Mashinnikova","doi":"10.21869/2223-1501-2022-12-6-72-84","DOIUrl":"https://doi.org/10.21869/2223-1501-2022-12-6-72-84","url":null,"abstract":"The relevance of the study is due to the inconsistency of the purpose of criminal proceedings formulated in Article 6 of the Code of Criminal Procedure with its goals set out in Article 297 of the Code of Criminal Procedure, which can only be achieved through an adversarial form of criminal proceedings. This discrepancy creates problems of law enforcement, which in turn reduce the effectiveness of criminal proceedings in general. The purpose is to study the criminal procedure legislation of the Russian Federation regarding the possibility of a verdict in the case corresponding to Article 297 of the Code of Criminal Procedure of the Russian Federation. The objectives of the study are: the study of criminal procedural norms in their interaction for the possibility of achieving the result indicated in Article 297 of the Criminal Procedure Code of the Russian Federation in criminal pro-ceedings, as well as the analysis of various positions on this issue. Methodology. The methodological basis of the research is the method of dialectical scientific cognition; a sys-tematic approach to the problem under consideration, a historical method, a formal logical method, etc. Results. In the course of the research, the defects of the criminal procedure legislation were revealed in terms of its internal contradictions between the purpose, form and goals, which do not always allow a lawful, reasonable and fair sentence to be passed in the case. Conclusion. The current criminal procedure legislation proceeds from different approaches to the concept of justice (as a means and an end). Meanwhile, justice as a means (the equivalence of the rights of the parties participating in criminal proceedings) in the adversarial process does not ensure the achievement of a fair decision in the case, and the purpose of criminal proceedings as its function does not allow achieving the goal of criminal proceedings, which generates problems of law enforcement, which in turn reduce the effectiveness of criminal proceedings as a whole.","PeriodicalId":359562,"journal":{"name":"Proceedings of the Southwest State University. In the first decades of the XXI century, the quality of prefecting musical education occurred in Russia. Outlooking programs implemented in children's music schools and musical departments of children's art schools do not allow students to fully master the game on musical instruments and get vocal skills necessary to continue vocational education. The beneficial effect on the improvement of the named region may also have an analysis and subsequent introduction into the practice of past experience, the achievements of the preceding generations of compatriots. The purpose of this article is to cover approaches to the organization of educational activities and the educational process in institutions of initial professional music training of the Ulyanovsk region in the 1990s. The objectives of the study: to determine the basic principles of the state policy of the 1990s in the field of do-mestic education as a whole and musical education in particular; explore and summarize published and unpublished materials containing information on approaches to the organization of educational activities and educational process in the children's schools of the arts of the Ulyanovsk region in the 1990s. Methodology. Regulatory legal acts and archival documents were made as sources of this work. The study was also carried out with a support for published materials (monographs, articles). The paper used a number of scientific approaches, the main of which were the principle of objectivity, the method of system analysis, historical and comparative and historical and typological methods. Results. The study showed that in the 1990s, the Ulyanovsk region had accumulated positive experience in the implementation of educational programs in the field of musical art in institutions of primary professional music training, which can be used today. In particular, issues were effectively solved with the creation of the publicly available to this type of education, ensuring the continuity of the training of educational and continuity of educational programs. Conclusion. In this work, the author examines the history of the formation of consumer protection legislation in accordance with the socio-economic circumstances in Vietnam in general and civil circulation in particular. Consumers are involved in civil circulation as subjects of civil law, however, they are considered a \"weaker side\" in relation to the counterparty. Consequently, the formation of a special legal mechanism is extremely necessary to protect the legitimate rights and interests of consumers. The aim of this work is to study the genesis and development of the legal institution for consumer protection in the Socialist Republic of Vietnam. The objectives of the study are to analyze important innovations in the 2010 Consumer Protection Act compared to the previous 1999 Consumer Protection Ordinance; define the concept of \"consumer\" under the laws of Vietnam and other countries, thereby establishing the most complete and clear definition of \"consumer\". Methodology. In the process of research, the author used general scientific methods of cognition (analysis, synthesis, deduction, induction) and special methods (comparative legal, descriptive, historical method, etc.). Results. Vietnamese consumer protection legislation establishes the relatively complete legal status of these participants in civil law relations, including their fundamental rights in accordance with UN guidelines, manufacturer's liability for violation of consumer rights and measures to ensure a legal mechanism for resolving disputes with con-sumers. Conclusion. Consumer protection is currently a fairly important institution in Vietnam, which is strictly regulated by regulatory legal acts and guaranteed by the state and its competent authorities. At the same time, undoubtedly an important component today is the staffing of a modern school with appropriate specialists. In this connection, the appeal to historical experience in the field of physical education work with schoolchildren in the pre-war years is certainly relevant and useful. The purpose of the research is to reveal the problems of staffing physical education work in schools of the Kursk Region in the period from 1918 to 1940 of the twentieth century. Objectives: to identify the main problems of staffing physical education work in schools of the Kursk Region in the designated period of time and to trace the main directions in solving this issue. Methodology. The methodological basis of the research was the main methods of historical science: the prin-ciples of historicism and objectivity; analytical, comparative – historical, historical-chronological, historical-genetic methods. Results. The problems faced by the Soviet school during its formation are associated with an acute shortage of qualified personnel, in particular in physical education work. In order to fill the \"niche\" assigned to the physical education teacher in the school team and physical education lessons, people with little knowledge in pedagogy and physical education were allowed to conduct classes. So in some schools, physical education classes were conducted by former officers, warrant officers, teachers of other subjects. The personnel problem was also associated with a large turnover of personnel from the composition of physical education instructors. In addition, classes were conducted according to the old methodology, which did not meet the requirements of the new time. Conclusions. The specifics of staffing problems are related to the shortage of physical education teachers, staff turnover, outdated methods of teaching physical education at school. The main direction in solving the staffing of physical education work in the schools of the Kursk Region in 1918 – 1940 of the twentieth century was the organization of advanced training courses for physical education teachers.","PeriodicalId":359562,"journal":{"name":"Proceedings of the Southwest State University. The current lack of a holistic scientific understanding of family entrepreneurship as a special legal phenomenon is due to the lack of scientific research on this topic, the lack of consistency in their implementation. The lack of coherent doctrinal approaches, in turn, leads to the fact that legislative regulation on issues related to family entrepreneurship is developing in a non-systematic way, within the framework of individual legislative acts, without taking into account the specifics of existing problems and gaps in legal regulation. The science of civil law reveals a number of inconsistencies between the approaches to the regulation of entre-preneurial activity and the regulation of family legal relations. This necessitates the development of a holistic scientific understanding of family entrepreneurship as a special legal phenomenon. The purpose of the research is to develop theoretical provisions aimed at creating a holistic scientific under-standing of family entrepreneurship as a special legal phenomenon, taking into account the peculiarities of entrepre-neurial activity with the participation of family members, the need to protect the rights of participants of such activities and third parties. Objectives: to determine the totality of features of family entrepreneurship as a special legal phenomenon; to determine the features of the balance of interests in the conduct of business in the form of family business; to identify areas for further development of legal regulation of the issues under consideration. Methodology. In carrying out this study, the dialectical-materialistic method, the systematic method, methods of analysis and synthesis, the formal-legal method were applied. The results of the research are of a theoretical and applied nature and are aimed at improving the quality of legal regulation of civil legal relations. The conclusions made in the article are of debatable character, are aimed at continuing research in the framework of the declared subject, at developing basic principles that allow to solve problems related to family entre-preneurship in a uniform way. Scientific typification of past events is one of the most common results, obtained in the course of historical research. At the same time, as a rule, we are talking about using only one typological feature and only one level of typing. This gives relevance to the consideration of the issue of establishing multidimensional and multilevel typing. Purpose of the article is to familiarize the professional community of historians with the experience of establishing a multidimensional and multilevel typification of the subject of research. The objective of the article is to establish the typification of the meteorological support of the Red Army Air Force and demonstrate by its example the practical application of the historical and typological method. Methodology. The use of the historical-typological method has become widespread in conducting historical re-search. In particular, it was used in the study of the history of meteorological support of the Red Army Air Force during the Great Patriotic War. Results. It was proposed to streamline the subject of the study by identifying types in it based on the estab-lishment of common inherent features. For this purpose, three typological features were used: the level of military man-agement, the regularity of meteorological support and the specifics of the activities of the Air Force. As a result, mul-tidimensional typing was obtained. The third type was subjected to further detail, which allowed us to talk about its second level. All conclusions and provisions are illustrated by concrete examples from the experience of aviation me-teorologists in providing the Air Force during the Great Patriotic War. Conclusion. The possibility of using the historical-typological method to establish multidimensional and multilevel typing is shown by the example of a specific subject of research. It is established that the use of this method should be preceded by the use of a descriptive method. The scientific base, created in the Soviet period, confirmed the cor-rectness of the scientific and engineering decisions taken during its creation, made it possible to accumulate experience for improving the thermal power industry. The purpose of the study is to identify the facts of the development and practical activities of the domestic scientific base in the field of thermal energy during the years of Soviet power. The objective of the study is to analyze the features of the work of scientific institutes in the field of the devel-opment of domestic district heating at various stages of formation. Methodology. In the course of the analysis of various scientific sources, various methods were used: problem-chronological, historical, comparative methods. Thus, the choice of the historical method is applied due to the study of the dynamics of the development of the domestic science of thermal energy. Results. In the course of studying and generalizing various literary and archival sources, the study proved the fact that domestic scientific institutions have developed intensively and over the years have reached significant proportions, which have determined the development of modern thermal energy. Conclusions: In the process of studying various literary and archival sources, it can be concluded that the do-mestic scientific base in the Soviet years allowed for the perfect supply of heat energy to industrial and residential buildings of the Soviet state. {"title":"\"Lord, Help me to Pass the exam\": Orthodox Practices of Soviet Pupils in the 1940s-1960s","authors":"A. V. The purpose of the paper is understanding the phenomenon of mass involvement of Soviet pupils (schoolchildren, students of colleges and universities) in Orthodox practices in the 1940s-1960s. Objectives: analysis of the the extent of the spread of Orthodox practices among Soviet youth in the post-war decades; studying the forms of participation of schoolchildren and students in the church life of the period under review; identification of the degree of stability of these forms in conditions of state opposition to the development of confessional culture. Methods. The main methods that were used in the course of the research were historical-analytical, historical-genetic and historical-statistical methods, as well as elements of micro-historical analysis. Results. The paper shows that the degree of familiarization of Soviet pupils with Orthodox practices in the 1940s-1960s was significantly higher than Soviet propaganda tried to imagine. Church services were attended not only by representatives of the older generation, in the post-war decades they were actively attended by school-age children and students. In places where was a clear shortage of Orthodox priests and churches, young people were involved in spontaneous practices of a folk worship. Conclusions. The paper concludes that the main moments of the transfer of confessional traditions to children and young people in the USSR were religious holidays, primarily Christmas, Epiphany, Easter. The Day of Knowledge also had a religious dimension for some schoolchildren. State policy had a significant impact on the forms of introducing children and young people to church life. The anti-religious actions of the authorities reduced the level of pupils' presence in the public church space, but did not destroy the interest of young people in Orthodox culture. An important role in maintaining this interest was played by the semi-patriarchal way of life that persisted in many Soviet families in the post-war decades.","PeriodicalId":359562,"journal":{"name":"Proceedings of the Southwest State University. The func-tioning of medical institutions in the postwar period took place in difficult conditions not only in the liberated territory, but also in the rear regions, as the consequences of the Great Patriotic War for the country and all the peoples of the former Soviet Union were enormous. Currently, Russian and Kazakh historiography lacks comprehensive studies on this issue, and the available works are mostly fragmentary in nature. The purpose of the research is to study the problems of medical and sanitary-preventive institutions, the state of health of the population of the Aktobe region of the Kazakh SSR in the post-war years. Objectives: on the basis of the documents of the State Archive of Aktobe region to analyze problems such as the shortage of medical personnel in the region, poor material - technical support and poor sanitary condition of medical institutions, to assess the extent of the spread of various infectious diseases, especially among the rural population. Methodology. The source base of the research includes published materials and archive documents. In the work were used scientific methods, typical for historical research: historical-genetic, comparative-historical. Results. The study showed that in general the state of medical institutions during the late Stalinism period in the territory of Aktobe region was unsatisfactory. The study of published sources and archival documents allowed us to reveal the real picture of the need and scarcity in the hospital institutions in the postwar years, as well as to assess the government attempts to reform the system of outpatient and polyclinic institutions. Conclusion. Deterioration of public health, which resulted in a decrease in the birth rate and increased mortality, arose as a result of the Great Patriotic War. Low provision of equipment, medical instruments contributed to the decline in the quality of medical care. The legislative regulation of this principle does not allow us to say that it is effective in the course of practical activity. The purpose of the research is to consider the operation of the principle of adversarial nature at various stages of the criminal procedure, as well as the theoretical concepts of its strengthening in the criminal procedure. The objectives of the research: to conduct a retrospective research of the implementation of the principle of competition in the criminal procedure of Russia, to consider various approaches to the definition of competition, to analyze proposals for strengthening competition in the criminal procedure of Russia. Methodology. Methodological basis of research is a general scientific dialectical method as a method of scientific knowledge; a systematic approach to the problem, historical method, formal-logical method, etc. Results. The strengths and weaknesses of the adversarial criminal procedure were identified, the possibility of introducing a lawyer's investigation, reviving the institute of investigative judges, creating a special court apparatus to ensure the independence of judges was considered. Conclusion. The existing criminal procedure system has long been formed in the conditions of authoritarian state power, which has left its mark on the operation of the principle of competition in the criminal procedure of Russia. Its manifestation to a greater extent at the trial stage is due to the presence only at this stage of an independent subject in the form of a judge, who can provide equal opportunities for the prosecution and the defense to participate in the consideration of a criminal case. In addition, there is no conceptual contradiction to the principle of competition in the fact that the presiding judge can act actively because the law imposes on him responsibility for the justice of the sentence.
