Sousa","doi":"10.36745/IJCA.388","DOIUrl":"https://doi.org/10.36745/IJCA.388","url":null,"abstract":"The crisis caused by COVID-19 has triggered a series of changes at the global level, resulting in a rapid change in the way social relations are organized. The state is no exception to this complex scenario, and is responsible for making available to citizens the various administrative provisions essential to life in society, one of which is justice. In this context, the aim of the present work is to analyse the institutional response of the judiciary branch in Brazil to the pandemic period of the new coronavirus, contrasting the normative actions taken by the judiciary with the results obtained with these interventions. To that end, at first, the main regulations that have underpinned the conduct, positioning and action of the judiciary since the beginning of the crisis in Brazil, which occurred in March 2020, were collected and analysed in a total of 57 official documents issued by the Brazilian justice authorities. A posteriori, the report “Assessment of the impacts of the pandemic caused by COVID-19 on the court’s work processes” was analysed, which includes analyses related to the adoption of rules relevant to issues of administrative management, procedural management and also the perceptions of impacts and difficulties due to the pandemic, as well as the other official documents published by the National Council of Justice – CNJ that provides statistics about the judicial indicators in times of pandemic. The data show a fast and comprehensive performance in the various fields in which justice operates, revealing a concern with health, social, administrative issues, among other aspects. The Judiciary has acted in an administrative unit, based on the regulations of a higher authority or of higher courts. © 2021. Although judicial professionals are recognised as having a highly demanding working environment and are one of the groups most vulnerable to occupational stress, studies on this subject are scarce and relatively new. These can be divided into two distinct categories: psychology research studies centred on psychosocial risks and professional stress and burnout; and studies in the field of the sociology of law on questions such as job satisfaction and organisation of work. This review aims to highlight the increasing importance of pursuing studies on the working conditions of professionals responsible for delivering justice with quality and guarantees for all citizens. Shi, Tania Sourdin, Bin Li","doi":"10.36745/IJCA.367","DOIUrl":"https://doi.org/10.36745/IJCA.367","url":null,"abstract":"As with other jurisdictions, China has introduced a range of newer technologies into its justice sector to promote greater access to justice, improve judicial transparency and to promote just outcomes for disputing parties with legal issues. Chinese courts’ practice of embracing technology is unique as an overarching approach has been adopted by the central government to build the ‘smart court’ system across the entirety of its courts. Arguably, the smart court system, which relies on computer technologies that enable big data use, blockchain formation and advisory and determinative forms of artificial legal intelligence, has, to a certain degree, promoted easier access to justice, enabled faster dispute resolution, saved costs by moving judicial process online and ensured that judgments can be enforced. On the other hand, however, there are concerns relating to the use of some technologies that include the use of automated judgments, digital divide issues, judicial independence, as well as issues linked to privacy and data protection.
