Both EU law and national rules require a causal link to be established between a harmful event and the resultant harm. The content of this causal link is mostly a matter for national rules. The ECJ case law on the nature of said causal link therefore remains underdeveloped, even though the issue of causality is highly relevant as it concerns every private enforcement case. This article explores the implications of the EU competition law notion of “single infringement” for private enforcement in general and for the understanding of the concepts of “harmful event” and “causal link” in particular. EU-level case law is analysed to determine how the finding of a single infringement could impact private enforcement. While the general right of access to documents has been extensively analysed, document registers and especially their practice are still under-examined. This article specifically focuses on the registers of the Parliament, the Council and the Commission, highlighting two striking gaps. The first gap exists between the strict rules of the Access Regulation and the softer rules of the institutions, the second between what is provided on the abstract level by these rules and the practical level. As shown by an empirical study of the user-friendliness, completeness and proactivity of the registers, their current design and limited content severely limit people’s right of access. In light of these shortcomings, this article recommends different practical approaches to increase the effectiveness of document registers. An effects-based approach is presented and a three-step methodology is proposed to identify whether a certain practice should be conceptualized as circumventing an obligation. This approach is applied to several practices suspected of circumventing the ban on parity clauses and an analysis is carried out to establish how the results fit into the Digital Market Act’s concept and instruments for avoiding circumvention.
