Baldini. This view, undoubtedly, represents a novelty in the understanding of this category of art; as such, it remains a contribution to aesthetics. Nevertheless, within the framework of the presented theory, subversiveness is combined with legal judgment and violation of the law. These circumstances situate the theory within the field of interest of legal studies; and from this perspective, it deserves criticism. This is because the theory does not contain precise determinants of the difference between legal and aesthetic judgments, nor does it equip the constructed criterion of street art with the ability to resolve conflicts between norms relevant to subversiveness; and it is the demonstration of these gaps, as well as proposals to fill them in the context of legal science that are the subject of this article.","PeriodicalId":36398,"journal":{"name":"Krytyka Prawa","volume":"9 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135487743","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Pracownik może w szybkim tempie pozyskać potrzebną informację i ewentualnie ją wykorzystać. Wobec tego czy dzielenie się wiedzą może być dalej atrakcyjnym sposobem przepływu wiedzy w przedsię-biorstwie? Niewątpliwie tak, wszystko zależy od tego, w jaki sposób pracodawca zarządza tą wiedzą, stymuluje i zachęca pracowników do dzielenia się wiedzą. Niezależnie od mechanizmów, które zastosuje pracodawca, pracownik nie ma jednak obowiązku dzielenia się wiedzą, jeżeli to wykracza poza zakres pracy, na którą strony umówiły się w treści umowy o pracę. Tym samym pracownik nie może ponosić odpowiedzialności tak porządkowej jak materialnej, jeżeli wiedzą się nie dzieli z innymi pracownikami.","PeriodicalId":36398,"journal":{"name":"Krytyka Prawa","volume":"10 6 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135487750","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

India’s growth story has remained incomplete due to a lack of required employment growth. The new law consolidates 44 primary labour laws into four main labour codes: pay, industrial relations, occupational safety, working conditions and social security. It was a conniving move on the part of the government to completely overhaul our labour laws. Given that we typically lack mean labourers by a significant margin, the question that remains is whether or not this can attract investors. There are several challenges that must be overcome before the economy can reach $5 trillion in 2025.","PeriodicalId":36398,"journal":{"name":"Krytyka Prawa","volume":"37 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135487761","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It aims to bring all these parties together to collectively resolve the consequences of crime, including the harm caused, with a view to future generations. In the Indonesian legal system, restorative processes have not yet been used to deal with environmental crimes, despite a growing interest in exploring their potential. Therefore, this paper seeks to demon-strate that restorative justice solutions addressing environmental crimes benefit the victims, the offenders, the community and the environment. Further, these solutions may prove to be useful as well as additional discretion to local authorities for redressing the damage to the environment.","PeriodicalId":36398,"journal":{"name":"Krytyka Prawa","volume":"357 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135487748","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Poland has introduced a new statute and has amended general rules applicable in mass influx situations. That area of law is regulated also by Directive 2001/55/EC which establishes a minimum standard of displaced persons’ rights, leaving their financing primarily to national budgets. The Council Implementing Decision (EU) 2022/382 is the first law which has activated the Directive. Under the amended Polish law, support to persons from Ukraine is subject to the avail-ability of national financial resources, which contradicts the principles of public finance law because Polish law does not establish predictable sources of financing, and spendings are not controlled by the Polish Parliament.","PeriodicalId":36398,"journal":{"name":"Krytyka Prawa","volume":"58 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135488030","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

W opracowaniu przestawiono złożony status doktoranta, na który składają się zarówno obowiązki publicznoprawne, jak i cywilnoprawne (wynikające z indywidualnego planu badawczego) oraz zarysowano model należytej staranności w nauce (obowiązujący też doktoranta). Okazuje się, że w pierwszym okresie studiów doktoranckich istotny wpływ na rozwój naukowy doktoranta ma jego bezpośrednie uczestnictwo w zaję-ciach. Niestety, w praktyce okazuje się, że instrumenty prawne, które posiada szkoła doktorska w zakresie kontroli tego obowiązku są nieefektywne, gdyż nie ma możliwości weryfikacji autentyczności zwolnień lekarskich. W ostatniej części przedstawiono więc publicznoprawne sankcje ze wskazaniem, jakie zmiany należałoby wprowadzić w obowiązujących przepisach, aby zapobiec nadużyciom w pobieraniu stypendium przez osoby, które tylko pozorują działania naukowe. Te zmiany nie spowodują dodatkowych kosztów w finansach publicznych, lecz tylko uszczelnią ten system.","PeriodicalId":36398,"journal":{"name":"Krytyka Prawa","volume":"14 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135487749","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The need to maintain social distance has accelerated changes in the judi-ciary. Remote hearings have emerged. The article attempts to answer the question of whether the e-hearings currently taking place are held in accordance with the principle of equality in view of the phenomenon of digital exclusion occurring in Polish society. An empirical study of remote hearings conducted by a student research group and the author’s own experience in this field make up the empirical resources documenting the technical issues that occur during remote hearings and problems related to digital exclusion.","PeriodicalId":36398,"journal":{"name":"Krytyka Prawa","volume":"45 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135487764","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Aksjologia tego obszaru prawa charakteryzuje się wyjątkową złożonością. Szczegółowym celem badań jest poszukiwanie odpowiedzi na pytania: (a) na jakich wartościach prawodawca powinien oprzeć regulacje dotyczące lokalizacji inwestycji w zakresie elektrowni wiatrowych, aby tworzone normy mogły w sposób efektywny prowa-dzić do wzrostu wytwarzania energii z OZE, (b) czy kształt krajowych regulacji określanych jako tzw. zasada 10H stosowanych dotychczas w procesie lokalizacji inwestycji w zakresie elektrowni wiatrowych oraz kształt nowych regulacji zmierzających do liberalizacji tej zasady oparte zostały na prawidłowo wyważonym szerokim fundamencie aksjologicznym. Tylko takie normy prawa ochrony klimatu, które będą oparte na szerokim fundamencie aksjologicznym, będą akceptowane przez wszystkie podmioty, na które będą oddziaływały, a w konsekwencji będą efektywnie realizować cel, do którego zostają powołane (wzrost poziomu wytwarzania energii z OZE).","PeriodicalId":36398,"journal":{"name":"Krytyka Prawa","volume":"44 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135488028","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
