EU law does not specify the concept of the court but leaves this question to the legislature of each state, which is why this question is regulated differently in EU states and thus represents a greater challenge for the future. In addition, the dynamic normative activity in this area at the European level requires further study and adaptation of the regulation. The main objective of this text is to present some of the potential problems, so a sketch of the challenges and possible answers that this text will offer can be considered as a modest contribution to the discussion on the inclusion of AI in litigation.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"10 1-2","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139895357","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In Southeastern Europe, given the war conflicts that occurred during the 1990s, in 1999, the EU Council initiated the Stabilization and Association Process (SAP) to encourage Western Balkans countries (WB) to cooperate among themselves and confirmed their eligibility for EU membership. After the V4 countries joined the EU, the Visegrad Declaration on cooperation in 2004 emphasized the idea of supporting the European integration of neighboring regions, including the Western Balkan region. From 2004 to the present day, the WB countries have applied for EU membership, and they have been granted EU candidate country status. In 2014 they became a part of the Berlin process (BP)initiative and for three of them – Albania, North Macedonia (N. Macedonia) and Serbia – accession negotiations with EU have already been opened. These three countries launched the Mini Schengen initiative in 2019, which was transformed into Open Balkan initiative (OB3) in 2021. Since that both Visegrad and Open Balkan in itiatives aim to enhance interstate cooperation and facilitate European integration process for their respective countries, the purpose of this paper is to consider the role of regional organizations and initiatives in accelerating the integration process, to examine whether the OB3 can draw valuable lessons from V4 experience and to elucidate how V4 supports the integration process of OB3.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"55 5","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139895501","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

After the introduction which reflects on general and special reasons for termination of enforcement in general, the authors analyze the subject provision de lege lata. They point out the positive and negative effects of that provision, linking them with the original intent that the legislator had upon its enactment. In that part of the paper, the authors compare the subject provision with the provision of Art. 72 para 2 of the Enforcement act and point out its (in)existence in the legal orders of other European countries. Special attention in the analysis is given to the character i.e. to the content of the legal action that the party seeking enforcement has to undertake within a year in order to avoid termination of enforcement by application of the subject provision. The authors also point out the modalities in which domestic courts interpret the subject provision and it is also analyzed from the viewpoint of the right of access to a court. Finally, the authors warn about the problems that may appear because of egregious formalistic interpretation of the subject provision and they discuss de lege ferenda suggestions to limit its application exclusively to proceedings for enforcement of monetary claims.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"20 6","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139896046","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The collaboration between Serbia, North Macedonia, and Albania aims to tackle socio-economic challenges, fostering regional cooperation for better state integration and the joint use of resources to combat unemployment and economic issues. This initiative has led to various agreements and acts forming the legal framework, mirroring the European Union’s values of unrestricted movement of people, goods, capital, and services. Key areas include establishing a single market, recognizing diplomas and qualifications, introducing administrative benefits in employment, and streamlining work permits. Facilitating free labor market access reduces emigration and aligns labor supply and demand across sectors. The construction of a unified labor market involves implementing an electronic system for identifying and applying for freelance jobs within the regional Union, serving as a potent tool for migration control and addressing labor shortages in specific professions.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"46 2","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139895381","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Most often, employment and work of migrant workers is accompanied by lack of stability and security of employment, as well as administrative, but also linguistic and cultural barriers, and finally numerous stereotypes and prejudices. On the other hand, working in agriculture also involves facing a series of specific challenges that are especially emphasized when it comes to migrants as seasonal workers in agriculture. An additional layer of complexity is introduced by once we take into account the gender perspective, considering the emphasized feminization of migration, as well as the feminization of agriculture. Of particular importance in the context of overcoming at least some of the mentioned challenges related to seasonal work of migrant women in agriculture in the Western Balkans is the Open Balkan initiative, which aims, among other, to achieve the free movement of workers and equal access to the labour market in member states.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"18 4","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139895389","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In addition to its key role in unifying and harmonizing judicial practices, the preliminary reference institute guarantees the effectiveness of judicial protection, implementation of the principles of equality and security, seeking to ensure an equal legal position for all Union citizens. In this paper, the authors elucidate the role of the preliminary reference procedure in the legal order of the European Union (hereinafter: EU), emphasizing the scarce intention of national constitutional courts to refer a preliminary question and their current issues. Taking into account the fact that the Constitutional Court of the Republic of Croatia posed a preliminary question to the EU Court for the first time in April 2023, a process that is still ongoing, the authors analyze the submitted request, problematizing the potential elements of discrimination regarding the freedom of movement of students studying at foreign universities, referring to related examples from the EU Court’s case law.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"16 4","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139895372","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This text explores how climate change affects children’s rights according to the Convention on the Rights of the Child and other international instruments, emphasizing the importance of the right to a healthy environment. It also analyzes the practices and efforts of the Committee on the Rights of the Child in safeguarding children from climate change. Special emphasis is placed on the vulnerability of children as climate migrants and their role in climate lawsuits that demand state accountability for failures in reducing greenhouse gas emissions and adapting to climate change. The paper also examines the impact of climate change on the position of children in Serbia, a country considered one of the most vulnerable in Europe regarding climate consequences.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"114 3-4","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139895534","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

At the same time, the right to be heard is identified with the principle of adversary (audiatur et altera pars), that is, with the right of one party to respond to the requests, statements and proposals of the opponent party. Also, it is understood that the denial of this hearing represents an absolute substantial procedural defect from Art. 374 (2) point 7 of the Law on Civil Procedure (ZPP). However, at the hearing analysed here, the plaintiff does not respond to the legal argumentation of the opposing side, but to the legal reasoning of the court. This paper critically examines the content of the right to be heard, more precisely, the traditional understanding of this right. As a result of the analysis, the right to be heard is equated with the right to a hearing, which allows parties to respond to the procedural actions undertaken by their opponent (relationship: partyparty), but also to the court’s legal reasoning (relationship: courtparty), during the course of the hearing. Given that these two forms of the right to be heard do not serve to achieve the same goals, an interpretation of Art. 374 (2) point 7 ZPP is offered through teleological reduction. It implies that only denying a party to respond to the opponents’ actions and statements leads to an absolute substantial procedural defect. While, on the other hand, denying a party to express opinion regarding the legal reasoning of the court, represents a relative substantial procedural defect.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"46 5-6","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139896045","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The regimes of national exhaustion of intellectual property rights (implemented in the region) block parallel imports (trade) of the protected goods within the region, i.e., the imports of the protected goods outside the official distribution channels established by the rightholders. Consequently, they impede the establishment of the regional free movement of goods anticipated by the Open Balkan initiative. The aim of our paper is to shed light on this challenge facing the Open Balkan initiative and indicate a possible approach for addressing it.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"36 4","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139895546","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Although arbitration owes its existence to the agreement of the parties, the question that poses itself is if this agreement allows them to rely on illegally obtained and confidential evidence or is this the place where their autonomy will be limited. Having in mind that there are no strict rules that regulate this topic, in order for us to come to an answer, this article will firstly analyze arbitral decisions. Due attention will also be given to the general principles of the arbitral proceedings that tribunals rely upon. The goal of this article is to prove that these general principles are more than enough and that strict rules in this area of arbitration are not needed. Moreover, legal interest will be best served if we allow arbitrators to base their decisions on the said principles. Lastly, this article will prove that there should be a difference when dealing with illegally obtained and confidential evidence.","PeriodicalId":517180,"journal":{"name":"Harmonius Journal of Legal and Social Studies in South East Europe","volume":"24 3","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-02-07","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139895560","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
