Our findings are consistent with the glass cliff theory of corporate appointments. Specifically we find that the appointment of Black leaders has a significantly negative impact on share price in comparison to the appointment of White leaders to comparable positions for the 10-day period following the announcement. We also find that markets assess Black leaders appointed from outside the firm more positively than Black leaders promoted from within. Given these findings, corporate decision makers committed to promoting leadership diversity should focus on formalizing internal promotional processes and adopting preferential recruitment practices for outside candidates. * Both authors contributed equally to this article. I apply Polanyi’s (1944, 1957) classic concepts of embeddedness and the double movement to understand the conflict that arises within a coherently motivated social movement. Using interview and participant observation data along with content analysis of FT organization mission statements, this research examines the role of conflict within the FT movement over how best to improve the well-being of producers in the global South. I discuss the different, conflicting ways in which FT participants think about improving labor conditions in the global South and the inherent conflict in using market mechanisms to counter market forces. I conclude that while participants share the values of human rights, equality, and environmentalism, realizing these goals through concrete market activities reveals the tension between the benefits of liberalizing and the benefits of regulating the production and sale of FT goods that may impede the continued growth of the movement. *This research was supported by the Center for Organization Research (COR) at the University of California, Irvine. Gender Bias in the Negotiation of Severance Pay in Lieu of "Reasonable Notice"

{"title":"Gender Bias in the Negotiation of Severance Pay in Lieu of \"Reasonable Notice\"","authors":"K. Thornicroft","doi":"10.2190/WR.16.2.B","DOIUrl":"https://doi.org/10.2190/WR.16.2.B","url":null,"abstract":"Canadian employees working under indefinite-term employment contracts are presumptively entitled to “reasonable notice” of dismissal. Employees dismissed without just cause or reasonable notice can sue for “severance pay in lieu of reasonable notice.” The damages payable (which can range up to 24 months’ wages) reflect the compensation the employee would have earned during the reasonable notice period. Although there is no statutory or common law formula for determining reasonable notice, various factors, such as the employee’s position, tenure, and age, and extant labour market conditions, are relevant considerations. The present study addresses the issue of whether women face gender-based discrimination (or gain any advantage) in the determination of their reasonable notice entitlement. This study examines the impact of gender on negotiated outcomes in wrongful dismissal claims, and the results indicate that women suffer a marked disadvantage in negotiated severance pay settlements. THE CANADIAN “REASONABLE NOTICE” DOCTRINE Canadian employers do not have the legal right to summarily dismiss indefiniteterm employees (i.e., employees for whom there is no predetermined termination point) unless they have just cause to do so. In other words, unlike the situation in the United States, there is no general “employment at will” doctrine (see Di Matteo, Bird, & Colquitz, 2011, for a recent review and critique of this doctrine).","PeriodicalId":382067,"journal":{"name":"Journal of Workplace Rights","volume":"13 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"121486140","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

One element was a demonstration project in the city of Qingdao that created worker-management committees in companies to discuss and resolve workplace issues. Over an 18-month period, elected worker representatives and management appointees met bimonthly. An analysis of the records of these meetings and examples of workers’ strategies for gaining agreement provide a window on both the kinds of issues of concern to workers and also the tactics used by workers to seek agreement. The worker-management meetings provide a possible approach to introducing greater workers’ voice into the management routines of Chinese companies.","PeriodicalId":382067,"journal":{"name":"Journal of Workplace Rights","volume":"30 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"127925250","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The study opts for in-depth gender knowledge derived from the positions of women workers and their social security needs. It examines how the social security needs have been understood, conceptualized, and articulated. And it argues for the creation of a wider space for the development and dissemination of gender knowledge.","PeriodicalId":382067,"journal":{"name":"Journal of Workplace Rights","volume":"175 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"128273614","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

However, there has not until now been a study investigating the work experiences of Nepali immigrants/migrants employed in the service and domestic sectors in these cities. This article investigates the work experiences of Nepali female migrants who work in service and domestic/child care work in Boston and New York, focusing on examining the type and nature of women’s work, labor practices, work and living conditions, women’s experiences and views about their work, and their responses to labor policies. The data for this research were collected through semistructured, informal, in-depth interviews and narrative collection in 2005-2006. Twenty research participants (16-65 years of age) were selected using snowball sampling. The cases of Nepali women reported here support existing literature asserting that migrant/immigrant women are greatly involved and preferred in domestic (including child care) work, and that they encounter labor exploitation, emotional abuse, and prejudice. By demonstrating the downward occupational mobility/status of educated professional Nepali female migrants, however, this study also deconstructs the myths *The first version of this article was presented at the International Sociological Association conference in Barcelona, 2008.","PeriodicalId":382067,"journal":{"name":"Journal of Workplace Rights","volume":"1 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"129280085","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

By activating their rights, they reassert their multiple identities as Filipina immigrants, Australian citizens, and skilled workers, although many agonise for a long time before seeking redress. Experiences of discrimination affect them in various ways, ranging from stalled career progression to negative effects on their self-esteem and psychological well-being. For many, workplace prejudices have made them more aware of their cultural difference from the majority population; but for others, their health and esteem have been so dented that they have resigned from their jobs. Looking through the lenses of gender, race, and class intersectionality, this article also explores the ramifications of the stigmatisation of Filipinas as mail-order brides in the workplace, and, to some extent, in Filipino immigrants' social circles.","PeriodicalId":382067,"journal":{"name":"Journal of Workplace Rights","volume":"40 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"125692958","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

These structural changes imply the redefinition of health and safety standards and the introduction of a new analytical category, called “vulnerable work.” In order to contribute to the debate, this article presents the results of a qualitative research project on the health and safety conditions of temporary workers carried out in a province of northeastern Italy. First, the aim of the article is to highlight the hazards and risks faced by temporary workers, which contribute to the production of a specific condition of vulnerability. The culturalist approach adopted here shows that the construction of (un)safety at work is the result of the intersection among different dimensions of vulnerability. Second, the article has an operational goal. On the basis of the research results, in particular on the basis of the interviews conducted with key informants, some recommendations for policymaking and human resource management are provided. In particular, the article points out that injuries sustained by temporary workers are often the consequence of an underestimation both of their specific risks and of a more general state of vulnerability.","PeriodicalId":382067,"journal":{"name":"Journal of Workplace Rights","volume":"62 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"131279303","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Commentators have noted the growth in civil society organizations, such as the Citizens Advice Bureaux in the UK, which can provide information, advice, and support to nonunionized employees. In this context, we examine the role of the Irish Citizens Information Services (CISs) in the area of employment. The CISs are state-funded services that provide information and advice to members of the public on their legal and social entitlements. We find that the CISs are an important mechanism by which nonunionized employees can self-empower. The advocacy role of CISs could go some way to protecting unionized employees but is in its infancy, and an expansion of the advocacy service would increase protection for nonunionized employees.","PeriodicalId":382067,"journal":{"name":"Journal of Workplace Rights","volume":"149 7","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"114004906","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
