The application of psychological behavioural analysis to law breaks the current paradigm and offers a unique perspective for lawmaking through the study of people's behaviour in the face of laws. Legal experimentation, an innovative practice, emerges as a crucial tool for law-making and regulatory impact assessment in novel areas whose subject matter may be potentially burdensome to individual rights and freedoms. In the context of the Spanish artificial intelligence sandbox, the application of psychology to law is of particular importance, as it contributes to the emerging and much-needed legal regulation. This cooperation between doctrines promises not only to boost normative evolution, but also to ensure a more effective and protective regulation in a world increasingly influenced by technology.","PeriodicalId":513331,"journal":{"name":"Revista Estudios Jurídicos. La proliferación de huelgas y protestas vino acompañada de múltiples formatos propagandísticos que alarmaron a las autoridades. En esta investigación se analiza la creación de nuevos órganos jurídicos puestos en marcha para combatir este fenómeno, como el Juzgado Especial Nacional de Propaganda Ilegal. Se exponen algunos ejemplos de sumarios incoados y las intersecciones que dicho juzgado tuvo con otros nacidos en la misma coyuntura. Nella prospettiva  di attuazione del regionalismo differenziato nell’ordinamento italiano, tali tematiche sollevano dubbi di rilievo soprattutto con riguardo alle garanzie di effettività della protezione dei diritti fondamentali sociali. {"title":"Algunas cuestiones sustantivas y procesales en el ámbito de la violencia de género en España","authors":"Silvia Pascual López","doi":"10.17561/rej.n24.8357","DOIUrl":"https://doi.org/10.17561/rej.n24.8357","url":null,"abstract":"El gran desafío del legislador en la Ley Orgánica 1/2004, de 28 de diciembre, de protección integral contra la violencia de género, ha sido sin duda, la creación de órganos judiciales especializados, los juzgados de violencia sobre la mujer. La determinación del ámbito de su competencia es uno de los principales temas de debate que propicia la aplicación práctica de esta Ley Orgánica. Los procedimientos más habituales en los juzgados de violencia sobre la mujer lo constituyen: juicio rápido (diligencias urgentes) y diligencias previas. Muy importante y necesaria la labor del médico forense, complementaria a la realizada por otros profesionales. Esta interrelación da como fruto la elaboración de un informe pericial de calidad adaptado a la solicitud realizada en el procedimiento penal correspondiente. La excepción o dispensa de declarar al pariente del procesado o al cónyuge tiene por finalidad resolver el conflicto que se le puede plantear al testigo entre el deber de decir la verdad y el vínculo de solidaridad y familiaridad que le une con el procesado. La competencia objetiva en el orden civil viene determinada por la concurrencia simultánea de tres presupuestos: uno de carácter material, un segundo de carácter personal y un tercero de carácter procedimental.","PeriodicalId":513331,"journal":{"name":"Revista Estudios Jurídicos.
