{"title":"PERLINDUNGAN TERHADAP LESSEE USAHA DALAM PERJANJIAN SEWA GUNA SEBAGAI KONTRAK BAKU","authors":"Sudjana - Sudjana","doi":"10.34010/rnlj.v5i2.7858","DOIUrl":"https://doi.org/10.34010/rnlj.v5i2.7858","url":null,"abstract":"This study aims to determine the clarity of existence (leasing) in agreement and leasing law in the perspective of standard agreements.The method of approach is juridical normative and the data is analyzed in a qualitative normative way to produce descriptive data based on the study of statutory norms.The results of the study show that leasing in treaty law has 2 (two) financing categories, namely finance lease (lease with option rights) and operating lease (lease without option rights). In contract law, the operating lease has the aspect of a lease agreement while the finance lease is more in line with the aspect of buying and selling, but each of these aspects compared to the financing category still has a difference.  The cases of violence against animals in Indonesia are increasing, with a lack of education on animal welfare and insufficient law enforcement being the main factors. To enhance legal protection for animals, it is necessary to establish clear guidelines regarding acts of violence against animals and ensure strict law enforcement. Violence against animals can manifest in physical, psychological, and sexual forms. Indonesian laws, such as the Animal Husbandry and Health Act, prohibit and impose sanctions on individuals involved in animal violence.To maintain balance and justice in ecosystems, it is crucial to raise public awareness, foster active participation, and enforce stringent laws against animal abusers. The Animal Protection Act in Indonesia, along with its implementing regulations, aims to safeguard the lives and welfare of animals and provide them with appropriate rights. Several regulations related to animal protection in Indonesia include the Animal Husbandry and Health Act, the Mineral and Coal Mining Act, the Government Regulation on Wildlife Conservation, and the Minister of Environment and Forestry Regulation on Protected Wildlife. Local regulations can also be established to address animal protection at the regional level. Furthermore, detailed regulations pertaining to animal protection and law enforcement concerning animal cruelty violations are necessary.
 
 ABSTRAK
 Kasus kekerasan terhadap hewan di Indonesia semakin meningkat, dengan kurangnya edukasi mengenai kesejahteraan hewan dan penegakan hukum yang belum maksimal menjadi faktor utama. Untuk meningkatkan perlindungan hukum terhadap hewan, diperlukan kepastian mengenai tindakan kekerasan terhadap hewan dan penegakan hukum yang tegas. Kekerasan terhadap hewan dapat terjadi dalam bentuk fisik, psikologis, dan seksual. Undang-undang di Indonesia, seperti Undang-Undang Peternakan dan Kesehatan Hewan, melarang dan memberikan sanksi bagi pelaku kekerasan terhadap hewan. Namun, masih diperlukan peraturan yang khusus mengatur kekerasan seksual terhadap hewan. Untuk menjaga keseimbangan dan keadilan dalam ekosistem, diperlukan kesadaran masyarakat yang tinggi, partisipasi aktif, dan penegakan hukum yang tegas. Undang-Undang Perlindungan Hewan di Indonesia, bersama dengan peraturan pelaksanaannya, bertujuan melindungi kehidupan dan kesejahteraan hewan serta memberikan hak yang layak kepada mereka. Beberapa peraturan yang terkait perlindungan hewan di Indonesia meliputi Undang-Undang Peternakan dan Kesehatan Hewan, Undang-Undang Pertambangan Mineral dan Batubara, Peraturan Pemerintah tentang Konservasi Jenis Satwa, dan Peraturan Menteri Lingkungan Hidup dan Kehutanan tentang Satwa Dilindungi. Peraturan daerah juga dapat memiliki peraturan tentang perlindungan hewan di tingkat lokal. Selain itu, perlu adanya peraturan yang lebih rinci tentang perlindungan hewan dan penegakan hukum terkait pelanggaran terhadap hewan.
