Indonesia as a country that adopts a presidential \u0000government certainly has a pattern of distribution of power, although theoretically the \u0000presidential government system power state agency separate (separation of power), but \u0000the relationship between institutions is not a relative. The mechanism of checks and \u0000balances of power destribusi state institutions. Before the amendment, the agency is the \u0000State Supreme People's Representative Council (DPR), the President, the Supreme Audit \u0000Agency CPC, the Supreme Advisory Council (DPA) and the Supreme Court with the \u0000vertical power distribution. Following the amendment to the state institutions teridir of the \u0000President, the People's Consultative Assembly (MPR), House of Representatives (DPR), \u0000the Regional Representatives Council (DPD), the Supreme Audit Agency (BPK), the \u0000Supreme Court (MA), and the Constitutional Court (MK) with distribution horizontal \u0000power - functional. The position and the authority of consultative agency started to change significantly after the amandements of 1945’s constitution. Even some opined that people’s consultative assembly is no longer required. There are several important issues that will be discuss as the main topic in this paper. First, development planning vs broad outlines of the nations direction (GBHN). Second, the authority of people’s consultative assembly to set the regulating provisions. Third, the authority of people’s consultative assembly to provide a constitutional interpretation. Fourth, this assembly reviewed it’s own provisions. Fifth, this assembly issued a decree inaugurating of president and vice president. The regulation includes the definition and standard for fishing gear and its types, and it is the implementing rules of Law Number 45 of 2009 on fishery. The purpose of this study is to examine the efficacy of the Regulation of the Ministry of Marine Affairs and Fisheries of the Republic of Indonesia Number 2 of 2015 on the Prohibition of using trawl and seine nets to catch fish. This study also aims to discover the strengths and weaknesses of the regulation. This is a juridicial empiricial research with juridicial empiricial approach. Based on the research, it is found that the regulation is deemed effective by the society, especially for fishermen. The regulation is effective in mitigating the damage of marine resources on the seabed.
