Sea ports are component part of a transport and productive infrastructure of the state and taking into account their location play key role as a “Sea Gates” to internal transport corridors.The corporate governance reform aims to create an efficient and transparent state enterprise management environment which will protect the rights of an owner, establish an effective system of internal controls and create a level playing field with commercial companies in the market in compliance with the principles of corporate governance set out by the Organization for Economic Cooperation and Development. An author marks thе functioning and development of seaports depends on a number of factors, among which the most important are the forms of management of 51 LEX PORTUS No 1 (15)’2019 seaports, the level of their technological and technical equipment, the compliance of the management system with the current international requirements, the provision of regulatory and legal framework, the own and involved sources of modernization and development of maritime infrastructure. Material Unwell-being of settlement of such factors has direct influence on efficiency of functioning of port and transport industry, but also economies of country on the whole. However this research has for an object illumination of fundamental criterion is management forms. An author comes to the conclusion about the necessity of the use for Ukraine of the best world practices from administration of port industry and decision of problems that arose up, by creation at legislative level of terms for development of marine ports with application of case of Landlord Ports frame. The key words: seaports, governance structure, state authority, strategy of development, marine industry, development plan, competition, private investments, port infrastructure. Прийняття Закону України “Про морські порти України” (далі – Закон) забезпечило впровадження нових сучасних та прогресивних форм і моделей взаємодії суб’єктів портової діяльності. Одним з ключових принципів функціонування портових галузей у всьому світі є розмежування господарських (комерційних) та адміністративних функцій. Так, наприклад стивідорна діяльність, пов’язана із відвантаженням, зберіганням на складах та перевантаження вантажів на морський транспорт вантажів, у морських портах здійснюється суб’єктами господарювання різних форм власності, які не стосуються адміністративних послуг. As a result of the study, it was found that the legal norms regulating information activities of mass media, including mass media, are imperfect and fragmentary. The mentioned institution of legislation is not yet characterized by a perfect conceptual-terminology apparatus, sufficient system and consistency with other institutes of information legislation. At 103 LEX PORTUS No 1 (15)’2019 the same time, the problem of legal regulation, organization and implementation of information operations in the current conditions of information globalization was revealed. It was concluded that the uncontrollability of some aspects of advertising activity has a negative tendency in the form of manipulative and aggressive activity by unscrupulous respondents. The problem of awareness of human rights in relation to the implementation of their respondents in everyday life was revealed. This is an important indicator of the level of legal awareness in our state. As you know, the availability of information is one of the important qualities of the information society. It was impossible not to emphasize this problem, because it is clearly expressed in Ukraine. The authors analyze the specific weight of influence among mass media on the outlook of ordinary citizens and the authority of the mass media in general.A significant disadvantage of the current Ukrainian legislation, in particular in the information sphere, is the lack of accuracy, somewhat misleading formulation. A significant proportion of information relations is regulated by subordinate legal acts, or generally rules are scattered under various legislative acts in related branches of law. This greatly complicates access to them and the correct use of current legislation. As a conclusion, it is possible to add that it is critically necessary to create a legislative act which will correspond the state of modern development of the information society in Ukraine, the norms of which will have an universal character. The author notes that the public, in particular, the state administration in the field of sea and river transport in Ukraine is currently in the process of continuous updating and finding new efficient mechanisms of regeneration and economic growth, attraction of cargo flows and reduction of ecological, energy and money expenses while simultaneously introducing new technologies and simplifications of registration, processing and transportation of cargoes. The article describes the modern system of bodies of public (state) administration in the field of sea and river transport in Ukraine, reviewed the main directions and results of their activities and provided suggestions for further improvement of organizational and legal provision of their activities, taking into account the recent updating of the Maritime Doctrine of Ukraine for the period up to 2035. It is noted that the Cabinet of Ministers of Ukraine defined the strategy and 69 LEX PORTUS No 1 (15)’2019 main directions for the further development of Ukraine as a naval state, and their implementation is entrusted to the systems of state management bodies of the marine activity. The leading components of this system include, in particular, the Ministry of Infrastructure of Ukraine, the State Service for Marine and River Transport of Ukraine, the State Enterprise «Administration of Seaports of Ukraine», captains and servicemen of the seaports of Ukraine, the State Enterprise «Classification Society The Shipping Register of Ukraine». An overview of the administrative functions of these institutions was carried out in the field of sea and river transport and the obtained and the expected results of their work were analyzed. The key words: administration, public administration, maritime transport, river transport, transport industry of Ukraine, updating of the institutional mechanism. Вступ Як відзначається у Національній транспортній стратегії України на період до 2030 року, транспортна галузь є однією з базових галузей економіки України, має розгалужену залізничну мережу, розвинуту мережу автомобільних шляхів, морські порти та річкові термінали, аеропорти та широку мережу авіаційних сполучень, вантажних митних терміналів, що створює необхідні передумови для задоволення потреб користувачів транспорту у наданні транспортних послуг та розвитку бізнесу. Так, у Чорноморському та Азовському басейнах і дельті Дунаю працюють 13 морських портів, сукупна потужність вантажообробки яких становить більш як 230 млн. т на рік. Територією України простягається 2714,5 км внутрішніх водних шляхів, що належать до категорії судноплавних. It investigates the process of establishing such institute in Ukraine and its implementation in accordance with the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on Determination of the Jurisdiction of Cases on Ship Arrest» dd. 20.12.2011 No. 4190-VI and the Law of Ukraine «On Joining Ukraine the International Convention for the Unification of Certain Rules Relating to the Arrest of Sea-Going Ships” dd. 07.09.2011 No. 3702-VI. It is noted that all the coastal states have their own national rules governing relations concerning ship arrest. In different countries, these rules may vary significantly. In today world there is a clear trend to internationalization of law, which implies its unification. Certainly, full unification of the law, including maritime law, is impossible and unlikely to be necessary, but smoothing out such differences is an objective need which has been noted by the international maritime community for a long time. There are detached terms and evidence for ship arrest to secure maritime 37 LEX PORTUS No 6 (14)’2018 claim in accordance with commercial procedural legislation valid for 2012-2017, as well as amendments thereto in late 2017. Attention is drawn to the fact that court practice which took place after updating the procedural law makes it possible to conclude that the courts, while considering the aforesaid category of cases, reduced the number of additional evidence that was previously required in order to prove the possibility of vessel leaving Ukraine, as well as have a more progressive attitude to determining the amount of counterclaim due to ship arrest. Вступ Арешт морських суден завжди мав важливе значення як для держав, так і для приватних учасників міжнародного торговельного мореплавства (судновласників, фрахтувальників, страховиків) (Жорник, 2015, с. 157). Довгий час Україна не була членом жодної з конвенцій щодо арешту суден, і це створювало враження, що наша держава знаходиться десь на узбіччі дороги, якою рухається міжнародне морське співтовариство. Лише 07.09.2011 р. Україна приєдналася до Міжнародної конвенції з уніфікації деяких правил щодо накладення арешту на морські судна від 10.09.1952 р., яку було укладено у Брюсселі. Це тоді, коли було прийнято вже нову Конвенцію про арешт суден у Женеві, датовану 1.03.1999 р., яка була підготовлена з урахуванням практики застосування Конвенції 1952 р. (Ремесло, Лебєдєв, 2016). Арешт у торговельному мореплавстві – це примусове затримання судна або вантажу на підставі рішення суду (Hill, 1985). При цьому якщо арешт вантажу здебільшого здійснюється у звичайному цивільно-правовому порядку, то арешт такої категорії майна, як морські судна, у більшості країн має специфічні особливості.
