It has also had an impact on the patentability of computer-implemented inventions in Europe more generally, which has become more restrictive as existing case law has not been confirmed. Moreover, G 1/19 has started a process in which previously well-defined legal terms are becoming increasingly blurred. The author identifies the problems associated with this development and points to early case law, such as T 208/84 and the German Federal Supreme Court’s (BGH) Logikverifikation, which the Enlarged Board of Appeal could easily have followed but chose not to. Finally, the author presents his own ‘Three Motives Model’ as a possible solution and compares it with a previous, similar model based on a ‘Virtual Analog Rule’ for patent eligibility suggested by Joseph. S. Bird in the US in 2015.","PeriodicalId":487734,"journal":{"name":"GRUR international","volume":"47 7","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-07-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"141819450","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This incident caused widespread concern and controversy, and has raised questions about the fairness and transparency of the pharmaceutical industry. From the perspective of antitrust enforcement, the administrative penalty decision has significant value for discussion in several aspects, including the identification of the subjects engaged in joint abuse of market dominance, the delineation of the relevant market, the determination of excessive prices, the imposition of penalties, and subsequent corrective measures. Furthermore, the coordination and cooperation between the competition authorities and the health security authorities in this case also merit discussion. This opinion provides an overview of the grounds of the decision and a detailed analysis in the context of China’s anti-monopoly regulations and guidelines for the pharmaceutical sector.","PeriodicalId":487734,"journal":{"name":"GRUR international","volume":"109 19","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-07-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"141820314","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

These guidelines aim to clarify the scope and details of Art. 5(3), specifically what ‘the storing of information, or to gain access to information stored in the terminal equipment of a subscriber or user’ means on a technical level. This opinion describes the circumstances under which such information may be stored or accessed.\u0000 In this contribution I pose the hypothesis that the broadening of the published guidelines is at least in part necessary to prevent the ePD from becoming irrelevant, if only non-covered techniques are to be used. In this opinion, I will first discuss the background of the ePD, provide context for the guidelines and their structure, and then follow and comment on the respective parts of the analysed phrase alongside the analysis of the EDPB. In the end, I will conclude and check if all the latest developments are likely to be caught by the new interpretation according to the technical guidelines, and what this could mean for legal practice.","PeriodicalId":487734,"journal":{"name":"GRUR international","volume":"111 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-07-19","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"141821126","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This might result in a weaker protection of fundamental rights, such as health, in those countries that do not possess the necessary know-how and industrial capacity to manufacture essential medicines. The recent Decision adopted at the 12th WTO Ministerial Conference provides the opportunity to focus again on the topic and deal with the issue of the clash between IP and the national interests of the least developed countries. Instead of addressing the problem by looking at the well-known flexibilities/inflexibilities of the Agreement, this paper proposes a different methodological approach that builds on the flourishing literature on regulatory governance. To this end, a multi-dimensional regulatory approach is suggested that simultaneously exploits a matrix of normative, market-based and cooperative instruments. While we wait for a more structural normative reform, a similar perspective not only proves to be useful from a theoretical perspective, but could also contribute to shedding a new light on the TRIPS Agreement.","PeriodicalId":487734,"journal":{"name":"GRUR international","volume":" 982","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-07-19","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"141823190","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
{"title":"The European Research and Bolar Exemptions ‒ Background, Status Quo and a Look at the Agreement on a Unified Patent Court (UPCA) and the EU Commission’s New Draft Directive for the Reform of Pharmaceutical Legislation","authors":"Marco Stief","doi":"10.1093/grurint/ikae094","DOIUrl":"https://doi.org/10.1093/grurint/ikae094","url":null,"abstract":"\u0000 A patent is a form of state monopoly granted to the owner of an invention. A patent rewards its owner with exclusive rights in exchange for innovation (‘quid pro quo’) for a limited period of time. These exclusive rights allow the patent holder to prohibit others from using the patented invention, helping to recover their research and development (R&D) costs and thereby create an incentive for further innovation. However, patents can hinder technical progress if no restrictions are imposed. Therefore, exceptions and restrictions exist to balance patent protection with the right to freedom of research under Art. 13 of the EU Charter. The most important exceptions are the so-called Bolar and research exemptions. The Bolar exemption allows generics manufacturers to seek authorization or approval under pharmaceutical law before a patent expires, enabling market entry immediately after patent expiration. The research exemption permits the use of patented inventions for research purposes. These two exceptions are increasingly important due to a shift in patent law favoring patent holders through simplified procedures and expanded rights. This article briefly outlines the history and application requirements of these two exemptions and the limits and restrictions to be observed. It also discusses the national differences in application of the Bolar and research exemptions within Europe and the new Art. 27 UPCA introduced in June 2023. Finally, the proposed amendments published in April 2023 as part of the new European pharmaceutical package will be discussed.","PeriodicalId":487734,"journal":{"name":"GRUR international","volume":" September","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-07-19","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"141823715","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
