Parker","doi":"10.3233/IJR-120039","DOIUrl":"https://doi.org/10.3233/IJR-120039","url":null,"abstract":"After the 10 regional water authorities of England and Wales were privatized in November 1989, the successor WASCs (water and sewerage companies) faced a new regulatory regime that was designed to promote productivity growth while simultaneously improving drinking water and environmental quality. As legally mandated quality improvements necessitated a costly capital investment programme, the industry's economic regulator – the Office of Water Services – implemented a RPI + K pricing system, designed to compensate the WASCs for their capital investment programme while also encouraging faster rates of productivity growth. This paper considers the relative effects of privatization and regulation on productivity growth in the industry using both non-parametric and parametric methods to provide a crosscheck on the robustness of the results. While there is evidence that labour productivity improved after privatization, there is no evidence that privatization led to a growth in TFP (total factor productivity). However, there is some evidence of a small increase in the rate of TFP growth in the aftermath of a substantial tightening of the regulatory regime that took place in 1995. There is some evidence that government agencies in Malaysia do carry out some assessment of the impact of regulations, but such practices appear to vary significantly across different ministries, state agencies, and local governments. Furthermore, there appears to be no centralized and concerted effort by any federal agency to adopt international best practices in regulatory governance. This is likely to have adversely impacted the quality and quantity of regulations in Malaysia. The government does recognize the need to improve the quality of regulations in the country. Recent policy reforms have been aimed at strengthening the institutional capacity and implementation capacity of regulation in the country. However, based on findings from the survey, such initiatives are likely to be implemented in a decentralized and possibly, in an ad-hoc manner. This paper makes use of this definition and considers ‘good enough’ governance as being a set of minimum requirements necessary for the proper (democratic) functioning of a state. In addition, it narrows the context where ‘governance’ applies, and solely refers to the organization and functioning of the public administration system. To this end, Robert Dahl's theory of democratization will provide the appropriate framework for ‘quantifying’ ‘good enough’ governance, and will then be applied to the Romanian public administration reforms (1998–2007). But, it has been pointed out that regulatory capture could undermine the stated aims of reforms. This paper compares the two main types of economic regulation: regulations based on costs, and based on incentives. While literature usually considers incentive-based regulation to be more prone to capture because of the higher stakes involved, we qualify this view based on findings of the economics of corruption, which opens the black box of processes through which capture occurs. Ultimately, both present specific risks of capture as well as common problems, which are not the least due to similarity of both types in day-to-day regulatory praxis. TV sets consuming 1-W power are widely available in the developed nations. In a developing country like Malaysia, however, the penetration of 1-W stand-by power TV is very low and unless a mandatory label programme is introduced, the degree of penetration is not likely to rise. This paper attempts to calculate the emission pollutants reduction and the energy savings by implementing the 1-W stand-by power label for TV sets in Malaysia. It is estimated that this effort will enable CO2 (carbon dioxide) emissions reduction of 1477.7 kT (kilo tonnes), NOx (oxides of nitrogen) reduction of 4673.0 tonnes, and CO (carbon monoxide) reduction of 763.7 tonnes in the country during the energy label period of 20 years. Various studies, audit findings of the Comptroller and Auditor General of India, and vigilance reports by India's Central Vigilance Commission have invariably highlighted the incidence of anti-competitive practices in Indian public procurements. Public sector procurements are highly regulated, given the transparency concerns and principal–agent problem.These regulations outlining the rules and procedures in public procurement directly or indirectly influence the short- and long-run market dynamics (with respect to entry, market concentration, prices, innovation, etc.). This paper aims to analyse the impact of existing regulation on competition in public procurement in India through a case study of procurements in the Indian Railways.
