Implementation of a good organizational culture will definitely be directly proportional to sharia compliance. Two years after the merger, Bank Sharia Indonesia has shown a positive trend towards the company's performance. The problem of this research can be formulated as follows: how is the strategy of Bank Sharia Indonesia in harmonizing organizational culture clashes during mergers, how is the implementation of sharia values (sharia compliance), and how is the review of maqâsid al-syarî'ah in both of these? This study aims to determine the strategy of Bank Sharia Indonesia in harmonizing organizational culture clashes that arise during a merger and how it is implemented in adherence to sharia values. The method used in this research is descriptive-qualitative with a case study approach. The results of this study found BSI strategies for harmonizing organizational culture. First, the BSI founder created the \"AKHLAK\" work culture, called trustworthy, competent, harmonious, loyal, adaptive, and collaborative, which was applied to all BSI personnel. Therefore, this research will reveal the veil of understanding by focusing on the anthropological view of the implementation of musyarakah contracts, both in terms of the application of the contract and sharia principles, as well as the problems that often occur in musyarakah contracts in the operations of sharia financial institutions. This research is a type of normative-empirical research, which is an anthropological approach. The data used are primary and secondary data which are then analyzed using argumentative analysis techniques. The results and conclusions of this research are that musyarakah exists as a method for practicing and implementing Islamic religious values, where this also includes the concept of hifdz mall (maintenance of assets) which is essentially part of the objectives of sharia itself. Although problems often occur in the musyarakah contracts carried out intentionally by the parties or unpredictable force majeure, these musyarakah contracts can be maximized again by using good and correct solutions by Sharia financial institutions. With the concept of the musyarakah contract, Sharia financial institutions have a mission to fight ignorance, poverty, tyranny, evil, and injustice in economic activities to achieve al-falah (prosperity in this world and the hereafter).","PeriodicalId":402140,"journal":{"name":"Jurnal Justisia Ekonomika: Magister Hukum Ekonomi Syariah","volume":"300 ","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-12-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139170665","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

One sector that takes advantage of technological sophistication is financial services. P2P lending refers to the provision of financial services that bring together lenders and loan receivers in the context of engaging into loa and borrowing agreements cia an electronic system that uses the internet network. The ease of the P2P Lending service offered by this online loan is very tempting for users. However, many Muslim people are still unwilling to do so. This study purposes to establish the principle of benefits and online loan agreements from an Islamic economic perspective. This research type is descriptive qualitative research using a systematic literature review. The research data is from 6 journals related to online lending from the perspective of Islamic economics published in 2020-2022. The study results show that online lending, or P2P lending, is a form of financial service utilizing technological sophistication. Online loans are permissible according to Sharia, but with various conditions that do not violate Sharia rules by MUI Fatwa No.117/DSN-MUI/II/2018. The principle of the benefits of giving loans in Islam is permissible to people who need debt to fulfill their needs based on mutual help in good matters. According to the Islamic economy, online loan transactions are classified as accounts payable (Qarḍh). In Islam, qardh is valid if the parties fulfill the conditions and pillars. If one of the conditions and pillars is not fulfilled, the qardh contract becomes invalid. Thus, the debts are considered to have occurred if the pillars and conditions of the debts themselves have been fulfilled.","PeriodicalId":402140,"journal":{"name":"Jurnal Justisia Ekonomika: Magister Hukum Ekonomi Syariah","volume":"44 ","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-12-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139169750","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
