This principle of eternity can be manifested in the form of optimizing the performance of nazhir (endowment organiser) and the District Office of Religious Affairs (KUA) which functions as manager, supervisor and recorder of the orderly administration of endowment in Indonesia. Due to the wide and large distribution of endowment land throughout Indonesia, the government, in this case the Indonesian Ministry of Religion, appointed the role and function of KUA elements as executors and supervisors of endowment. The style and allocation of waqf in each sub-district is different. This article analyzes the role and authority of the KUA of Nanggung District, Bogor Regency in carrying out its functions. In particular, the allocation of endowment in Nanggung District is still limited to '3M' endowment, namely masjid-musala, madrasa, and burial ground. This research uses a empirical juridical approach which is descriptive analytical and explanatory. This research provides an overview and analysis of endowment organiser and supervision practices by nazhir and by the KUA institution by linking this implementation to applicable laws and regulations. The results of this research show that the role and function of the Nanggung District KUA has been implemented optimally. In addition to the rejection from the Balinese people, the Government of Bali also refused to continue the Bedugul PLTP geothermal project, where the refusal was stated in the juridical provisions of the Governor of Bali's Rejection Letter Number 660.1/1497/Bid.1/Bapedalda dated 17 October 2005 addressed to the Minister of Energy and Mineral Resources Mineral Resources and Bali Governor Regulation No. 45 of 2019 concerning Bali Clean Energy which emphasizes that PLTP construction cannot be carried out in the Bedugul sacred area and indirectly this has hampered geothermal permits in the Bedugul working area. The approach method used in this legal research is a normative juridical approach, research that is based on existing legal principles and also looks at the facts that occur. However, in several cases, judges did not consider Article 103 of the Narcotics Law to provide rehabilitation for addicts and victims of narcotics abuse. Based on the background above, the problems that will be discussed in this study are: how is the implementation of the rehabilitation process for addicts and victims of narcotics abuse in Indonesia? And how does restorative justice apply to narcotics addicts through the rehabilitation process? This research is normative legal research with descriptive nature. The research results show that the implementation of rehabilitation for addicts and victims of narcotics abuse in Indonesia can be seen from the data for 2021 and 2022. It shows that the punishment for most narcotics addicts is imprisonment. So that efforts are needed from law enforcement officials prioritising rehabilitation for narcotics addicts to enforce restorative justice law. {"title":"Mekanisme Insolvency Test Dalam Mencegah Iktikad Buruk Pemailitan Korporasi Oleh Kreditor","authors":"Andrian","doi":"10.31599/krtha.v17i2.2358","DOIUrl":"https://doi.org/10.31599/krtha.v17i2.2358","url":null,"abstract":"Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang memberikan alternatif hukum kepada kreditor maupun debitor untuk mengajukan permohonan kepailitan atau PKPU. Baik permohonan kepailitan maupun PKPU, debitor diberikan kesempatan untuk mengajukan proposal perdamaian kepada kreditor. Di dalam proses PKPU, ketika proposal perdamaian ditolak, maka debitor dinyatakan pailit. Konsekuensi yang terjadi ketika debitor dinyatakan pailit yang dimulai dari proses PKPU adalah debitor tidak memiliki upaya hukum yang dapat dilakukan, baik itu kasasi ataupu peninjauan kembali. Celah hukum tersebut menjadi permasalahan hukum yang seharusnya dapat diselesaikan dengan cara insolvency test sebagai kewenangan pengadilan untuk memeriksa kesehatan keuangan dan keberlangsungan usaha korporasi (going concern) untuk mencegah kesengajaan pemailitan oleh kreditor. Perihal konsep inosolvency test dan posibilitas penerapan gagasan ini perlu untuk dikaji lebih lanjut menurut hukum positif dan asas-asas kepailitan yang berlaku menurut UUKPKPU. Dalam melakukan kajian terhadap insolvency test tersebut, penulis akan menggunakan jenis penelitian yuridis normatif dengan pendekatan-pendekakatan analisis berupa pendekatan konseptual dan pendekatan perundang-undangan.
