce naganna. Praca zawodowa, jak i życie rodzinne, stanowią najważniejsze sfery życia, które pozostają ze sobą ściśle powiązane i wzajemnie od siebie zależne, a jednocześnie względem siebie silnie konkurencyjne. Ochrona pracownika-rodzica powinna dotyczyć nie tylko przyznania mu stosownych uprawień, ale przede wszystkim stwarzać skuteczne środki ochrony (prawne, poza-prawne) przed dyskryminacją. Jeżeli korzystanie z licznych uprawnień z tytułu rodzicielstwa staje się przyczyną nierównego traktowania, to dochodzi do niedozwolonej dyskryminacji ze względu na rodzicielstwo. Wybór życiowy, jakim pozostaje rodzicielstwo a w konsekwencji wypełnianie obowiązków z nim związanych może mieć znaczący wpływ na traktowanie i pozycję pracownika w środowisku pracy stąd też winno być ono – de lege ferenda – zawarte w treści kodeksowej zasady jako kryterium niedozwolonego różnicowania. Przy czym ochroną przed dyskryminacją z uwagi na rodzicielstwo objęci winni być nie tylko sami pracownicy, ale również kandydaci do pracy oraz byli pracownicy. Ustawodawca stworzył pracownikowi--rodzicowi kilka możliwość, z których ten może skorzystać w przypadku wystąpienia dyskryminacji, takich jak np. rozwiązanie umowy o prace bez wypowiedzenia (choć nie w każdym przypadku) czy roszczenia odszkodowawcze, ale przy faktycznej ochronie przed dyskryminacją wydają się być one jednak niewystarczające. Ochrona przed dyskryminacją pracowników–rodziców nie będzie kompletna, jeśli pozosta-nie oparta jedynie na rozwiązaniach kodeksowych. Bez konkretnych rozwiązań w zakresie obligatoryjnego wdrażania przez pracodawcę stosownych procedur anty-dyskryminacyjnych nie będzie możliwe zapewnienie pełnej i skutecznej ochrony. Jednakże, aby móc sięgnąć do kodeksowych środków ochrony, należy przede wszystkim uregulować je tak, aby nie był wątpliwy ich charakter prawny oraz zakres. In Italy outsourcing is widespread, facilitated by a legislation that has removed limits and made the outsourced production and the management of the workforce easier. As a result, employment, working conditions and industrial relations in the value chain have been affected by this phenomenon in terms of high fragmentation and work protection. In this scenario the industries which have been more negatively impacted by the phenomenon are the ones under high pressure from large retailers and the demand for low cost goods, such as the logistics and the meat sector. The article aims at presenting the analysis of outsourcing phenomenon in Italy, by examining its causes, its mechanism and its consequences on workers and their trade unions. In this context, an inadequacy of the present regulatory approaches in addressing the phenomenon of outsourcing has been observed. {"title":"Employee’s obligation to submit to preventive tests for sobriety","authors":"Magdalena Rycak","doi":"10.4467/25444654spp.19.019.10909","DOIUrl":"https://doi.org/10.4467/25444654spp.19.019.10909","url":null,"abstract":"The article presents an analysis of employees’ obligation to be sober in the context of legal possibilities of running preventive sobriety tests on employees. It thoroughly discusses the Supreme Court judgment policy on employees’ obligation to be sober in the workplace and legal consequences of their failure to fulfil this duty. The article also conducts a critical analysis of the opinion that an employer can carry out preventive checks only based on an employee’s consent expressed on his/her own initiative. The author proves that a contrary thesis is right and that, in case of some jobs, such as drivers or persons working at height, an employer is obliged to do preventive tests for employees’ sobriety and employees are obliged to take such tests. At the same time, employees’ consent to process data concerning the state of their sobriety is not required.
