{"title":"Defining International Terrorism to Protect Human Rights in the Context of Counter-terrorism","authors":"Stella Margariti","doi":"10.1163/18750230-02901004","DOIUrl":"https://doi.org/10.1163/18750230-02901004","url":null,"abstract":"The main argument of this article is that defining international terrorism will further the protection of human rights in the context of counter-terrorism. For this purpose, it will be shown that the transnational legal system under which counter-terrorism operates is fraught with problems regarding human rights protection. Secondly, it will be shown how domestic counter-terrorism legislation can become a breeding ground for serious human rights violations, when based on too broad or otherwise problematic definitions of terrorism. The analysis zooms in on, in particular, the often-overlooked component of the 2018 Law that requires the investigation of historical crimes of ‘Ukrainian nationalists’, as well as the wider context of ‘memory wars’ through memory laws in Central and Eastern Europe. It will compare and analyze the leading instruments in this field, namely the Arms Trade Treaty and the Council of Europe Common Position 2008/944/CFSP. This article describes ways in which the conflict continues to impact the lives of civilians and describes the humanitarian-security nexus in the Ukrainian conflict.
