Studies have been largely unsuccessful in explaining these disparities. This study uses administrative data from a random sample of individuals arrested for drug offenses in California to examine this issue. We use a decomposition model to estimate whether Black-White disparities in commitments to prison or diversions to drug treatment are attributable to differences in the characteristics of criminal cases and whether case characteristics are weighed differently by race. We also examine whether the influence of case characteristics changes after California implemented Proposition 36, which was a mandatory prison diversion program for eligible drug offenders. Our results suggest that Black-White differences in prison commitments are fully explained by criminal case characteristics, but that a significant portion of the differences in treatment diversions remain unexplained. The unexplained variation in drug treatment also does not change after Proposition 36. These findings suggest that case characteristics play a larger role in explaining prison commitments for drug offenders than the discretion of prosecutors and judges. By contrast, diversion to drug treatment appears to be driven more by the discretion of court officials and Black-White disparities remain prominent.</p>","PeriodicalId":515223,"journal":{"name":"The Journal of Legal Studies","volume":"43 1","pages":"155-187"},"PeriodicalIF":1.0,"publicationDate":"2014-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"https://sci-hub-pdf.com/10.1086/675728","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"32799817","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"OA","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

When abortion was legalized in a number of states in 1969 and 1970 (and nationally in 1973), this cost was reduced. We predict that abortion legalization generated incentives leading to an increase in sexual activity, accompanied by an increase in sexually transmitted diseases (STDs). Using Centers for Disease Control data on the incidence of gonorrhea and syphilis by state, we test the hypothesis that abortion legalization led to an increase in sexually transmitted diseases. We find that gonorrhea and syphilis incidences are significantly and positively correlated with abortion legalization. Further, we find a divergence in STD rates among early legalizing states and late legalizing states starting in 1970 and a subsequent convergence after the Roe v. Wade decision, indicating that the relation between STDs and abortion is casual. Abortion legalization accounts for about one-fourth of the average disease incidence.</p>","PeriodicalId":515223,"journal":{"name":"The Journal of Legal Studies","volume":"32 2","pages":"407-33"},"PeriodicalIF":1.0,"publicationDate":"2003-06-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"https://sci-hub-pdf.com/10.1086/377049","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"24766892","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Studies, including those by David Meltzer, support the premise that hospitalist care is less expensive and possibly of higher quality than inpatient care provided by primary physicians. Meltzer's survey of randomly selected individuals indicates that, although many would prefer that their own physician orchestrate their inpatient care, relatively few would pay more than $100 for this privilege. This indicates that patient dissatisfaction with the hospitalist model is unlikely to impede its widespread implementation. Hospitalists are just the latest example of the ongoing tension between generalism and specialization in American medicine. The hospitalist--unlike most traditional medical specialists--is actually a generalist by nature whose specialty is defined by the the site of the care rather than by organ, disease, patient population, or procedure.</p>","PeriodicalId":515223,"journal":{"name":"The Journal of Legal Studies","volume":"30 2","pages":"615-23"},"PeriodicalIF":1.0,"publicationDate":"2001-06-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"https://sci-hub-pdf.com/10.1086/339296","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"22307127","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

I comment on David Meltzer's controlled study of the costs and outcomes of hospitalist care, which showed increased cost savings and no change in patients' satisfaction with their care. Relative to full-time community practice, Meltzer's findings probably exaggerate the effect of hospitalists on costs. The physicians in charge of the control group of patients were full-time academic faculty, who typically spend 1 or 2 months per year doing inpatient care, in contrast to hospitalists, who spent most of their time caring for hospitalized patients. His findings probably minimize differences in satisfaction with care. Resident physicians did most of the bedside care for the hospitalist patients and the control group patients, an arrangement that would reduce any intrinsic differences.</p>","PeriodicalId":515223,"journal":{"name":"The Journal of Legal Studies","volume":"30 2","pages":"607-14"},"PeriodicalIF":1.0,"publicationDate":"2001-06-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"https://sci-hub-pdf.com/10.1086/324669","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"22307063","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
