However, more recent research shows that metaphor expresses a closer association between the two terms of comparison than like-simile. This paper proposes a variety of criteria to understand the similarities and differences between these two figures of speech, among them the abstractness of the resemblance relationship, the greater subjectivity of metaphor, and the role of comparison in contrast to other factors. Предлагается законодательное закрепление обязанности конфидентов сохранять в тайне сведения, ставшие им известными в связи с оказанием содействия органам, осуществляющим оперативно-розыскную деятельность, под угрозой ответственности за разглашение сведений, составляющих государственную тайну.\u0000 The article discusses the historical development of the legal regulation of the regulation of confidants by departments of internal affairs bodies, ensuring operational-search activities. The authors of the investigation discover a legal analysis of obligations to a person who shows confidential participation, according to the previously existing and chosen domestic legislation. Обращено внимание на то, что расследование преступной деятельности нередко связано с вмешательством в личную жизнь человека. Приводятся примеры, когда полученные в рамках досудебного производства конфиденциальные данные не сохраняются в тайне от третьих лиц, что причиняет вред отдельным участникам уголовного процесса. Делается вывод о том, что сложившееся положение обусловлено недостатками законодательства. Межотраслевое регулирование этих вопросов нельзя признать оптимальным. Анализ соответствующих норм права, сложившихся общественных отношений позволил определить пути решения поставленной проблемы. Автор формулирует конкретные предложения, направленные на оптимизацию положений УПК РФ.\u0000 The paper investigates the problem associated with the protection of information about the private life of a person in the process of proving in criminal cases. Attention is drawn to the fact that the investigation of criminal activity is often associated with interference in a person's personal life. Examples are given when the received confidential data in the framework of pre-trial proceedings are not kept secret from third parties. This causes harm to individual participants in the criminal process. It is concluded that the current situation is due to shortcomings of the legislation. Intersectoral regulation of these issues cannot be considered optimal. An analysis of the relevant norms of law, existing social relations, made it possible to determine ways to solve the problem. The author analyzed the legislation of the Russian Federation, which regulates the institute of state protection, the points of view of various authors on the subject under consideration. The most significant problems and issues that arise during the implementation of this institution in criminal proceedings are highlighted. The author noted that despite such a detailed regulation of the institution of state protection in law enforcement practice, there are a number of problems and difficulties associated with its implementation, some of which are analyzed in the study.
