Six new cases were begun in 2018 and two in 2019 dealing with matters such as appealing decisions of international bodies and alleged breaches of international treaties and conventions. Alfred Yekatom and Ngaïssona, the commencement of trial in the case against Mr. Al Hassan, and the Pre-trial Chamber’s authorisation that an investigation be launched for the alleged crimes committed against the Rohingya in the Situation in Bangladesh/Myanmar. Two landmark acquittals were pronounced in early 2019 in the case against both Mr. Laurent Gbagbo and Mr. Charles Blé Goudé, culminating from no case to answer proceedings launched by the defence the previous year, and litigation went underway in the context of Mr. Jean-Pierre Bemba’s compensation claim following his acquittal by the Appeals Chamber, raising novel issues relating to the interpretation of Article 85 of the Rome Statute. The Court stirred controversy in unanimously rejecting the Prosecutor’s request to proceed with an investigation into alleged crimes against humanity and war crimes committed on the territory of Afghanistan, extending among others to the conduct of US troops, in the context of renewed pressures from the United States imposing sanctions against ICC staff. Further controversy arose from the Appeals Chamber’s confirmation of the Pre-Trial Chamber’s order in the Comoros case, whereby the Prosecutor was yet again ordered to review its decision to not investigate the situation. Therefore, the chapter is devoted to the implementation and the evolution of a procedural right of standing in the context of international adjudication to protect community of interests in environmental matters. The locus standi of states in relation to the protection of the environment before international courts and tribunals, such as the International Court of Justice and the International Tribunal for the Law of the Sea, and human rights courts, such as the European Court of Human Rights and the Inter-American Court of Human Rights, will be investigated. US nuclear policies both reflect and fuel the fraying regimes, provoking countermeasures by adversaries, sowing doubts in allies, and stiffening support among the non-nuclear states for the Ban Treaty. It argues that the legal orders that framed early constitutional states reflected a limited understanding of war, in which warfare was perceived, in narrow legal terms, as a simple sovereign function. This concept of war obscured the actual conjunctures of military violence at this time, and it often triggered patterns of irregular military mobilization, in which classical forms of sovereign statehood were unsettled. This chapter then considers how, after 1945, many states began to organize their sovereignty more effectively. They did so by directing their constitutional systems towards a revised concept of warfare, acquiring features of an occupation constitution.
