Hein","doi":"10.1163/15718190-08634P06","DOIUrl":"https://doi.org/10.1163/15718190-08634P06","url":null,"abstract":"This article examines the origins, differentiation, and migration of constitutional entrenchment clauses from the beginning of modern constitutionalism until today. It is based on a broad understanding of ‘entrenchment clauses,’ covering all constitutional provisions that make amendments either to certain parts of a constitution or under certain circumstances more difficult to achieve than ‘normal’ amendments or even impossible, i.e., legally inadmissible. In particular, the article answers three questions: (1) When, and in which contexts, did the different types of constitutional entrenchment clauses emerge? (2) How have these types spread globally? (3) Which constitutional subjects do such clauses protect, and thus, which main functions do they aim to fulfill? In order to understand how the ECHR gradually managed to gain authority in diverse national settings, it is necessary to complement transnational historical perspectives with studies of national reception histories. The present article approaches the history of the ECHR in Belgium by focusing on the history of the Belgian cases in Strasbourg, which have played an important role in contributing to the ‘discovery’ of the ECHR in the Belgian legal system. On the basis of interviews with actors involved in the early cases against Belgium, it was possible to determine their position in the Belgian legal landscape as well as their motivations and aspirations in going to Strasbourg. A première vue il peut paraître étrange que nous ne préparions pas aujourd’hui le tome 101 mais seulement le 86e. Ce fait s’explique – du moins partiellement – par l’histoire politique du 20e siècle. Avant la Guerre, la Revue ne parut pas régulièrement chaque année. Le premier tome couvre les années 1918-1919, le deuxième 1920-1921 et les tomes des années 1926, 1931, 1935, 1938 et 1940 manquent. Durant l’occupation allemande la Revue fut publiée uniquement en 1941 et trois fascicules seulement parurent. Le quatrième fascicule avait bien été imprimé durant la Guerre, mais il ne fut adressé aux abonnés qu’après la Libération. Au cours des années de difficile reconstruction suivant 1945 il n’était pas possible d’assurer une parution immédiate de la Revue: la publication ne fut reprise qu’en 1950. Depuis lors la Revue n’est plus une entreprise purement néerlandaise, mais le fruit d’une collaboration entre les historiens du droit belges et néerlandais. Du côté belge il faut louer ici les efforts de Louis Maes. Depuis 1950 la Revue est parue avec une régularité quasi parfaite. Je reviendrai sur la coopération belgo-néerlandaise un peu plus tard. Ce qui suit maintenant n’est qu’un complément à l’historiographie de notre Revue. En effet, notre regretté collègue Robert Feenstra qui fut membre de la rédaction pendant 63 ans, pratiquement jusqu’aux derniers jours de sa vie (1950-2013), a esquissé l’histoire de la Revue dans trois articles dont deux sont parus dans la Revue même1. Ce qui suit n’est donc qu’un supplément qui montre que les historiens posent à chaque époque des questions différentes. Malheureusement les archives de la Revue d’avant-guerre, qui étaient conservées chez l’éditeur Tjeenk Willink, ont été perdues. Afonso V, [‘Revised Laws of King Afonso V’], accomplished by Doctor Rui Fernandes in the town of Arruda on 28 July 1446.
