This research seeks to reveal the role of Santri in shaping the social dynamics of society, as well as to understand their intellectual contributions to social change in Indonesia from pre-independence to the present day. The research method involves the analysis of historical documents and literature studies to compile a comprehensive narrative of the social and intellectual journey of santri. In this context, the role of the santri, the madrasah, and the pesantren as traditional centers of education that play a vital role in the spread of Islam and the formation of the santri character is analyzed. Around the end of June 2022, there was a phenomenon of the acceptance of interfaith marriages by the Surabaya District Court. It suddenly made the clergy furious. Institutions like the MUI even asked the related court to cancel the decision. Apart from that, this paper wants to look at the problem of registering interfaith marriages from the perspective of Maqashid Al-Shari'ah. After conducting a study through the lens of Maqashid Al-shari'ah, the registration of interfaith marriages in the end, according to the author's conclusion, is maslahat juziyat hajiyat, which has been upgraded to maslahat juziyat daruriyat. Therefore, registering interfaith marriages is an important matter that the State must regulate and legalize.","PeriodicalId":484340,"journal":{"name":"Journal of Islamic Studies and Civilization","volume":"2 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-25","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135168885","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Nonetheless, it still presents various problems regarding the type of administration to benefit mustahik zakat, like the concept of Maqosid Asy-Shari'ah Ibnu 'Asyur. The goal of this research is to describe, from the perspective of Maqosid Asy-Shari'ah Ibnu 'Asyur, the concept of productive zakat and how to enhance the community's economy by redirecting productive zakat from a consumptive society to a productive society.This study uses library research that employs the descriptive analysis method, which entails gathering data, compiling or clarifying, and compiling and interpreting it in order to clearly describe the object under study naturally, both from the structure of the sentence, the structure of discourse, and the structure of the semantic. According to the findings of this study, Productive Zakat incorporates Maqid al-shari'ah through three elements: first, by using Al-Maqm. The second is Al-Tamyz Baiyna Al-Waslah Wa Al-Maqud, and the third is Istiqra (induction).","PeriodicalId":484340,"journal":{"name":"Journal of Islamic Studies and Civilization","volume":"50 5","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-25","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135168892","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Additionally, how effective is the legal defense against e-money transactions? This study uses a normative or doctrinal research method by comparing the Law and the enlightening validity of reading books, texts, journals, print media, and other related information. This study demonstrates that the validity of electronic money transactions has done a lot, whereas the transaction encloses safeness, convenience, and time efficiency. This article uses a normative juridical method and qualitative analysis. Moreover the study was carried out on the legality of the status of heirs for non-Muslim children born by a fornication out of wedlock, which is viewed under in the perspective of the law in force in the Indonesia law prepective compared with the Maqasid Syariah fil-usrah view of Jamaluddin Athiyya. Regarding the legality of the status of heirs, there are several opinions in the Civil Code providing opportunities for heirsWhile it is clear in the Islamic law, especially the Islamic law of inheritance (Fiqh Mawaris), states that the children born as a result of fornication to be eligible as heirs. The contrast between the two legal systems is fused with the Supreme Court Jurisprudence No. 51.K/AG/1999 and the MUI Fatwa No. 11 of 2012 which states that non-Muslim children as a result of a fornication are not entitled as heirs, but they are eligible to obtain the inheritancethrough a mandatory will (Wasiat Wajibah). Thus, there are still pros and cons on the legal impact of Jurisprudence and Fatwa which are not fully binding. Moreover, Jamaluddin Athiyyah's view of the Maqasid Syariah in terms of the family issueagaints the Supreme Court Decision No. 51.K/AG/1999, No. 368 K/AG/1995, the Constitutional Court Decision No. 46/PUU-VIII/2010 and the MUI Fatwa No. 11 of 2012, concludes although the non-Muslim children born as a result of fornication are not eligible as the heirs. However, the providing a mandatory will has considerably been benefited the child welfare and the family are considered implementing the Islamic law.","PeriodicalId":484340,"journal":{"name":"Journal of Islamic Studies and Civilization","volume":"4 2","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-25","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135169245","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

NU is the largest Islamic organization in Indonesia, and because Indonesia is so large, the largest in the world. It has been long committed to Indonesia as a non-shariah state as well as multi-religious and multi-ethnic nation. Nahdlatul Ulama’s young men’s organization Ansor, seeks to train non-radical Muslim leaders with a range of expertise and foci. Ansor has a sub-organization called Banser which regularly guards Christian churches, liberal Muslims, and businesses from being targeted by extremists like the Islamic Defenders Front. If the present, or even recent, history of Banser and Ansor is that of protecting religious minorities and pluralism, this has not always been the case. Ansor/Banser was an important auxiliary force in the Revolution (1945-1949) and in the 1965-1966 national bloodletting that left 500,000 alleged communists dead. It is even more telling and interesting if we explore the ways in which the newer socially progressive actions are based on conservative, traditional understandings of Islam and not liberal or progressive religious understandings.","PeriodicalId":484340,"journal":{"name":"Journal of Islamic Studies and Civilization","volume":"4 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-25","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135168258","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
