When considering threshold policies with constant levels of mitigation for a time period, the overall fatality rate in the population is non-monotonic in the levels of mitigation: higher levels of mitigation can increase the overall fatality rate. The review examines data coverage by country; econometric models; and results for under- or overshifting by beverage. Several primary studies indicate substantial over-shifting of alcohol taxes. Median rates also suggest taxes are overshifted. Precision weighted-averages calculated for two samples show beer taxes are overshifted and wine-spirits taxes are fully shifted. Meta-regressions corrected for publication bias indicate, however, that full-shifting of alcohol taxes cannot be rejected for any beverage. After briefly looking at the context of private enforcement of competition law in Spain, it examines the process followed for the transposition and the issues discussed before the adoption of the Transposition Decree in May 2017. Overall, it can be affirmed that the new rules comply with the mandates of the Directive, only in a few matters there seems that there will be doubts concerning the interpretation of the new provisions. Este trabajo pasa revista a la reciente casuística española y analiza críticamente el tratamiento otorgado a estas intervenciones de las administraciones públicas por las autoridades de competencia españolas. <b>English Abstract:</b> Occasionally firms’ anticompetitive conducts have been preceded or coupled with public powers actions that incentivize, promote or sponsor them. In other cases competition restraints come directly from administrative action without legal coverage that distort market functioning. Recent decisions of Spanish Competition Authorities offer several examples of some of these situations, which are neither unknown in other jurisdictions. Enacted in 1986, EMTALA vastly expanded Medicare’s initial focus on elderly and disabled beneficiaries and imposed enormous financial liabilities. Neither the Supreme Court nor any Circuits have addressed EMTALA’s constitutionality.This Article proposes that EMTALA violates the Fifth Amendment’s Takings Clause. First, it imposes a host of individual takings as the government forces one private party — the hospital — to transfer personal property to another private party — the patient. Here, violations depend on whether the hospital is justly compensated.Second, EMTALA as a whole is an “unconstitutional condition” imposed on hospitals’ participation in Medicare. Although the government can properly attach “strings” to ensure public funds are spent as Congress intended, the government cannot with impunity require persons to waive fundamental constitutional rights as a condition for receiving a government benefit. Individuals living inside the charging zone are eligible for a 90% discount of the charge. Using a geographical information system (GIS), we analyse full-digit post code information to precisely identify the eligibility of the discount for survey participants in the London Travel Demand Survey 2005-2011. We employ a boundary regression-discontinuity design, and find no evidence that the financial incentive promotes active commuting (cycling and walking) or improves general health status around the border of the congestion charging zone. Rowell","doi":"10.2139/SSRN.2062987","DOIUrl":"https://doi.org/10.2139/SSRN.2062987","url":null,"abstract":"The National Highway Traffic Safety Administration (NHTSA) is considering promulgating a rule to increase rearview visibility in vehicles—a rule intended to reduce backover crashes, which occur when a vehicle moving in reverse strikes a pedestrian or a cyclist, and which kill hundreds and injure thousands of people a year. In performing a cost-benefit analysis of the proposed rule, NHTSA has refused to monetize many of the most emotional impacts of the rule, including the fact that many of the victims of backover crashes are small children. Without including these impacts, the monetized costs of the rule far exceed the monetized benefits. This Article argues that treating these effects of the rearview rule as nonmonetizable assumes that people are willing to pay no money to secure those effects, and that it is therefore likely to lead to significant undervaluation of the amount of money people are actually willing to pay for the regulation. Regulators are often averse to attempting to monetize the nonmonetary effects of regulations, particularly when those effects are deeply emotional, as they are whenever regulation touches upon the death of small children. Insofar as this hesitation to monetize stems from concern about the incommensurability of money and other goods, it should cease immediately. Incommensurability does not necessarily preclude partial valuation, or the partial expression of a good’s value in terms of another good. Even something as horrific and emotionally laden as the death of a child can therefore be partially valued in monetary terms—so long as people are willing to pay money to prevent the event from occurring. However, attempts to reduce insurance company profits could affect the quality of care that they provide to their enrollees. This study investigates whether there is a relationship between the profitability of an HMO and the quality of care that its enrollees receive. The sample is comprised of health maintenance organizations in Texas from 2000 to 2008. Quality of care is proxied by HEDIS compliance rates for selected child and female health measures, while profits are measured both on a dollar and percentage basis. Annual data are used that are disaggregated by market area. The results suggest that there is a statistically significant relationship between profits and some measures of quality. Specifically, the child health measures used here are positively related to profits, in that increases (decreases) in profits are associated with increases (decreases) in quality. By contrast, there is not a statistically significant relationship between the available female health measures and profits.
