Irregular migrants’ difficulty to be mobile often lead them to maintain complicated transnational relationships with their family members in different places, which are exemplary of the overlooked political, economic and social consequences of irregular movements and stays. The chapter reviews the literature in family and migration studies to show how restrictive migration policies are increasingly shaping irregular migrants’ practices of doing family. There is evidence to suggest that this often leads to transformations in gendered roles in the household. At the same time, the chapter also demonstrates how family relationships can successfully support individuals’ migratory aspirations and trajectories despite restrictive policies. By focusing on these migrants’ family relationships, the chapter makes them visible as parents, grandparents or children with particular needs which are otherwise often neglected in discussions around irregular migration.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"106-117"},"PeriodicalIF":0.0,"publicationDate":"2023-03-30","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147916888","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The UNGPs, endorsed by the United Nations Human Rights Council in 2011, are the first universally accepted framework for addressing business responsibilities for human rights. They outline State obligations to protect human rights, businesses’ responsibility to respect human rights, and the importance of both States and businesses offering adequate remedies for human rights breaches.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"200-207"},"PeriodicalIF":0.0,"publicationDate":"2023-03-17","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147920227","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It studies narratives of the construed Terrorist Other to argue that the false assumptions that dominated post-9/11 discourse continue to cause unjustified deprivations of foundational human rights for noncitizens, with a disparate impact on marginalized groups and with a significant impact in the realm of migration. As much of that discourse has been normalized in the course of time, faulty political imaginations and scenarios serve as a shaky foundation for the development of legal provisions, which, in turn, provide their own shaky foundation for the further development of political discourses. The chapter accounts for the discourse of the Terrorist Other across several thematic domains such as the Guantanamo Bay detentions, Donald Trump’s infamous ‘Muslim ban’, and the case of Mohamed Harkat, long detained in Canada under an immigration security certificate.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"345-359"},"PeriodicalIF":0.0,"publicationDate":"2023-02-21","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147881355","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In 2014, the UN Human Rights Council was called to vote on a resolution presented by Ecuador, to establish an intergovernmental working group on transnational corporations and other business enterprises with respect to human rights (IGWG). The vote was narrowly passed, with many developing States (several of which from Latin America) abstaining. The adoption of this resolution was perceived as an attempt to diminish the UN Guiding Principles on Business and Human Rights, endorsed by the Council barely three years earlier, in 2011. However, different stakeholders perceived this as a natural evolution of an inherently complex dynamic. As the debate has moved forward, the diplomatic confrontation between different States has been a trademark of the treaty process, where many States in the Global North have vehemently opposed the project, and where many in the Global South are divided. Despite this ideological chasm, the negotiation has moved forward to a third revised draft. There is now a relatively clear basis - and growing consensus - on the issues that need to be tackled to develop a useful instrument that may help advance the protection and respect of human rights in the context of transnational business activities.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"247-260"},"PeriodicalIF":0.0,"publicationDate":"2022-12-08","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147889086","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
